An Uncertain Privilege: Implied Waiver And The Eviseration Of The Psychotherapist Patient Privilege In The Federal Courts, Deirdre M. Smith Jan 2008

An Uncertain Privilege: Implied Waiver And The Eviseration Of The Psychotherapist Patient Privilege In The Federal Courts, Deirdre M. Smith

Faculty Publications

Twelve years ago in Jaffee v. Redmond, 518 U.S. 1 (1996), the United States Supreme Court first recognized a federal common law psychotherapist-patient privilege and held that federal courts must protect confidential communications arising in psychotherapy despite the "likely evidentiary benefit" of such communications. This article examines the sharply conflicting authority in the federal courts that has developed since that landmark decision on the question of whether a plaintiff to a civil lawsuit waives the psychotherapist-patient privilege merely by seeking emotional distress damages. The federal courts' inconsistent and unprincipled approaches to this question renders the privilege itself nearly illusory and …

Sexual Harassment And Assault Experienced By Reservists During Military Service: Prevalence And Health Correlates, Amy E. Street, Jane Stafford, Clare M. Mahan, Ann Hendricks

Faculty Publications

The current investigation identified the gender-specific prevalence of sexual harassment and assault experienced during U.S. military service and the negative mental and physical health correlates of these experiences in a sample of former reservists. We surveyed a stratified random sample of 3,946 former reservists about their experiences during military service and their current health, including depression, posttraumatic stress disorder, somatic symptoms, and medical conditions. Prevalence estimates and confidence intervals of sexual harassment and assault were calculated. A series of logistic regressions identified associations with health symptoms and conditions. Both men and women had a substantial prevalence of military sexual harassment …

The Effects Of Managed Care On Social Work Mental Health Practice, Tendai Masiriri Jan 2008

The Effects Of Managed Care On Social Work Mental Health Practice, Tendai Masiriri

SPNA Review

An individual seeking psycho-therapy services for a mental health disorder has 60-70 percent chance of receiving services from a master’s level clinical social worker. Despite their lower status, clinical social workers make up 60 to 70 percent of the mental health workforce (Ivey et al, 1998; Clinical Social Work Society of Delaware; Testimony of the National Association of Social Workers Washington, DC Submitted to the Senate Committee on Health, Education, Labor and Pensions, September 26, 2001). This analysis examines the effects of managed behavioral health care on social work mental health practice. It begins with a synopsis on the historical …

Strategic Approach To Preventing Occupational Stress, Jean-Pierre Brun, Caroline Biron, Hans Ivers

Review Of The Social And Emotional Wellbeing Of Indigenous Australian Peoples, Darren Garvey Jan 2008

Review Of The Social And Emotional Wellbeing Of Indigenous Australian Peoples, Darren Garvey

Research outputs pre 2011

The first case of diabetes among Indigenous people was recorded in Adelaide in 1923. Records prior to this time showed that Indigenous people were fit, lean, and did not suffer from any form of metabolic condition, which were largely believed to be a characteristic of European populations. The earliest detailed studies investigating the development of diabetes in Indigenous populations were not undertaken, however, until the early 1960s. These and subsequent studies found a significant correlation between the development of a ‘westernised’ lifestyle and the levels of type 2 diabetes in the Indigenous population.

Since that time, type 2 diabetes has …

Six Critical Ingredients In Creating An Effective Workplace, Jenet I. Jacob, James T. Bond, Ellen Galinsky, E. Jeffrey Hill

Faculty Publications

Using a nationally representative sample of data collected from waged and salaried employees in the United States (n = 2810) by the 2002 National Study of the Changing Workforce (NSCW), we evaluate workplace flexibility as another critical ingredient in creating an effective workplace. The study examined the bivariate relationships between six factors of workplace effectiveness and three job outcomes (job engagement, job satisfaction, employee retention) and one employee outcome (mental health). It also examined the relationship between a composite measure of overall workplace effectiveness and the four outcomes. Results indicated that all six aspects of workplace effectiveness and the composite …

Hearts, Minds, Hands: A Dream Team For Mental Health, Julianne Gold Brunson, Judy Molner, Miriam Nathan Lerner

Articles

Interpreting in a mental health setting with hearing staff members and deaf clientele, the ethical situations fly fast and furious, providing the interpreter with a wealth of war stories with which to regale neophyte students of this dynamic profession. Much has been written to improve the many and varied mental health services being extended to deaf populations. The most commonly described dyads are that of hearing therapist and deaf patient. However, consider the case of a deaf psychologist treating hearing clients. In this instance, the interpreter becomes the liaison between the deaf professional and the hearing patient. When an interpreter …

The Effects Of Psychological And Biological Gender On Gender Role Conflict And Mental Health Of Gay And Lesbian Individuals., Kevin James Herdman 1969- Dec 2007

The Effects Of Psychological And Biological Gender On Gender Role Conflict And Mental Health Of Gay And Lesbian Individuals., Kevin James Herdman 1969-

Electronic Theses and Dissertations

This dissertation represented an examination of the interrelationships between psychological gender (i.e., masculinity, femininity, androgyny, and undifferentiated), biological gender (i.e., male and female), gender role conflict, self-esteem, and loneliness in a sample of gay men and lesbian women. Psychological gender and biological gender served as the independent variables in the study while gender role conflict, self-esteem, and loneliness served as the dependent variables. A two-way factorial MANOVA was used as the statistical model of choice in addition to correlational analyses. A confirmatory factor analysis was also completed on the instrument used to measure gender role conflict, the Gender Role Conflict …

The Choice To Limit Choice: Using Psychiatric Advance Directives To Manage The Effects Of Mental Illness And Support Self-Responsibility, Breanne M. Sheetz Dec 2007

The Choice To Limit Choice: Using Psychiatric Advance Directives To Manage The Effects Of Mental Illness And Support Self-Responsibility, Breanne M. Sheetz

University of Michigan Journal of Law Reform

Psychiatric advance directives are a valuable tool for individuals with mental illnesses. Ulysses directives, in particular, allow individuals to bind themselves to treatment in advance of needing it for the purpose of overcoming illness-induced refusals. This Note evaluates the effectiveness of state advance directive statutes in three areas that are especially important for Ulysses directives: defining competency to execute, activate, and revoke directives; waiving the constitutional right to refuse treatment; and encouraging provider compliance. This Note ultimately advocates for other states to adopt provisions similar to a Washington State statute. The Washington statute authorizes Ulysses directives by allowing advance consent …

The Relationship Between Childhood Bereavement And Adult Mental Health, Alicia Kimball Dec 2007

The Relationship Between Childhood Bereavement And Adult Mental Health, Alicia Kimball

Undergraduate Honors Capstone Projects

Bereavement, due to the loss of family and friends, affects approximately 3.7 million children per year in the United States. These losses can have lasting effects such as changed dynamics within a family, decreased academic performance, and poor physical and mental health that not only inhibit a child's ability to function normally but if not dealt with sufficiently can persist into adulthood.

The primary purpose of this study was to determine if individuals who experienced a loss in childhood exhibit more mental health problems in adulthood than those who did not. A survey was administered to 209 college students requesting …

Poverty Duration, Maternal Psychological Resources, And Adolescent Socioemotional Outcomes, Bridget J. Goosby Aug 2007

Poverty Duration, Maternal Psychological Resources, And Adolescent Socioemotional Outcomes, Bridget J. Goosby

Department of Sociology: Faculty Publications

This study seeks to assess the impact of maternal psychological well-being on the depression and anxiety levels and social withdrawal in a sample of young African American and Caucasian adolescents between the ages of 10 and 14 (N = 854) using data from the National Longitudinal Survey of Youth 1979 child sample. Analyses using structural equation modeling found (a) that the duration of time mothers spend in poverty strongly predicts maternal mastery and depressive symptoms and (b) that the effects of poverty duration on adolescent outcomes are mediated primarily by maternal depression and sense of mastery even after controlling for …

Rural Women With Disabilities And Depression, Part One: Characteristics And Treatment Patterns, Rosemary Hughes, University Of Montana Rural Institute

Health and Wellness

Depression is a common mental health problem in which a person may experience persistent sadness, be unable to enjoy formerly pleasurable activities, and feel worthless or hopeless. Undetected and untreated depression causes substantial physical and social limitation and may lead to suicidal thoughts or actions. More than 80% of people with depression improve with appropriate treatment (National Institute of Mental Health [NIMH], 2005).

Disparities In Mental Health Utilization Among Persons With Chronic Diseases, Saundra H. Glover, Keith T. Elder, Sudha Xirasagar, Jong-Deuk Baek, Crystal N. Piper, Dayna Campbell

Faculty Publications

This study used Aday and Andersen's Behavioral Model of Health Services Use to examine to role of chronic disease and the joint impact of race and chronic disease type on mental health utilization. Using data from Community Tracking Survey Household Survey, we tested the assumption that chronic disease, chronic disease type, and race are related to lower rates of mental health visits when adjusted for predisposing, enabling, and need factors. After adjusting for population characteristics, we found that race significantly moderated the impact of chronic disease type on mental health utilization, showing that African Americans with cardiovascular disease were half …

Interpersonal Distance In Social Relationships And Mental Health Outcomes In A Glbt Sample, Kristina Mcdougal

Undergraduate Honors Capstone Projects

Ample research has been conducted on how heterosexuals distance themselves from gays and lesbians through lack of emotional attachment, job discrimination, and lack of familial support, yet there has been little research on how people who are gay, lesbian, bisexual or transgender (GLBT) view this distancing. To examine the distancing from the point of view of people in a GLBT sample we surveyed 200 GLBT people at the Annual Pride Not Prejudice celebration in Salt Lake City. Participants were asked how they viewed their relationship with their parents, and how they perceived their parents religiosity. Participants also completed the Beck …

Teacher Perceptions Of Bullying Prevention: A Comparative Analysis Of Teacher Perceptions Of Bullying Prevention Programs, Diana Howell

Undergraduate Theses and Capstone Projects

School bullying has often been tacitly minimalized as a rite of passage—an unfortunate but common experience among children. In the past few years there has been an increasing awareness of school bullying as a catalyst of school violence. Parents, school boards, and administrators are understanding and taking more seriously the negative impact that bullying has on victimized students and are actively looking for ways to reduce incidents of such violence. This research provides a discussion of bullying behavior and an examination of teachers’ perceptions of the effectiveness of bullying prevention programs in their schools. If teachers do not feel that …

Child Abuse And Neglect And The Mental Health Of Adult Survivors: A Retrospective Study, Shelley A. Holland Jan 2007

Child Abuse And Neglect And The Mental Health Of Adult Survivors: A Retrospective Study, Shelley A. Holland

Digitized Theses

Several researchers have indicated that child abuse and neglect are related to mental health problems in adulthood. Social support has been found to have a protective influence on the sequelae of these traumatic interpersonal experiences. The purpose of this study was to explore the relationship between the severity of childhood interpersonal trauma and the severity of mental illness and substance abuse problems in adulthood. This study is guided by the Neuman Systems Model, specifically the impact of stressors, reaction to stressors, and the moderating role of the sociocultural variable in the flexible line of defense. This research takes advantage of …
