Is Originalism Bullshit?, Michael L. Smith

It’s finally time to answer the big question. This Article draws on the surprisingly robust literature examining the definition, essence, and significance of bullshit and evaluates whether originalist constitutional interpretation fits the bill. I begin with Harry Frankfurt’s definition of bullshit as utterances made in pursuit of the speaker’s goals without regard for their truth value. I also rely on alternate formulations, including bullshit as unclarifiable nonsense as well as contextual and audience-centric variations of bullshit.
While not all instances of originalism are bullshit, I identify those instances which are, and go on to demonstrate that originalism is uniquely prone …

American historians have created an historical absence by ignoring Romani people’s presence in evidence from the past. The origins of this „absence-ing” are multifaceted and interrelated, but fundamentally stem from the continued influence of out-of-date and unprofessional ways of thinking and knowing. Examining and understanding „absence-ing” requires a consideration of the nature of the discipline of history as well as a history of the missing historicization of Romani Americans. Occasional Papers on Religion in Eastern Europe
This paper examines the evolution of religious education and the professional development of clergy in Kazakhstan, with particular emphasis on the establishment of institutions aimed at enhancing the competencies of imams and religious educators. It traces the evolution of the Islamic educational system throughout various historical periods until the present day. Particular focus is given to blending Islamic teachings with contemporary educational structures. The researchers heuristically analyzed the current state of the field, identified the main problems, and suggested prospects for Islamic education for further development. The article focuses on the foundations of Israel’s legitimacy. It explores the issue of Israel’s legitimacy from the viewpoint of the sociology of law and the sociology of politics. It aims to provide perspective and nuance to some highly problematic and inherently anti-Zionist arguments raised by the Palestinian narrative and academic paradigms, such as "settler colonialism" and reductionist manichean theories of conflict.

Three main religious traditions—indigenous African beliefs and practices (African religion), Christianity and Islam—have dominated everyday life of communities in Africa today. Scholarship on religion indicates that only African religion originated in Africa— Christianity and Islam are foreign religions. Many Africans today have been active Christians and Muslims, who are sometimes being misleadingly taught that African religion is demonic and forms of paganism. This article employs historical and philosophical approaches to show how the study of African religion has navigated through various historical currents and resultant implications on the way the current generation views it. This article analyzes the employment of women in the city of Osijek, the fourth biggest city in the Republic of Croatia, using a diachronic approach. The paper’s main goal is to analyze the social position of women in Croatia in relation to employment and their right to work and to examine whether that position has changed in the last two centuries. As exact and reliable historical data are limited, the authors analyzed job announcements and employment offers relating to women in two local newspapers in Osijek. Ahead of his time, Frédéric Ozanam believed that the laity should play an essential role in what he termed the regeneration of the Church, which would lead to the regeneration of society. This would “occur only if Catholic laypersons understood that they had an obligation to transform themselves and then to use their talents to better their Church and their world.” Transformation was to touch all the religious, social, economic, and political aspects of life. To know who we are, Filipinos, we must know who we were, Indios. On the one hand, we have few precolonial documents which might tell who the Indio was; on the other hand, the Filipino is the Westernized Indio. The Filipino is who the West says the Filipino is. According to Western research, the Filipino, like all Orientals, is a residual category of the Occidental: not Western. There is need of independent Asian research. Before his untimely death in 1940, the German philosopher Walter Benjamin wrote an essay, entitled “Theses on the Philosophy of History,” marking his recovery from the shock of the Hitler-Stalin non-aggression pact. This study reflects on the philosophical and historical significance of this essay, unraveling Benjamin’s critique of Marxism as a critique of progress. Progress, which the angel of history sees as a storm coming from paradise, has caused a growing pile of rubble of historical blunders and environmental disasters. This uncritical submission to progress, however, can be seen not only in the blind confidence of the communists and the …

What is Japanese Philosophy? This paper will address this question, not by giving a survey of the works of Japanese philosophers or a definition of the subject matter of Japanese philosophy, but by attempting to present how it emerged as a distinct philosophical tradition—by sketching the controversies that gave rise to its formation; the social, intellectual, and historical factors that paved the way to its development; and the revolution of thought which finally gave it the title “Japanese philosophy.” I will argue that Japanese philosophy was born not because Japanese thinkers desperately wanted a philosophy that they could call their …

Persona 4, through the use of nostalgia and the process of native-place making known as furusato-zukuri, creates a fictional rural space, using authentic Japanese imagery and cultural symbols to make Inaba a 21st-century furusato. In doing so, Persona 4 critiques city life in a neoliberal society, which causes a growing disillusionment with urban living due to a constant state of unrest. Furthermore, through its use of nostalgic imagery which normally emphasizes gender norms in the Japanese culture, Persona 4 flips this idea on its head by showcasing powerful female leads, who, despite living in a space normally …

While cultural theory developed in past eras was often marred by the biases of its privileged authors, we are still often required to teach the canon, so that graduate students can recognize past intellectual trends to which current critiques of the canon respond. In this article, a “History of Feminist Theory” course is employed as an example of larger principles of foundations course design that can be used in any cultural studies seminar to productively address the tension between old and new schools of thought. This project aims to develop an inclusive art history curriculum as a high school level course, addressing the traditional Western-centric focus that has been marginalized non-Western contributions. By pairing Western and non-Western artworks within a chronological framework, students can compare artistic expressions across cultures, emphasizing parallel histories rather than a single Eurocentric narrative. The curriculum employs diverse interpretive methodologies to foster critical thinking and challenge conventional narrative. Designed for a 20-week semester, it focuses on a smaller number of key artworks per unit to encourage meaningful engagement and projects. Recent calls to address racism in bioethics reflect a sense of urgency to mitigate the lethal effects of a lack of action. While the field was catalyzed largely in response to pivotal events deeply rooted in racism and other structures of oppression embedded in research and health care, it has failed to center racial justice in its scholarship, pedagogy, advocacy, and practice, and neglected to integrate anti-racism as a central consideration. Academic bioethics programs play a key role in determining the field's norms and practices, including methodologies, funding priorities, and professional networks that bear on equity, inclusion, and epistemic justice. …

On May 4, 1970, the Ohio National Guard opened fire on students at Kent State University (KSU), killing four and wounding nine. Although this event marked a watershed moment in American culture and the start of a decline in activism related to the war in Vietnam, its place in higher education history is not well-understood. This paper traces the co-evolution of campus activism and the student affairs profession, situates the activism occurring at Kent State nationally and locally, and suggests the impact the shootings had on student affairs and law enforcement practice. Blair Kelley's Black Folk: The Roots of the Black Working Class offers a comprehensive examination of the experiences of working-class African Americans from the Reconstruction era to contemporary times. The book challenges prevailing stereotypes associated with the working class, particularly the imagery that often excludes black Americans, and emphasizes their central role in labor movements and the quest for dignity in work. Through extensive historical research and personal narratives, Kelley highlights the struggles faced by newly emancipated African Americans, who encountered devaluation of their labor and systemic discrimination in the workforce. This article considers the changed landscape for abortion rights since the United States Supreme Court’s opinion in Dobbs v. Jackson Women’s Health. Before Dobbs, the right to choose an abortion was a fundamental right under federal law, enforceable against all state governments. After Dobbs, the scope of one’s right to choose an abortion depends on the state in which one lives, and if abortion is illegal in their home state, their right to travel to another state where abortion is legal. The right to travel is particularly important for workers who must live in an anti-abortion state because their …

My artwork is situated within and around vessels and the Queer Homoerotic World and explores sexuality as a Demisexual within them. This is accomplished through the two processes of my creation, Minivague and Queerform/ing: balancing sexual tension and explicit expression, while subverting traditional norms and stereotypes with queerness to distance oneself from stereotypical Gay Art. Altering/emphasizing makes the artwork more romantic, lighter, whimsical, softer, and tender than the figure/s and the situations actually are. Shenandoah National Park (SNP), established in 1935, was the first major case of the United States seizing privately owned land for the creation of a national park. As a result, approximately 500 families that resided in the area of the Blue Ridge Mountains that was to become SNP were removed from their homes on the mountain throughout the 1930s. This experience of removal greatly impacted not only the displaced themselves, but it has had a lasting impact on their 21st-century descendants. The collective memory of the displaced and their descendants is made up of varying themes that can be used …

This work is a close look at how veterans of war have been treated medically for ailents of the mind. This work looks closely at the many therapies and pharmaceutical remedies that have been perscribed to veterans with the advent of the field of psycology at the trun of the century. Sources included the Diagnostic and Statistical Manual (DSM), multiple clinical trials and white papers, records from the VA, etc. The reader should walk away with a better understanding of how the path towards healing invisble wounds has been mired with revictimization and controversy.
