From The Margins To Pacesetting: The Place Of The Elderly In U.S. Legal History From A Historian's Perspective, W. Andrew Achenbaum

Prior to the Civil War, the small percentage of Americans who were elderly lived on the margins of society. Uncared-for poor elderly persons could be placed in poor-houses. Achenbaum discusses the evolution, through veteran's benefits, Social Security, corporate and union pension plans, and Medicare to a society where the care and well-being of the elderly are among the most important legal issues of the day.

Parenting is a major preoccupation in law and culture. As a result of efforts of the American women's movement over the past forty years, the legal parent is, for the first time in history, sex-neutral. Our law has abandoned restrictions on women's education, employment, and civic participation that sprang from and reinforced beliefs about the primacy of motherhood as women's best destiny. On the flip side, U.S. law now also generally rejects formal constraints on men's family roles by requiring sex-neutrality of laws regulating custody, adoption, alimony, spousal benefits, and the like. Models Of Youth Work: A Framework For Positive Sceptical Reflection, Trudi Cooper

In the post-welfare state, youth workers need models to articulate the purpose and value of their work to politicians and the public, and to explain foundational assumptions about society, young people, values, and mechanisms for personal and social change. Robust on-going discussion about models clarifies the relationship between theory and practice and enables youth work to make use of advances in knowledge in other disciplines, and to innovate constructively when faced with social and political change. Theorisation of models of youth work flourished briefly in the final quarter of the twentieth century. Renewed models of youth work are urgently needed. …

In 1898, the Salvation Army ventured into a colonization project to take urban working poor people, relocate them to rural areas, and allow them to become productive agriculturalists. The impetus for the project was the book, In Darkest England and the Way Out (1890), by General William Booth, the founder of The Salvation Army. General Booth's daughter, Emma, and son-in-law, Fredrick St. George de Lautour Booth-Tucker, took charge of the Salvation Army in the United States in 1896, and took it upon themselves to carry out General Booth's plan in the United States. Administrative Law In The 1930s: The Supreme Court’S Accommodation Of Progressive Legal Theory, Mark Tushnet

In the first decades of the twentieth century, Progressive politicians and legal theorists advocated the creation and then the expansion of administrative agencies. These agencies, they argued, could address rapidly changing social circumstances more expeditiously than could courts and legislatures, and could deploy scientific expertise, rather than mere political preference, in solving the problems social change produced. The proliferation of administrative agencies in the New Deal-the SEC, the NLRB, and others-meant that defending administrative agencies from close judicial oversight became intertwined with defending the New Deal itself In a series of contentious cases decided by the Hughes Court, Progressives believed …

Faith, Charity, Justice, And Civic Learning: The Lessons And Legacy Of Frédéric Ozanam, Raymond L. Sickinger Ph.D.

Frédéric Ozanam’s philosophy and work has much to offer those interested in community service and service learning. Thinkers such as John Dewey and Jane Addams believed that acts of charity allowed the rich to judge the poor and to excuse themselves from greater social responsibility. Charity and social justice were therefore mutually exclusive. In contrast, Ozanam’s definition of Christian charity involved treating poor persons as equals to increase social engagement and transform all of society. Ultimately, all classes were to come together with the same social goals of “peace, order, and happiness.” With the advice of those working in the …

Each "stage" of feminist legal theory-and each brand or strand of feminism- stays alive and is never completely replaced by newer approaches. When I first attempted to synthesize the field of Feminist Legal Theory for a treatise I was writing at the end of the twentieth century, I thought it would be useful to think chronologically and to analyze the major developments of the 1970s, 1980s, and 1990s.
