The landscape of lawyering seems bewilderingly chaotic today, compared with images of practices past, replete with country clubs and white male practitioners.' Despite their exclusiveness, corporate law firms of old at least had some shared values, and some commitment to norms other than those generated by the market. Our society, as well as the legal profession, is more diverse than it was. The present-day invocation of professionalism is one reaction to the increased diversity of the legal profession, and to the vaulting prominence of market forces, which has reduced many lawyers in major firms to a race to the bottom …

Readers of legal ethics literature frequently encounter the following question: "Can a good lawyer be a good person?" This Article addresses a variation of that question: "Can a good lawyer be a good person if that person is not a good philosopher?" This new question confronts a perplexing realization about most moral exploration of lawyering-that it takes place amidst a language and an intellectual world with which most practicing lawyers are not familiar or conversant. This article provides an overview of these basic Indian Child Welfare Act (ICWA) requirements and judicial interpretations of these requirements. It also includes references to the Federal Guidelines for State Courts. These Guidelines do not have the binding legislative effect of federal regulations, but are helpful in interpreting the ICWA.

This article focuses on the economic aspects of crime in the United States, specifically analyzing crimes which are committed by persons upon other persons and against property. The author notes that NAFTA may result in an increased influx of crime due to increased activity between the United States, Canada and Mexico. The article proceeds to analyze the economic aspects of criminal behavior by examining the probability of success via "Risk-Factors." While we are forced, somewhat begrudgingly, to face the fact that there are limitations to what medicine can achieve, we still seem to have an undisturbed faith in what law can achieve. The limitations to what litigation under the Canadian Charter of Rights and Freedoms' can achieve was highlighted most recently in the case of Rodriguez v. British Columbia (A.G.)2 where the Supreme Court of Canada, by a five to four margin, upheld the constitutionality of the assisted suicide provisions of the Criminal Code.3 The Court recognized that Ms. Rodriguez's rights were violated but concluded that the infringement did not …

Regulating The Airwaves: The Governmental Alternative To Avoid The Cellular Uncertainty On Privacy And The Attorney-Client Privilege, Jose L. Nunez

This Comment will analyze the federal government's latest attempts to assure privacy and order in wireless communication in an effort to avoid the uncertainty prevalent during the early days of cellular telephony. First, Part II will examine the history behind present legislation designed to afford privacy to wireless communications. Part I will describe the judicial interpretation of this legislation. Part IV will then discuss the attorney-client privilege in the context of wireless communications. Finally, Part V will analyze the available options to assure privacy with an emphasis on a standard encryption code promoted by the government.

The Role Of The Illinois Attorney General In Environmental Enforcement, Roland W. Burris, Diane L. Rosenfeld

In this article, the authors explain the critical role of the Attorney General in the enforcement of Illinois' environmental laws. Improvements made in the attorney-client relationship between the Attorney General's Office and the Illinois Environmental Protection Agency have led to streamlined enforcement of cases and a stronger prioritization of environmental matters. Attorney General Burris' hands-on management style in prosecuting environmental violations and formulating initiatives to strengthen enforcement is explained. The first part of the article describes the responsibilities and function of the Attorney General as chief legal officer for the State in his representation of State agencies and as lawyer …

Part II of this Article provides the reader with background on the current state of federal affordable housing and community development law. It describes what President Clinton is inheriting from prior administrations as well as the new administration's affordable housing and community development agenda. In short, Part II describes the enormity of the challenge facing the legal community.
