This Article engages with Ronald Dworkin’s final book, Religion Without God, which proposes to shrink the size and importance of the fierce “culture wars” in the United States between believers and nonbelievers – theists and atheists – by separating out the “science” and “value” components of religion to show these groups that they share a “fundamental religious impulse.” Religion Without God also calls for framing religious freedom as part of a general right to ethical independence rather than a “troublesome” special right for religious people. Previous research suggests that obesity can be stigmatizing in interpersonal relationships, including romantic relationships. Timing of obesity and weight stability are also especially important. The negative effects of obesity on interpersonal relationships appear most salient in women and Whites, while men and racial/ethnic minorities appear to experience fewer negative consequences from obesity in their relationships, suggesting that an intersectional lens is necessary in studies on the long-term effects of obesity on interpersonal relationships. In this dissertation, I employ an intersectional lens to understand how histories of obesity, gender, and racial/ethnic identity work together to influence three aspects of romantic relationships …

The Supreme Court’s recent decision in United States v. Windsor, invalidating part of the federal Defense of Marriage Act, presents a significant interpretive challenge. Early commentators have criticized the majority opinion’s lack of analytical rigor, and expressed doubt that Windsor can serve as a meaningful precedent with respect to constitutional questions outside the area of same-sex marriage. This short Article offers a more rehabilitative reading of Windsor, and shows how the decision can be used to analyze a significant constitutional question concerning the use of state criminal procedure to regulate immigration.

The purpose of this study was to explore single women’s views towards the institution of marriage. This study utilized a qualitative design. In-depth face-to-face interviews with ten unmarried women living in San Bernardino County were conducted to collect the data. Participants were asked in a structured interview to provide their views towards premarital sex, cohabitation, non-marital childbearing, divorce, and same sex marriage.This study found that women’s liberal and conservative views towards premarital sex, cohabitation, non-marital childbearing, divorce, and same sex marriage did not affect a women’s desire to enter the institution of marriage. "Love and Marriage: Domestic Relations and Matrimonial Strategies Among the Enslaved in the Atlantic World" argues that the cultural and sociopolitical dimensions of slave marriage were primary issues for diasporic Africans, abolitionists, and proslavery apologists whose lives were intertwined by the cultural and economic connections that framed the Atlantic World throughout the seventeenth, eighteenth, and nineteenth centuries. Through analyzing the interplay between legislation, cultural practice, and political discourse in the early periods of colonial slavery, I first show how matrimonial patterns from Atlantic Africa and Britain were re-imagined by diasporic Africans enslaved in Bermuda, the British West Indies, and colonial …

This comment examines whether gay men can have a child through a surrogacy arrangement in Virginia and whether gay men can retain parental rights through surrogacy contracts under the Virginia Assisted Conception Act. The Virginia laws affect gay males and gay females equally, but this comment addresses the issues arising with same-sex couples in the context of gay dads. Part II provides a background of surrogacy and specifically discusses surrogacy in relation to same-sex couples. The current study presents findings regarding marital preparation for individuals in great marriages. Data from a national qualitative study of individuals in self-identified great marriages were used. Thirty-eight individuals were identified as being married for 20 years or less, and therefore, chosen as the subsample for the current study. Their rich, narrative responses were analyzed and coded, using a qualitative method, to identify what marriage preparation occurred for these couples prior to marriage and contributed to their successful marriages. This study was conducted to explore associations among marital maintenance strategies, religious experiences, and marital quality in a sample of 80 married college students. Maintenance strategies are tactics used by couple members to sustain healthy relationships/marriages, and include both cognitive (e.g., choosing to focus on the positive aspects of the partner) and behavioral (e.g., engaging in shared activites) strategies. Specific patterns of association among religious practices and beliefs, particular maintenance strategies, and marital-quality outcomes were assessed in order to better understand pathways to optimal marital functioning for religiously affiliated individuals.

The citizenship status of children born to American parents outside the United States is governed by a complex set of statutes. When the parents of such children are not married, these statutes encumber the transmission of citizenship between father and child while readily recognizing the child of an American mother as a citizen. Much of the debate concerning the propriety and constitutionality of those laws has centered on the extent to which they reflect gender-traditional understandings of fathers’ and mothers’ respective parental roles, or instead reflect “real differences” between men and women. Current demographic trends in the United States suggest that emerging adults delay marriage (Vespa, 2014), nonmarital cohabitation is the norm among this age group (National Marriage Project, 2012), and premarital sex—including noncommitted hooking up (Garcia, Reiber, Massey, & Merriwether, 2012)—is widely accepted (Pew Research Center, 2014). These trends collide with consistently high divorce rates (Amato, 2010; Cherlin, 2010), where up to one-third of emerging adults grow up in stepfamilies (Copen, Daniels, Vespa, & Mosher, 2012). Pride and Prejudice, by Jane Austen, features five main marriages that demonstrate the eighteenth century companionate marriage model in varying degrees. Many of the societal changes in the eighteenth and nineteenth century contributed to the rise of the companionate marriage, and these many changes are reflected in the rising genre—the novel. Specifically, Jane Austen’s Pride and Prejudice incorporates the major themes of the novel as a genre, specifically, the rise of the individual and equality of souls, to show that the companionate model of marriage makes marriage a formational platform for two individuals. Most theories of parentage fail to explain the genesis of the right to parent—for example, why does a biological relationship generate parental rights? This Article shows that the law of parental rights mirrors theories of acquiring property, and that the law has shifted over time, from favoring a property right based in genetics to a Lockean theory of property rights earned through labor. The growth of Lockean labor-based theories is epitomized in reforms to parentage laws that incorporate functional theories of parenting, meaning that adults who perform caretaking work that creates a significant relationship with children are recognized as legal …

Research indicated that is need to assess the relationships of female service members who were found to have higher prevalence of divorce than their military and civilian counterparts. The aim of this study was to understand better civilian husbands' experiences of challenges and benefits from their active duty spouses' service and experiences of deployment, relocation, and training sessions. Further, the study assessed the influence of wives' service on couples' communication, conflict, and husbands' perceptions of marital satisfaction. This mixed-method study entailed conducting telephone interviews with 20 civilian husbands across the United States. Interviews were recorded, and transcribed verbatim.

As the legalization of same-sex marriage spreads across the states, some religious believers refuse to serve same-sex married couples. In the academy, a group of law and religion scholars frames these refusals as “conscientious objection” to the act of marriage. They propose “marriage conscience protection” that would allow public employees and private individuals or businesses to refuse to “facilitate” same-sex marriages. They rely on the theoretical premise that commercial actors’ objections to marriage are equivalent to doctors’ objections to controversial medical procedures. Although the titular act of confession is unsurprisingly significant, the diegesis actually foregrounds Matrimony and Holy Orders – two sacraments that remain under the spotlight during a tumultuous era for the Catholic Church.
