Clinical Legal Education: Is Taking Rites Seriously A Fantasy, Folly, Or Failure?, Steven D. Pepe

University of Michigan Journal of Law Reform

This article assesses the primary product of law schools-the practicing lawyer-and reviews the criticisms of the adequacy of the initial training for attorneys that law schools provide. After a brief. review of goals of legal education and goals of clinical teaching methods, the article argues that properly structured clinical programs are not based on flawed premises and that the nation's law schools, particularly the leading schools, should not abandon their clinical experiments without further efforts to help clinical legal education achieve its unfulfilled promises. Professor Francis Allen states succinctly the problem which faces academic lawyers in these times of rapid and dramatic change: ... law schools in Canada and the United States are undergoing an identity crisis as they attempt to provide broad interdisciplinary and humanistic education and, at the same time, meet the demands for training in legal skills.' The problem is not new. The statement simply reflects the harsh reality of Canadian legal education: the natural tensions which result from the interdependence of university programs in law and the later processes of admission and continuing education under the jurisdiction of governing bodies. …

The subject I have been asked to address, the moral responsibility of-law schools, is perplexing, less because answers to the implicit question are uncertain than because the meaning of the question is unclear. Our ideas about moral responsibility have been formed in reference to individuals. They presuppose the existence of distinctively human characteristics such as understanding and will. What, then, can be meant by the moral responsibility of "law schools," institutions that, just because they are not human, necessarily lack these capacities?
