Preliminary Investigation Of The Extent And Effects Of Sediment Contamination In White Lake Near Whitehall Leather Tannery, Richard Rediske, Gary Fahnenstiel, Tom Nalepa, Peter Meier, Claire Schelske Dec 1997

Preliminary Investigation Of The Extent And Effects Of Sediment Contamination In White Lake Near Whitehall Leather Tannery, Richard Rediske, Gary Fahnenstiel, Tom Nalepa, Peter Meier, Claire Schelske

Scientific Technical Reports

By using a combination of chemistry, toxicological evaluation, ecological analysis, and radiodating, this investigation has defined the ecological effects and the nature and extent of sediment contamination in the Tannery Bay area of eastern White Lake. The sediments in Tannery Bay represent a source of chromium transport for most of the eastern basin of White Lake. The recent deposition of chromium contaminated sediments exceeding 500 mg/kg in down gradient locations shows that export processes are responsible for the movement of this material from Tannery Bay. Arsenic and mercury appear to be less mobile and are retained in the sediments of …

The Use Of Profiling To Target Services In State Welfare-To-Work Programs: An Example Of Process And Implementation, Randall W. Eberts Oct 1997

The Use Of Profiling To Target Services In State Welfare-To-Work Programs: An Example Of Process And Implementation, Randall W. Eberts

Upjohn Institute Working Papers

The purpose of this paper is to provide preliminary information about the design of a pilot project to test the efficacy of profiling and referring welfare-to-work participants. Welfare reform requires welfare recipients, with few exceptions, to participate in work activities and ultimately become economically self-sufficient. Welfare recipients possess a wide variation in job readiness skills, ranging from those who are ready and able to work to those who face significant barriers to employment. The challenge of the local administrator of welfare-to-work programs is to target services to those who need them the most. Yet, most programs provide the same services …

Concentrations And Isotope Ratios Of Dissolved Inorganic Carbon In Denitrifying Environments, C. Nascimento, Eliot A. Atekwana, R. V. Krishnamurthy Jun 1997

Concentrations And Isotope Ratios Of Dissolved Inorganic Carbon In Denitrifying Environments, C. Nascimento, Eliot A. Atekwana, R. V. Krishnamurthy

Geosciences and Geological and Petroleum Engineering Faculty Research & Creative Works

We measured the concentration and isotope ratio of dissolved inorganic carbon (DIC) in groundwater associated with denitrification (Corg + NO3- = CO2 + N2) in an agriculturally impacted site in southwestern Michigan. Samples with the lowest nitrate levels also had low dissolved oxygen content and were more depleted in δ13C than background groundwater. All the samples had DIC concentrations in excess of titratable alkalinity. The magnitude of this DIC in excess of alkalinity correlated with a decreasing δ13C attesting to the presence of CO2 derived from organic carbon. Carbon …

Innocents Beware: Has Bennis V. Michigan Made Asset Forfeiture Too Easy?, Ronald F. Labedz May 1997

Innocents Beware: Has Bennis V. Michigan Made Asset Forfeiture Too Easy?, Ronald F. Labedz

Northern Illinois University Law Review

This note examines the historical justifications of asset forfeiture as well as the justifications behind its more recent uses. The note begins by analyzing the rationale of precedents that have upheld asset forfeiture then that rationale is applied to the facts of Bennis v. Michigan. After establishing that the exigencies historically thought necessary to justify asset forfeiture are not present in Bennis, the author determines the Supreme Court improperly applied precedent and instead should have conducted a due process analysis. The author argues that had the Supreme Court conducted that analysis, the Court would have held Michigan's asset forfeiture scheme …

Damned For Using Daycare: Appellate Brief Of Jennifer Ireland In Ireland V. Smith, Julie Kunce Field Jan 1996

Damned For Using Daycare: Appellate Brief Of Jennifer Ireland In Ireland V. Smith, Julie Kunce Field

Michigan Journal of Gender & Law

At issue is custody of three-and-a-half-year-old Maranda (date of birth: April 22, 1991). The trial court found that Maranda had an established custodial environment with her mother, Jennifer Ireland, but then nominally ordered custody changed to Steven Smith. The court's order changing custody was based on a determination that day care is an inappropriate choice for care of a preschool child, and that no one effectively can be a single parent and a student at the same time. Those findings have no factual basis in the record, no legal basis under Michigan law, and no logical or even common sense …

A Study Of The Concomitant Problems Facing Most Of The "At-Risk" African American Students In The Benton Harbor Elementary School System: A Case For An Alternative Model, Simon M. Honore Jan 1996

A Study Of The Concomitant Problems Facing Most Of The "At-Risk" African American Students In The Benton Harbor Elementary School System: A Case For An Alternative Model, Simon M. Honore

Dissertations

Problem

It would appear that the problem of school truancy, retention, and subsequent academic failure is a major educational crisis which puts most of the African American students at risk in the Benton Harbor area schools.

Purpose

The purpose of this study has been to determine the concomitant educational problems facing the "at-risk" African American students in the Benton Harbor Elementary School System and to suggest positive changes through an alternative model.

Results

The results of the survey indicated that approximately 90-95% of Benton Harbor educators agreed to changes. Administrators and teachers strongly agreed that the recommendations, based on the …

Why Hard Cases Make Good (Clinical) Law, Paul D. Reingold Jan 1996

Why Hard Cases Make Good (Clinical) Law, Paul D. Reingold

Articles

In 1992, when the University of California's Hastings College of Law decided to offer a live-client clinic for the first time, its newly hired director had to make several decisions about what form the program should take.1 The first question for the director was whether the clinic should be a single-issue specialty clinic or a general clinic that would represent clients across several areas of the law. The second question, and the one that will be the focus of this essay, was whether the program should restrict its caseload to "easy" routine cases or also accept non-routine, less controllable litigation. …

Seniority, External Labor Markets, And Faculty Pay, Byron W. Brown, Stephen A. Woodbury Jul 1995

Seniority, External Labor Markets, And Faculty Pay, Byron W. Brown, Stephen A. Woodbury

Upjohn Institute Working Papers

We estimate the returns to seniority (the wage-tenure profile) for university faculty, and the degree to which these returns respond to entry-level salaries (or opportunity wages) a relationship unexplored in work to date. Using data on faculty at a Big Ten university (ours), we estimate elasticities of senior-faculty salaries with respect to entry-level salaries, and find that these elasticities decline with seniority. The evidence both provides an explanation of faculty salary compression and suggests the importance of controlling for entry-level salaries in obtaining estimates of the returns to seniority.

Electronic Mail And Michigan's Public Disclosure Laws: The Argument For Public Access To Governmental Electronic Mail, Daniel F. Hunter Jun 1995

Electronic Mail And Michigan's Public Disclosure Laws: The Argument For Public Access To Governmental Electronic Mail, Daniel F. Hunter

University of Michigan Journal of Law Reform

This Note explores the potential for citizens to request electronic mail (e-mail) records from government agencies using public disclosure laws, with emphasis on the Michigan Freedom of Information Act (FOIA). E-mail is a medium that has come to replace both telephone calls and paper documents for many purposes. The applicability of public disclosure laws to e-mail, however, is less than clear. Telephone conversations by public employees for most purposes are confidential, while paper records created by those same employees can be requested under the FOIA. Thus, should public e-mail remain private and confidential or should it be subject to FOIA …

Gender Differences In Faculty Turnover, Byron W. Brown, Stephen A. Woodbury Mar 1995

Gender Differences In Faculty Turnover, Byron W. Brown, Stephen A. Woodbury

Upjohn Institute Working Papers

Over the last 15 to 20 years, colleges and universities have paid increasing attention to attracting and retaining faculty women. The rate of progress of women in academe has nevertheless been painfully slow. For example, statistics on economists collected and published by the American Economic Association (Committee on the Status of Women in the Economics Profession 1994) suggest that in recent years, about 20 percent of Economics assistant professors in graduate Ph.D.-granting departments were women, about 10 percent of associate professors were women, and under 5 percent of full professors were women. The percentage of new assistant professors who are …

Judging Girls: Decision Making In Parental Consent To Abortion Cases, Suellyn Scarnecchia, Julie Kunce Field Jan 1995

Judging Girls: Decision Making In Parental Consent To Abortion Cases, Suellyn Scarnecchia, Julie Kunce Field

Articles

Judges make determinations on a daily basis that profoundly affect people's lives. On March 28, 1991, the Michigan legislature enacted a statute entitled The Parental Rights Restoration Act (hereinafter "the Michigan Act" or "the Act"). This statute delegated to probate court judges the extraordinary task of deciding whether a minor girl may have an abortion without the consent of a parent. Nothing in law school and little in an average judge's experience provide a meaningful framework for making such a decision. Although many commentators, including the authors, argue that decisions about abortion should be left to the woman regardless of …

Community Development Banking Strategy For Revitalizing Our Communities, Rochelle E. Lento May 1994

Community Development Banking Strategy For Revitalizing Our Communities, Rochelle E. Lento

University of Michigan Journal of Law Reform

CDCUs and CDLFs may outnumber CDBs, but their scope of lending activity pales in comparison. Despite CDBs' relatively small number, their impact on their respective communities warrants an in-depth discussion of their structures and formulas for success. This Article will provide an overview of the CDBs in the United States. Part I first sets forth the legal structure and purpose of CDBs, and then reviews the history and current status of mature CDBs and emerging CDBs. Part II considers community development credit unions, after which Part III gives community development loan funds similar treatment. Finally, Part IV analyzes the potential …

The 'Right To Die': A Catchy But Confusing Slogan, Yale Kamisar Jan 1994

The 'Right To Die': A Catchy But Confusing Slogan, Yale Kamisar

Articles

Some 30 years ago an eminent constitutional law scholar Charles L. Black, Jr., spoke of "toiling uphill against that heaviest of all argumental weights-the weight of a slogan. I am reminded of that observation when I confront the slogan the "right to die." Few rallying cries or slogans are more appealing and seductive than the "right to die." But few are more fuzzy, more misleading, and more misunderstood.

Responding To Gender Bias In The Courts: Progress Without Accountability, Suellyn Scarnecchia Jan 1994

Responding To Gender Bias In The Courts: Progress Without Accountability, Suellyn Scarnecchia

Articles

On December 19, 1989, we received the final report of the Michigan Supreme Court Task Force on Gender Issues (task force report). The task force made 91 recommendations, plus an additional 18 joint recommendations with the Task Force on Racial/Ethnic Issues in the Courts. The Michigan Supreme Court, the State Bar of Michigan and other individuals and organizations have made much progress in responding to the recommendations, with one glaring omission-Although jointly recommended by both task forces as "essential to the realization of the goals envisioned in the goals envisioned in the reports," the Supreme Court has failed to appoint …
