From Vision To Legacy: Walter Gellhorn And The Establishment Of The Toshiba Library For Japanese Legal Research, Yukino Nakashima

This paper chronicles events surrounding the creation of the largest academic Japanese law library in the United States, while focusing on two extraordinary law faculty members at Columbia Law School and their successful fundraising efforts from the initial concept of building a Japanese law library through the establishment of permanent funding. It recounts others who tirelessly supported carrying through this arduous plan. It is about insightful visions, perseverance, and lasting personal relationships, as well as building a foreign law collection in the United States. It examines lessons to be learned.

In this thesis, I describe and analyze the manifestations of modern thought in the life and works of Ḥasan al-ʿAṭṭār (d. 1835), an Egyptian Islamic scholar who served as Shaykh al-Azhar in the 1830s, in concert with Muḥammad ʿAlī Pasha. These manifestations were significantly influenced by the writings and ideas of Ottoman ʿulamāʿ and political elites which al-ʿAṭṭār would have encountered during his 10-year journey across the Empire. The thesis will also explore the content of al-ʿAṭṭār’s political, legal and social thought, which was guided by a unique form of ‘Islamic utilitarianism’ which reaches across his writings and the reforms …

Here, we review the research undertaken since the 1950s in Australia’s grain cropping regions on seed-borne virus diseases of cool-season pulses caused by alfalfa mosaic virus (AMV) and cucumber mosaic virus (CMV). We present brief background information about the continent’s pulse industry, virus epidemiology, management principles and future threats to virus disease management. We then take a historical approach towards all past investigations with these two seed-borne pulse viruses in the principal cool-season pulse crops grown: chickpea, faba bean, field pea, lentil, narrow-leafed lupin and white lupin. Many legal scholars have observed that the current Supreme Court is returning to the doctrines, values, and methods of reasoning that were employed between 1873 and 1937-the Lochner era and the era immediately preceding it.¹ As it did during the Lochner era, the current Supreme Court elevates property rights over personal rights;² strikes down major civil rights legislation;³ arrogates power to itself by ignoring legislative intent and administrative expertise;⁴ and relies on tradition instead evidence-based reasoning to interpret the law.⁵

This article considers different applications of the Purchaser-Seller Rule that a plaintiff must satisfy to bring a Section 10(b) and Rule 10b-5 private action. The history and development of the Purchaser-Seller Rule under Supreme Court and lower federal court jurisprudence is considered, with emphasis on recent case law unduly constricting this Rule. In particular, the Second Circuit’s restrictions on Section 10(b) standing are addressed, focusing on that appellate court’s decision in Frutarom which adhered to an overly formulaic approach to Section 10(b) standing that is out of line with prior Second Circuit and Supreme Court precedent. Mass public defiance of legal authority has a lengthy history in America, extending back to the nation’s founding. Indeed, the very existence of the United States is the result of the ultimate act of defiance against legal authority—the revolution against Great Britain. It hardly stopped there, however. This thesis evaluates the relationship between race science and eugenics, statistical epidemiology and Southern public health thought, African American health, and the 1918-1920 influenza pandemic. Historians have neglected the flu as an important epidemiological event in Southern history and historiography. To demonstrate the significance of the flu, this thesis makes several arguments based on research from new qualitative and quantitative evidence. The chief argument is that African Americans suffered disproportionately compared to whites in the South, challenging the consensus that the flu affected both races equally. Segregation did not protect African Americans from the flu. In some cases, African Americans …

The historiography of Edward II has painted him as a weak king who deserved deposition, overemphasizing his faults while under-examining the circumstances in which he had to rule. Starting from the earliest chronicles, through the early modern period, 19^th and 20^th centuries, and through the present, the historiography demonstrated the changes that Edward II’s reputation has undergone. These changes went from thinking of Edward as a weak king who should be blamed for all of England’s ills, to acknowledging and addressing his faults while realizing that not everything was under Edward’s control to fix.

In the study of Japanese American relocation centers, much of the emphasis is put on the centers while they were still active detention centers, and not what happened to them after they closed. The buildings of the centers often were not scrapped and landfilled but removed and repurposed in the farms and towns surrounding the former center sites, and now blend into their current environments.

It begins with the highway’s formulation and predecessors, ending with the passage and immediate impact of NAFTA following over two decades of disillusionment. The Supreme Court’s 2022 decision in New York State Rifle & Pistol Ass’n v. Bruen brings historical complexity to the fore by instituting a history-focused test for the Second Amendment that demands analogues from the Founding or Reconstruction eras to support modern gun regulations. The majority opinion in Bruen considers, in multiple places, how certain historical gun regulations may have been enforced. Famine is a huge problem for societies, even in the modern world. Throughout history, famine has reared its ugly head and brought about demographic and societal collapse. The Great Famine of 1315 Famine and the Irish Potato Famine, despite their differences, had similar underlying factors of land management and overpopulation paired with an environmental catalyst, and also show that governmental response has the potential to both cause and prevent a famine, but only if the scale of the problem is limited.
