This note explores the impact COVID–19 has had on contracting parties who have attempted to implicate force majeure provisions. An inquiry of recent cases reveals varying degrees of success and tension when parties turn towards force majeure text. This Note analyzes common law alternatives, discusses the implication of force majeure clauses as applied under Mexican and American law, highlights the implications that have played out in recent court decisions, and discusses post–pandemic implications that could affect how parties conduct cross–border transactions in the future.

The Preventing Future Pandemics Act was introduced to mitigate zoonotic disease threats around the world by focusing policy efforts on the closure of wildlife markets that gave rise to COVID–19. This Note challenges the efficacy of wildlife market closure policy by considering cultural, socioeconomic, and legal factors for the existence of wildlife market within megadiverse countries in Latin America. Based on scientific research on the animal-to-human interface and zoonotic disease transmission, this Note suggests effective policy should incorporate a targeted species ban for reservoir species, improved sanitary measures and disease surveillance, and wildlife trafficking prevention. U.S. Travelers’ Perceived Image Of Latin America As Their Future Travel Destination, Maricela I. Montes-Guerra, Natalia Zapata-Cuervo, Miyoung Jeong

This study identified U.S. travelers’ perceptions toward Latin America as their future place to visit, based on their perceived destination attributes, activities, and overall affective image. Selecting nine attractive destinations, this study aimed, first, to develop U.S. travelers’ perceptual mapping of countries by using destination image attributes and activities, second, to determine comparative strengths and weaknesses, and third, to propose destination marketing strategies that will derive U.S. travelers' attention to the country. Overall, Americans have favorable affective image toward the nine tourism destinations in Latin America. Costa Rica was respondents’ most preferred country to visit, followed by Peru and Brazil.

Loopholes within Latin American democratic systems of governance are a cause for concern, but also intrigue. In this research the specific loopholes and strengths of democracies in Latin America will be spotted and explained. My dissertation, Truth in Horror: Cinematic Representation of Social Violence in Spain, Latin American, and the Latinx United States, investigates the recent explosion of political horror films that straddle the past and present, reflecting both the current political moment and the polemic historical memories of state repression against racialized others and ideological dissidents. The international security environment has changed. In the last two decades, new challengers to the American liberal order arose, with China being the most defiant one, in political and military terms. The socio-political history of cannabis in Costa Rica is one of external global influence; from colonization to independence; from neocolonialism to neoliberalism. Cannabis in Costa Rica has gone from failed agricultural crop to non-indigenous intoxicant import to controversial cultural mainstay. As Mexico influenced cannabis prohibition in the United States, so too has the U.S. approach to cannabis prohibition influenced Costa Rica. This dissertation examines the relationship between purity and order, and the ways this relationship informs and reproduces exclusionary forms of governance. The starting point for this analysis is the puzzling use of the language of limpieza social [social cleansing] as a justification for violence in Latin America. This study analyzes the interaction between foreign intellectuals and ICAIC (Instituto cubano de artes e industrias cinematográficas) in shaping the image of Cuba in the 1960s. I make the case that the idea of Revolution was a product of cosmopolitan intellectual engagement and that in this process documentary film was a privileged medium. By tracing the development of normative stories of commitment, cosmopolitanism, and aesthetic experimentation embodied both in written texts and travel essay films, I argue that such circulation destabilizes fixed ideas of Cuban, Revolutionary or Intellectual. The democratic peace theory holds that democracies rarely, if ever, go to war with one another based on the institutional and normative features of democratic governments. Alternatively, the capitalist peace theory insists that, rather than the democratic nature of a government, states opt out of warfare when their economic interests are at play – whether that be trade interdependence or general market features. Background: Obstructive sleep apnea (OSA) is a condition characterized by repeated episodes of partial or complete obstruction of the upper airway during sleep. An accessible method to facilitate self-management education is through information and communication technologies (ICTs).
Purpose: To assess the frequency of and preferences for ICT use in patients with sleep apnea.
Methods: A multicenter, multinational, observational cross-sectional survey study was conducted between 2018 and 2019 in sleep units in different countries of Latin America, including patients of both genders older than 18 years with a diagnosis of sleep apnea. Previous research indicates that a combination of Acceptance and Commitment Therapy (ACT) and Exposure and Response Prevention (ERP) is an effective treatment for obsessive-compulsive disorder (OCD). However, there are no studies to date of ACT for OCD in Latin American populations. Because socio-cultural context influences OCD symptomatology, it is worth adapting and testing ACT for OCD in such cultures. Three patients seeking treatment for OCD at a public health center in Rio De Janeiro, Brazil were treated with 16 sessions of ACT and ERP. All participants showed decreased OCD scores from baseline to post-treatment that remained lower at follow-up, suggesting …

Beginning from the framework of welfare state regimes in rich capitalist countries, this article radically redefines it and applies the new model to regions and countries which experience problematic states as well as imperfect markets. A broader, comparative typology of regimes (welfare state, informal security, insecurity) is proposed, which captures the essential relationships between social and cultural conditions, institutional performance, welfare outcomes, and path dependence. Using this model, different regions of the world (East Asia, South Asia, Latin America, and sub-Saharan Africa) are compared. This thesis intends to explore the conditions of gender-based violence in Latin America and how it interacts with government type, crime rates, and religion. Currently, feminicide is perceived at higher rates in countries such as Mexico and Guatemala. A significantly higher indigenous community, Catholicism, and increased crime organizations are also present in these countries.
