Citizen Soldiers: The North Carolina Volunteers And The War On Poverty, Robert R. Korstad, James L. Leloudis Oct 1999

Citizen Soldiers: The North Carolina Volunteers And The War On Poverty, Robert R. Korstad, James L. Leloudis

Law and Contemporary Problems

During the summers of 1964 and 1965, more than 300 college students fanned out across the state of North Carolina in a bold campaign to defeat poverty and, as they saw it, to uplift the poor. Korstad and Leloudis trace the history of the North Carolina Fund's Volunteers program, provide an analysis of the contribution that those students made to fighting poverty in the state, and evaluate the impact of that experience on the lives of the Volunteers themselves.

History Of Grassland Birds In Eastern North America, Robert A. Askins Sep 1999

History Of Grassland Birds In Eastern North America, Robert A. Askins

Biology Faculty Publications

Until recently the severe decline in the populations of many species of grassland birds in eastern North America has aroused relatively little concern or conservation action. This response appears to be rooted in the perception that grassland birds invaded the East Coast from western grasslands after European settlers cleared the forest. Detailed historical accounts and analysis of pollen deposits, however, show that open grasslands existed on the East Coast of North America at the time of European settlement. Extensive grasslands resulted from burning and agricultural clearing by Native Americans. Natural disturbances, such as wildfire and beaver (Castor canadensis) activity, produced …

"This Province, So Meanly And Thinly Inhabited": Punishing Maryland's Criminals, 1681-1850, Jim Rice

History Faculty Scholarship

This essay examines three questions, in each case using the colony and state of Maryland as a case study. First, why did some states adopt the penitentiary so much earlier than others? Pennsylvania opened one in 1790, but South Carolina waited until 1868 to do so. Given the variations in timing, did different states establish penitentiaries for different reasons? That seems to have been the case, as a comparison of Maryland's path to the penitentiary with that of other jurisdictions will demonstrate. Second, was the penitentiary truly revolutionary? Perhaps in some places, but not in Maryland. Third, did the diverse …

To Yick Wo, Thanks For Nothing!: Citizenship For Filipino Veterans, Kevin Pimentel Jan 1999

To Yick Wo, Thanks For Nothing!: Citizenship For Filipino Veterans, Kevin Pimentel

Michigan Journal of Race and Law

In this Note, the Author uses science fiction novelist Robert Heinlein's model of citizenship as an analytical framework for examining the historical treatment of Filipino veterans of World War II. The Author Heinlein's conception of citizenship in Starship Troopers was one in which a person can acquire citizenship only through a term of service in the state's armed forces. Similarly, the United States provided immediate eligibility for citizenship to World War II era foreign veterans, but it effectively excluded Filipino veterans from this benefit. The Author examines how the plenary power doctrine in immigration law, has quashed legal challenges by …

"Welcome, Fellow Toastmasters": The History And Membership Of A Public Speaking Phenomenon, Ellen Beth Levine Bremen

UNLV Retrospective Theses & Dissertations

Since 1905, Toastmasters International (TI) serves as the most recognized organization for voluntary oral communication practice in the world. Due to the dearth of scholarly communication research regarding TI, this thesis details the history, educational structure, and program dynamics of the organization. Literature review included the nature and extent of post-secondary communication education, as well as social affiliation and leisure theories. Finally, an Internet survey of 343 international TI members revealed the demographics of the "typical" TI member: a male or female college graduate between the ages of 36--50, who works in a wide range of professions. The study also …

Beyond Black And White: The Civil Rights Movement In Baton Rouge, Louisiana, 1945--1972., Mary Jacqueline Hebert

LSU Historical Dissertations and Theses

The civil rights movement in Baton Rouge, Louisiana, went beyond a battle between blacks and whites over segregation. Within each racial group, factions developed along class, generational, and educational lines. Interactions among these groups shaped the nature and pace of change in the city. In 1945, black World War II veterans launched the movement. Committed to working within the legal system, they established voter registration schools, participated in the 1953 bus boycott, and sued to equalize teachers' salaries and to integrate public schools. In the 1960s, black college students rose to prominence in the movement and used direct action, including …

Sovereignty, Compliance, And The World Trade Organization: Lessons From The History Of Supreme Court Review, Mark L. Movsesian Jan 1999

Sovereignty, Compliance, And The World Trade Organization: Lessons From The History Of Supreme Court Review, Mark L. Movsesian

Michigan Journal of International Law

This article explores the nineteenth-century conflict over Supreme Court review and discusses its implications for today's debate on the WTO. Congress granted the Court appellate jurisdiction over state courts in one of its earliest pieces of legislation, the Judiciary Act of 1789. The first serious challenge to that jurisdiction occurred about a quarter-century later, however, in connection with the Court's famous opinion in Martin v. Hunter's Lessee. The conflict continued episodically for the next four decades, with several states refusing to acknowledge the Court's jurisdiction in particular cases, and ended only with the Civil War, which resolved this and …

Damned To The Inferno? A New Vision Of Lawyers At The Dawning Of The Millennium, Robert J. Cosgrove Jan 1999

Damned To The Inferno? A New Vision Of Lawyers At The Dawning Of The Millennium, Robert J. Cosgrove

Fordham Urban Law Journal

This Article seeks to explain the negative perception the legal profession and lawyers have in the eyes of the American public. Disregarding common answers such as the disproportionate amount of influence lawyers have or high salaries and extravagant lifestyles, this Article argues that a cultural shift has led many Americans to see the law as an arbitrary device. Consequently, this belief is reinforced by lawyers and and perpetuated by law schools, leading to the negative perception of the legal profession. In the process, the Article addresses five main issues: the definition and purpose of the law, the republican theory of …

Confronting The War Machine: Draft Resistance During The Vietnam War, Michael Stewart Foley Jan 1999

Confronting The War Machine: Draft Resistance During The Vietnam War, Michael Stewart Foley

Doctoral Dissertations

This dissertation recovers the history of the draft resistance movement in Boston during the Vietnam War. It is a blend of social, political, and cultural history that seeks not merely to assert the importance of draft resistance to our understanding of the antiwar movement and the Vietnam War era, but also to capture the experience of draft resisters and their supporters.

It is an actor-oriented history. The sources used include the personal private manuscript collections of participants, court records, underground newspapers, a 1997 survey administered to 310 former resisters and draft resistance activists (185 responded), and interviews with more than …

Another New South: Patterns Of Continuity In The Southern Naval Stores Industry., Robert Boone Outland Iii Jan 1999

Another New South: Patterns Of Continuity In The Southern Naval Stores Industry., Robert Boone Outland Iii

LSU Historical Dissertations and Theses

Analysis of southern naval stores production, an industry in many respects more representative of southern economic development than cotton textiles, reveals a pattern of continuity between the antebellum and post-war South. Naval stores manufacturing began in the colonial era but languished as a marginally-profitable business until the 1830s when new uses for spirits of turpentine resulted in increased demand and higher prices. Large turpentine operations developed almost exclusively in eastern North Carolina and the slaves, who performed most of the work, experienced distinct work patterns. By the 1850s, destructive gum-harvesting methods led to the depletion of North Carolina's longleaf pine …

Beyond The Hero Judge: Institutional Reform Litigation As Litigation, Margo Schlanger Jan 1999

Beyond The Hero Judge: Institutional Reform Litigation As Litigation, Margo Schlanger

Reviews

In 1955, in its second decision in Brown v. Board of Education, the Supreme Court suggested that federal courts might be called upon to engage in long-term oversight of once-segregated schools. Through the 1960s, southern resistance pushed federal district and appellate judges to turn that possibility into a reality. The impact of this saga on litigation practice extended beyond school desegregation, and even beyond the struggle for African-American equality; through implementation of Brown, the nation’s litigants, lawyers, and judges grew accustomed both to issuance of permanent injunctions against state and local public institutions, and to extended court oversight of compliance. …

Astride Two Worlds: The Chinese Response To Changing Citizenship In Western Australia (1901-1973), Tian M. Cai

Theses: Doctorates and Masters

Citizenship is central to understanding the nature of Chinese migrants and their relationships within the social and political environment in Australia. Utilising the concept of citizenship can be a new way to interpret the human experience of the Chinese survival in Australia and to show that a historical balance can be found between the Australian social environment on the one side and the Chinese experience in Australia on the other. How the Chinese community reacted to the changing issues in citizenship and attitudes towards Asian immigration become the focus of the thesis. This research is designed to ask how Chinese …
