This Note examines Islamic legal doctrine in the field of humanitarian law and considers the historical contributions made by Islamic law to contemporary international humanitarian law. The goal of this Note is neither to unfairly attack nor to apologize for Islamic law, but rather to attempt an honest appraisal of Islamic humanitarian precepts, with an awareness of the way in which Islam has often been stereotyped as hostile and bloodthirsty in Western discourse. Between 1853 and 1914 the kingdom of Prussia and the Church of Jesus Christ of Latter-day Saints, the Mormons, disagreed over the issue of Mormon missionaries proselyting in Prussia. In 1853 royal magistrates banished all Mormon missionaries from the kingdom for advocating emigration. A new church policy of preaching without seeking for official permission, in addition to an improved relationship between the Mormons in Utah and the United States government after the Manifesto of 1890, led to an increase in missionaries sent to Germany, including Prussia. The first part of this article gives the political, social, economic, and religious context of the world in which Elizabeth Seton lived. The second part describes the establishment and work of the Sisters of Charity. Education for all was important to early Americans, largely because everyone was supposed to read the Bible. Women had more agency than their European counterparts, although their influence was still mostly confined to the home. They were charged with instilling morality in children, and through them, in society in general. This was reflected in the curriculum of Elizabeth Seton’s school, Saint Joseph’s Academy. This thesis looks at the legal status and the daily lives of the women living on the Virginia frontier in the counties of Augusta, Botetourt, Montgomery and Washington during the period of the American Revolution. All ages and all levels of society are given consideration in developing the theme that the service performed by the women who survived the rigors of frontier life during this crucial period in American history was as valuable in its own way as was the service performed by their male contemporaries. "What About The Poor?" Nineteenth-Century Paris And The Revival Of Vincentian Charity, Edward R. Udovic C.M., Ph.D.

During the Industrial Revolution, poor persons constituted up to half the population of Paris. They were considered to be criminal, and their poverty was seen as a punishment for this. The Church believed the traditional social order was divinely ordained. The rich were to be charitable and the poor were to be resigned to their status; these conditions were necessary for the salvation of both groups. In the Church’s eyes, the rich and the poor each contributed to the gap between them, and they could only be reconciled by returning to Christian values and the traditional social hierarchy. It was …

Presidential Systems In Stress: Emergency Powers In Argentina And The United States, William C. Banks, Alejandro D. Carrió
Michigan Journal of International Law
This article offers three comparative insights. First, it concludes that comparative inquiries into presidential systems may be useful for those interested in constitutional government, regardless of historical, cultural, or other contextual differences among nations. Thus, nations with presidentialist constitutional systems may have common problems because of the institutional presidency. The article maintains that our presidential systems are in such states of disrepair that a fundamental reinvigoration of the legislative and judicial branches is required, so that government may better serve important constitutional values in our nations.

This volume, produced by three members of the Central Washington University Department of History, on the occasion of the school's centennial, cannot document all the stories of the many thousands of students who have earned degrees here. The lists of courses they took, clubs they joined, professors who introduced them to new subjects for consideration, administrators who shaped the programs and policies, staff people whose services supported their progress, buildings that housed their residential and scholarly activities, would be interminable. History, Organization And Belief Among Cuban "Plantado" Political Prisoners, 1959-1993, William Raymond Yaworsky
UNLV Retrospective Theses & Dissertations
Anti-Castro activists began organizing guerrilla groups in the early 1960's to oppose the revolutionary government of Cuba. The perception that the new regime posed a threat to religion and pre-existing cultural values were among the motives for this activity. This thesis presents three case studies of individuals who due to their beliefs, became guerrillas, were imprisoned for that activity, and who subsequently refused to participate in the prison reeducation program. The findings of this study indicate that ideology and beliefs function to provide meaningful explanations to social life, and are not necessarily thin veils for self interest masquerading as principle. …

Edward Powell's splendid study of Henry V's strategy for keeping peace among magnate and gentry factions represents an important contribution to the history of criminal justice. After providing a panoramic view of the machinery of criminal justice, Powell analyzes the extent to which that machinery was effective as between the Crown, at the center, and the upper echelons of society in the provinces. His conclusion, not surprisingly, is that the regular processes of common-law criminal administration could not easily be deployed at those levels. But Powell does not let the matter drop there. The army of the Habsburg Monarchy was the central institution of the Habsburg state, and it embodied the ideal of non-national, dynastic rule. The army leadership was aware of the dangers of nationalism, but in the period between the end of the Napoleonic Wars and the revolutions of 1848, no attempt was made to overcome the danger of national disaffection. The revolutions of 1848 caused the army to remove Hungarian and Italian units from their homelands, but, despite the suspicion in which they were held, these troops fought well in the wars of 1859 and 1866. A 1656 royal decree outlawed begging and private almsgiving in Paris and forcibly confined persons who were poor in various institutions of the General Hospital. These measures were later mandated throughout France until 1715. The poor were treated as enemies of the state because of their numbers and the violence, crime, and social unrest that accompanied poverty. This was a radical shift in society’s perspective. During the Age of Faith, poverty was a sign of election since Christ chose to be poor. The poor had a right to seek charity and the rich were obligated to give it. In the …

Feminizing Unions: Challenging The Gendered Structure Of Wage Labor, Marion Crain

In this article, I argue that labor unions can be an effective, central tool in a feminist agenda targeting the gendered structure of wage labor. Collective action is the most powerful and expedient route to female empowerment; further, it is the only feasible means of transforming our deeply gendered market and family structure. Others have laid the groundwork by showing how existing individual-model challenges have been unable to accomplish such broad-based reform. I begin where they leave off.
