From Commonwealth To Constitutional Limitations: Thomas Cooley's Michigan, 1805-1886, Robert Allan Olender
From Commonwealth To Constitutional Limitations: Thomas Cooley's Michigan, 1805-1886, Robert Allan Olender
SJD Dissertations
In response to what he perceived as the challenges associated with republican governance in the later portions of the nineteenth century, Michigan’s Thomas McIntyre Cooley penned his treatise concerning constitutional limitations on legislative power. In it, Cooley offered a vision of government where courts would check government power and would raise constitutional barriers against the impact of improper influences on legislators. As a student of history, Cooley grounded his beliefs and doctrines in experience, not philosophical reflections. Believing that “the fruits of speculative genius in government are of little value,” Cooley submitted that governing structures and law “must be the …

EXAMINING THE COSTS OF PROVIDING AN ADEQUATE EDUCATION
FOR MICHIGAN'S K-12 PUBLIC SCHOOL STUDENTS
by
SEAN WIGHTMAN
February 2014
Advisor: Dr. Michael F. Addonizio
Major: Educational Leadership and Policy Studies
Degree: Doctor of Philosophy
Because the Federal No Child Left Behind Act of 2001, which requires students to perform at predefined proficiency levels on state standardized testing instruments, adequate school funding has become arguably the single most important factor influencing the success of children in schools. Because State legislators are the one's primarily responsible for establishing annual budgets for K-12 public education, it is essential they are made aware …

A Study Of The 8th Grade Technology Literacy Of A Michigan Charter School, James Edward Spruill
CCAC Theses and Dissertations
As states adopt the common core state standards and next generation assessments for the 2014 - 2015 school year, the importance of students' technology literacy will increase Smarter Balanced Assessment Consortium. The next generation assessments will require students to complete technology performance tasks. For the first time in mandatory testing, students' technology literacy will directly impact a school's Adequate Yearly Progress (AYP) rating. Technology literacy is defined as the ability to operate hardware and software (computer literacy), conduct effective research for and then evaluate digital content for accuracy and merit (internet and information literacy), and digitally communicate effectively(digital media literacy). …
Developing Servant-Leaders At The Three Angels Fellowship Seventh-Day Adventist Church In The Michigan Conference, Frank Lugo
Doctor of Ministry Projects
Problem
The former elders' use of stern domineering leadership behaviors at Three Angels Fellowship Church led to a schism that caused deleterious effects and lingering debility. This schismatic experience left the church body suspicious toward the remaining elders' leadership style. The church lost lay leaders, church members, financial support, and was losing ministry opportunities because the congregation dreaded authoritarian leadership. It was clear that the biblical model of servant leadership needed to be applied by the remaining elders. This study dealt with the ministry challenges at Three Angels Fellowship Seventh-day Adventist Church by equipping the board of elders to discover …

A Broken Promise: Examining The Merit-Aid Policy And Implementation Gap In The Michigan Promise Scholarship, Nathan Daun-Barnett, Albert Hermsen, Lori Vedder, Beth Mabry
Journal of Student Financial Aid
In 2006, Michigan changed their traditional merit award to a credit contingent program based upon successful completion of 60 college credits. The Michigan Promise Scholarship was crafted by state policymakers without input from the financial aid community. This case study suggests that the change in policy resulted in two unintended consequences: 1. an administrative burden for financial aid offices resulting from the award verification process and 2. a financial burden for students during the year they are expected to be eligible for the award. The Scholarship was eliminated in 2011, but this case is illustrative for other states seeking to …

The U.S. State Department estimates as many as 27 million men, women, and children are global human trafficking victims at any given time. In 2012, only 46,570 new victims were identified. Globally, there were only 7,705 prosecutions and 4,746 convictions for human trafficking crimes in 2012. The Power To Protect Themselves: Gender, Protective Labor Legislation, And Public Policy In Michigan, 1883-1913, Amy Marie-Holtman French
Wayne State University Dissertations
This study provides a narrative of laborers' fight for legal protection through the Gilded Age and Progressive Era. Since American law was one of the most important forces in shaping and limiting workplace reform, both labor unionists and reformers used the law to try to solve labor problems. Reformers employed the law to force state control over women and children, while labor unionists attempted to craft legislation to allow working men control over industrial relations.
Although society and the law treated men as independent agents, working men were not truly free. Common law designated workers as servants. Employers denied laboring …

Closing The Regulatory Gap In Michigan's Public Trust Doctrine: Saving Michigan Millions With Statutory Reform, Kelsey Breck
Closing The Regulatory Gap In Michigan's Public Trust Doctrine: Saving Michigan Millions With Statutory Reform, Kelsey Breck
University of Michigan Journal of Law Reform
The Great Lakes are some of Michigan's most valuable and important environmental resources. The public trust doctrine requires Michigan to protect and preserve the lands along the shores of the Great Lakes for the use of future generations. Unfortunately, the public trust doctrine in Michigan is in disarray and as a result, public and private rights to the lands along the Great Lakes are poorly delineated. This Note presents an economic argument for why the public trust doctrine should be reformed to better define public and private rights to the land along Michigan's Great Lakes. It also suggests a statutory …

State Legislative Update , Benjamin Angulo, Daniel J. Romine, Matthew Schacht
Journal of Dispute Resolution
This analysis will examine the sample of bills in four parts. Because some of the proposed state bills are silent on whether their respective bills are reserved for non-commercial matters, Part II examines whether the bills apply to businesses that are parties to business-to-business international commercial contracts. Part III assesses the bills' definition of foreign law to better understand the scope of the anti-foreign law bans. Because each anti-foreign law bill initially defines foreign law as one that is created outside the U.S., Part III analyzes whether the bills' foreign law definitions include international organizations and tribunals. It is important …

A Comparative Case Study Analysis Of Administrators Perceptions On The Adaptation Of Quality And Continuous Improvement Tools To Community Colleges In The State Of Michigan, Ted B. Mattis
All-Inclusive List of Electronic Theses and Dissertations
The purpose of this study was to determine whether community college administrators in the state of Michigan believe that commonly known quality and continuous improvement tools, prevalent in a manufacturing environment, can be adapted to a community college model. The tools, specifically Six Sigma, benchmarking and process mapping have played a critical role in improving performance in the manufacturing sector. In 2008, the Obama administration made restoration of America'sEducational prominence a campaign promise and committed to the development of the American Graduation Initiative, a $12 billion plan to reform U.S. community colleges to be executed over the next decade. The …

An Examination Of The Relationship Between School Climate And Student Growth In Select Michigan Charter Schools, Benjamin P. Jankens
Master's Theses and Doctoral Dissertations

Student growth data were calculated using the fall and spring reading and math results from the Performance Series test by Scantron, and the MAP test by NWEA.

Discipleship Master Plan: A Disciple-Making Strategy For The South Flint Seventh-Day Adventist Church, Melvin S. Santos
Doctor of Ministry Projects
Problem
The lack of a disciple-making plan and irregular leadership training for members in the South Flint Seventh-day Adventist Church resulted in undeveloped and ill-equipped members operating in a reactive and survival mode leading to frustration and leader “burn outs.”
Method
The Discipleship Master Plan was developed and implemented in the South Flint Seventh-day Adventist Church in Burton, Michigan, which consisted of two major formats: (1) Four Levels of Discipleship Training, and (2) a Discipleship Master Plan Infrastructure. The four levels of discipleship focus on the development of all members. This training took place primarily during Sabbath afternoons and worship …
