Rites Of Passage, Rites Of Spring: The Honors Convocation And Senior Day Speeches. A Senior Day Address, Patricia M. Wald
Law Quadrangle (formerly Law Quad Notes)
Like the new leaves on the Quadrangles trees, Honors Convocation and Senior Day demarcate the end of the Law School academic year. In speeches made on these occasions last May, Law Professor Thomas Kauper and Federal Judge Patricia M. Wald urged graduates to take the risks that excellence mandates and to live full lives both inside and outside the law. Their addresses follow in abridged form.
The Moral Responsibility Of Law Schools, Terrance Sandalow
The Moral Responsibility Of Law Schools, Terrance Sandalow
Law Quadrangle (formerly Law Quad Notes)
Editors note: This article is an abridged version of the address Dean Sandalow delivered at the plenary session of the 1984 annual meeting of the Association of American Law Schools. The full text appears in the June issue of the Journal of Legal Education.
The subject I have been asked to address, the moral responsibility of law schools, is perplexing, less because answers to the implicit question are uncertain than because the meaning of the question itself is unclear. Our ideas about moral responsibility have been formed in reference to individuals. They presuppose the existence of distinctively human characteristics such …
Training Lawyers To Be More Effective Dispute Preventers And Dispute Settlers: Advocating For Non-Adversarial Skills, Paul L. Tractenberg
Training Lawyers To Be More Effective Dispute Preventers And Dispute Settlers: Advocating For Non-Adversarial Skills, Paul L. Tractenberg
Journal of Dispute Resolution
After briefly recounting some milestones in the history of legal education, and especially efforts to train lawyers in non-Langdellian techniques, I will explore re-orientation of lawyer training, first globally and then more specifically. Most of the ideas in this article are not new. Many of them date back 50 years and more. Articles by Llewellyn and Frank in the 1920's and 1930's could be reprinted with modest changes and seem totally relevant. 3 This in itself bears serious pondering. We do have the advantage of some relatively recent studies which, in the main, tend to support Llewellyn's and Frank's intuitions. …

Social Problems And Legal Answers, William T. Coleman Jr.
Social Problems And Legal Answers, William T. Coleman Jr.
Law Quadrangle (formerly Law Quad Notes)
Mr. Coleman delivered these remarks on the integration of public service and private practice of law at Law School Senior Day last spring. Mr. Coleman' own career is an eloquent testimonial to his argument that skilled and principled lawyers are uniquely qualified to serve their nation and society...
In his lecture , Mr. Coleman draws on his various experiences to construct an argument for lawyers' vital contribution to many aspects of traditional American life. He urges this year's graduates to consider the particular challenges they will face in fulfilling the lawyer' profesional responsibilities today.

The Social Costs Of Incompetence: An Educator's View, A. Wayne Mackay

After I had cut off my hands and grown new ones, something my former hands had longed for came and asked to be rocked. After my plucked out eyes had withered and new ones grown, something my former eyes had wept for came asking to be pitied. 2 The above quotation has been applied to lawyers and in particular the process of legal education. It is a distressing thought for anyone who cares about the law and considers it a worthy profession. Must people sever hands that can rock and pluck out eyes that can pity in order to become …
Legal And Medical Education Compared: Is It Time For A Flexner Report On Legal Education, Robert M. Hardaway
Legal And Medical Education Compared: Is It Time For A Flexner Report On Legal Education, Robert M. Hardaway
Sturm College of Law: Faculty Scholarship
The purpose of this Article is to explore the common elements of legal and medical education and to compare the reform movements in each profession, with a view toward finding an explanation for the widely differing conditions that exist today in the education of each profession. For example, why is it that medical education can provide facilities and training costing up to ten times that provided law students? Why do medical schools receive outside financial support paying up to 95% of the costs of medical education while law schools are supported primarily by tuition and fees? Why do medical students …

It is, of course, a great and undeserved honor for me to be offering this year's Horace E. Read Memorial Lecture. The slightest acquaintance with Dean Read's career reveals the range and quality of his contributions to the law, to the institutions of society and to legal education. It is a great pleasure to be playing a role in these annual memorial celebrations. His life is a model of service and scholarship to all who wish to live the life of the law at its higher levels and refutes those who see our profession as narrow or intellectually confined. Nevertheless, …

Law Faculty Articles and Essays
This article assists the process of understanding the clinical methodology by analyzing the following premises. 1. The method of instruction termed "clinical" differs from the Langdellian appellate casebook method in only one respect--the clinical method collects directly experienced legal processes involving a third party (the client) as its core of material studied by the law student while the casebook method utilizes collections of vicariously or indirectly experienced two-dimensional material as its core of learning material. 2. Issues of what specific educational goals are selected by the law teacher, and the techniques of instruction (Socratic, lecture, discussion, videotapes, etc.) are not …
The History Of Legal Education In Virginia, William Hamilton Bryson
The History Of Legal Education In Virginia, William Hamilton Bryson
Law Faculty Publications
Many methods of legal education have been used over the years. Each has its strengths and its weaknesses. The study of the past is instructive and useful in showing both the good and bad goals and methods. We must cultivate the good and uproot the bad. This study suggests that there has always been progress, slow but constant improvement. The teaching of law is vital to the administration of justice, a noble cause. The continuing challenge is ever to strive for the improvement thereof.
Justice Higher Education At The University Of Alaska: A Curriculum Study, John E. Angell
Justice Higher Education At The University Of Alaska: A Curriculum Study, John E. Angell
Reports
The University of Alaska has been offering courses in police and correctional subjects since the mid-1960s. The University's entrance into this justice field was to take advantaqe of program opportunities rather than to develop comprehensive academic programs, and consequently the curriculum has developed incrementally — a course at a time. The Criminal Justice Center [later the Justice Center] was established in 1975 to oversee and coordinate the University's efforts in the field of justice. One of the top priorities identified by the Center was the reorganization of undergraduate curriculum offered by the University in justice fields. This document contains the …

Reply Paper To ‘Multicultural Law-Related Education In The Humanities’ By Dr. Carlos E. Cortes, Conn N/A
Conference papers
Multi-ethnic (or bicultural) legal education is a superior way to teach law as a social process within an everchanging American legal culture. By stepping out of one's own legal tradition or culture and into another's, it is possible to see how law really operates without blinders of ethnocentricity. Ethnic minority students can use their own legal tradition as a basis for contrast and comparison with American legal culture. Elementary school is the best place to explore the values which underlie legal traditions. Teachers must discover differences and refrain from indoctrination. Curriculum that is bicultural should focus upon common problems, borne …

Reassessing Law Schooling: The Sterling Forest Group, Thomas L. Shaffer
Reassessing Law Schooling: The Sterling Forest Group, Thomas L. Shaffer
Journal Articles
This Article is the result of a weekend in December 1976 at the Sterling Forest Conference Center. Several legal educators came together there to explore the possible relevance of humanistic educational psychology to legal education, and the pieces that follow flow from the experiences in learning we shared there. The concerns that brought the ten of us together were not new; rather, they emanated from a longstanding challenge within the profession.
Although we taught at different institutions and in different fields, our experiences had led us to a common dissatisfaction with legal education and a hope that more was possible. …

Legal education in the United States is passing through its winter of discontent. Those who are new to the law schools-students and young instructors-are likely to be unaware of how recently and precipitously the present mood developed. Even those who have known the law schools longer may by now have forgotten the confidence and euphoria that were characteristic attributes of the schools until no more than a decade ago. Legal education, of course, has never lacked criticism, and …
Clinical Education At The Crossroads: The Need For Direction, David R. Barnhizer
Clinical Education At The Crossroads: The Need For Direction, David R. Barnhizer
Law Faculty Articles and Essays
This Commentary rests on five premises. The first is that it is both possible and necessary to understand clinical legal education as a general instructional method. The second is that all legal educators must be more willing to reexamine and clarify the purposes of legal education and to engage in discussion about the primary educational goals to be served. The third premise is that different educational methods possess distinct capabilities for the attainment of specific educational goals and that certain applications of the clinical method are manifestly superior vehicles to facilitate learning in the area of "professional responsibility." The fourth …
