This essay explores why and how today’s marriage equality movement for same-sex couples might benefit from lessons learned by African Americans when they too were allowed to marry for the first time in the immediate post-Civil War era. Why has the right to marry, rather than say, employment rights, educational opportunity or political participation, emerged as the preeminent vehicle by and through which the freedom, equality and dignity of gay men and lesbians is being fought in the present moment. Problem

A number of marital issues are challenging the members of the Ottawa Seventh- day Adventist Church. Of primary concern is the increase in “marital distress.” Given the importance of marital satisfaction on the health of a marriage, an examination of marital satisfaction levels among couples in the Ottawa Seventh-day Adventist Church is a priority. Based on this background, the primary focus of this study was to investigate marital satisfaction and its effect on marital health, with the intention of improving marital satisfaction levels among couples in the Ottawa Seventh-day Adventist Church.

This short essay, written for a volume that celebrates and reflects on Lawrence M. Friedman’s work in legal history and legal culture, explores the modern controversy about same-sex marriage through a historical lens. The legalization of same-sex marriage by five states, and the express condemnation of it by more than forty others, has reintroduced the age-old problem of non-uniform marriage laws and the complicated interactions that follow. This essay reviews the issues the Supreme Court of Virginia resolved in Truro and notes important issues it did not resolve. Part II supplies the factual background and procedural history ofthe dispute. Part III summarizes the court's opinion and the reasoning underlying its determination that Virginia Code section57-9(A) is not applicable to this particular action. Part IV critiques the opinion, noting the issues the court resolved and how it resolved them. Part V briefly addresses issues that remain unresolved by the court's decision and discusses the implications of leaving those issues unresolved. Part VI presents the authors' conclusions.

This article will investigate current state laws regarding the change of a husband’s name to his wife’s upon marriage. Given that tradition, and often law itself, discourage that practice, the lingering gendered norms that perpetuate the historical tradition will be explored. Components of this article will include a brief historical analysis of the origin of surnames and the law as it has developed on that issue, including an examination of the place of tradition in the law both empirically and normatively. Sex Ratios, Divorce Laws And The Marriage Market, Brishti Guha

Research Collection School Of Economics

We show how an interaction between the skewness of the sex ratio and the jump in divorce rates after a liberalization in divorce laws can obtain in a model of marriage market matching with non-transferable utility. This model is partly motivated by a significant cross-country correlation between these two variables. We also find that men’s hopes or fears about women’s marriage market odds are self-confirming under mutual consent, resulting in multiple equilibria. The multiplicity vanishes with a more skewed sex ratio or a liberalization of divorce laws. Our work sheds some light on the possible implications of divorce liberalization and …

In their thought-provoking book, Red Families v. Blue Families: Legal Polarization and the Creation of Culture, Naomi Cahn and June Carbone examine conflicting views on family formation in the "culture war." Mirroring the electoral maps of 2004 and 2008, the authors contend that regional differences between Republican and Democrat voters correspond to deeply held beliefs about family values. The "blue" family paradigm is essentially liberal: It stresses individual equality, tolerance of diverse lifestyles, and a role for government in helping people achieve educational and economic success. "Red" families are conservative. They value tradition, as expressed in religious beliefs or longstanding …

Conflicts and choice of law questions arising from marriage recognition are more multidimensional today than ever before. Traditionally, these conflicts arose because one jurisdiction allowed marriage between two individuals while another prohibited such a marriage. This was the model in the consanguineous, polygamous, and interracial marriage contexts. It has also been the primary model for analyzing conflicts that arise in the context of same-sex relationships.

In a forthcoming article, Resolving Interstate Conflicts Arising from Interstate Non-Marriage, I challenge this model, and suggest that the emergence of marriage-like 2 and marriage-lite3 alternatives (i.e., civil unions, domestic partnerships, reciprocal benefits arrangements, etc.) …

The UN Convention on the Rights of the Child (CRC) recently began its third decade. Why has the United States still not ratified the CRC, celebrated as the most widely ratified international human rights treaty in history? Once again, this question is on the table: Congressional resolutions that President Obama should not transmit the CRC to the Senate for advice and consent rapidly followed intimations that the Obama Administration had some qualms about the U.S. keeping company only with Somalia in not ratifying it. This exploratory study reveals the narratives of long-term, committed same-sex couples living in the Bay area of California, who decided not to marry in 2008 when it was temporarily legal. Thirteen participants were interviewed and their responses were transcribed and analyzed. They were asked to explain personal, social, and political influences on their perspectives on marriage. They were also asked to define commitment and the commitment markers used in their relationships. Lastly, they were questioned about their relationship with the current marriage equality movement. Animal studies have implicated oxytocin and vasopressin in social bonding, physiological stress responses, and wound healing. In humans, endogenous oxytocin and vasopressin levels covary with perceptions of relationship quality, marital behaviors, and physiological stress responses. To investigate relationships among marital behavior, oxytocin, vasopressin, and wound healing, and to determine the characteristics of individuals with the highest neuropeptide levels, 37 couples were admitted for a 24-hour visit in a hospital research unit. After small blister wounds were created on their forearm, couples participated in a structured social support interaction task. Blister sites were monitored daily following discharge to assess wound repair …

Polyandry has occurred all over the world, among human societies at all levels of social stratification, employing all types of economic strategies. While the classical cases that appear in Southeast Asia among stratified, agricultural societies have been thoroughly studied, very little has been written on the non-classical cases. This thesis surveys fifty-two non-classical cases of polyandry and investigates the conditions under which non-classical polyandry most often occurs. Age Differences In Marriage: Exploring Predictors Of Marital Quality In Husband-Older, Wife-Older, And Same-Age Marriages, Brandan E. Wheeler

Using data from a nationally representative sample of 723 married adults, this study explored the association of age differences between spouses at the time of marriage on various aspects of marital quality years into the marriage. Four groups (full sample, husband-older, wife-older, and same-age marriages) were compared to see how marital quality was affected by age difference and several other moderating variables. Spousal interactions increased among wife-older marriages, but not among the other groups. An increased level of husband participation in household labor was linked with an increase in marital happiness and a decrease in marital problems for wife-older marriages. …

Beyond Employment And Income: The Association Between Young Adults’ Finances And Marital Timing, Jeffrey P. Dew, Joseph Price

This study tested an extension of the theory of marital timing (Oppenheimer, Am J Sociol 94:563–591, 1988) by assessing whether visible and less visible financial assets and debt mediated the relationship between employment and the likelihood of marriage. We conducted these prospective, longitudinal analyses using a sample of 1,522 never-married young adults from the National Survey of Families and Households. For participants who were not cohabiting at Wave 1, financial issues such as car values predicted marriage but did not mediate the relationship between work hours, occupational prestige, and the likelihood of marriage. This book is a collection of twelve sociological studies that examine how active, faithful Latter-day Saint singles go about deciding to marry and selecting a mate. Since most of the research was conducted via surveys of BYU students and asks the question "What makes the Mormon marriage process different from the typical American process?" it accounts for a very narrow part of the worldwide LDS community. Focusing on this small segment is a good start but shows that research in LDS sociology is still often limited in its scope.

From a family systems theoretical view, this paper uses both variable-oriented and person-oriented research approaches to examine parental marriage as a dynamic, interdependent system, and extends the literature by examining parental marriage across a 15 year time span. The United States' promise to establish equality for all has been challenged by post-operative transsexuals seeking recognition in their acquired sex. The birth certificate is the legal gateway to changing other legal documents; but the process for changing the birth certificate varies widely from state to state. This lack of national uniformity makes post-operative transsexuals' recognition of their acquired sex complicated at best and impossible at worst.
