The year 1963 was a time of international tensions, major social and political turbulence, and the early years of the Second Vatican Council. Great changes were taking place around the world, inspiring Bishop Walter W. Curtis of Bridgeport to create a university in which laity would assume leadership.

After more than two centuries of jurisprudential stillness, the United States Supreme Court undertook the task of discerning the Second Amendment’s meaning in District of Columbia v. Heller, holding that the Second Amendment protects the individual right to self-defense. Since Heller, the lower courts have grappled with determining the scope of the Second Amendment. One question of scope—the subject of this piece—is at what age does a person come within the scope of the Second Amendment’s protections? Some federal and state courts have suggested, and in some cases held, that persons under twenty-one do not enjoy Second Amendment rights. However, …

The End Of Balancing? Text, History & Tradition In First Amendment Speech Cases After Bruen, Clay Calvert, Mary-Rose Papandrea

This Article examines the potential impact on First Amendment free-speech jurisprudence of the U.S. Supreme Court’s increasing reliance on text, history, and tradition in 2022 decisions such as New York State Rifle & Pistol Association v. Bruen. In Bruen, the Court embraced a new test for examining Second Amendment cases. It concentrates on whether there is a historical tradition of regulating the conduct in question, and it eliminates any use of constitutionally common means-end standards of review such as strict and intermediate scrutiny. Those two scrutiny standards often guide the Court’s free-speech decisions. The Bruen majority, however, asserted that its …

Freedom of expression has always been weighed against other values. Like all freedoms, it brings with it a degree of risk that it will be misused to do ill. In the work ahead, I hope to offer a reminder of the value of free expression and a warning against the folly of over-restricting it. Those in favor of censoring and regulating expression too often feign to act as protectors of the much desired public or community safety. What censorship really produces, however, is at best a mere illusion of safety. Only an environment in which all ideas, no matter how …

Different Class: The Creation Of The Premier League And The Commercialization Of English Football, Colin Damms

This project examines how English football evolved from a culture of hooliganism and poor upkeep into a popular and enterprising industry across the globe. The Premier League and its stars marketed the English game and its culture worldwide. Since the 1990s England has established itself as the leading club footballing nation. I argue that through football, and the culture and economics behind it, we can see the ways in which England attempted to change its image in the modern world. In the 1980s and 1990s Britain was confronted with its own established culture of violence, bigotry, and nationalist pride, particularly …

Catalonia, the autonomous region of Spain has seen an increase in secessionist sentiments in recent years. While the past inclination toward independence has been centered on economic autonomy and cultural identity, there has been a recent emphasis on political independence, particularly in the times of crisis. In this thesis. I analyze the relationship between the economic changes during the period of a crisis and the public opinion about the potential Catalan secession. Ronald Reagan’s ideological basis in neoliberalism and the difficulties with cutting out programs to which the citizenry had grown accustomed prompted him to change the narrative on government expenditures, focusing on the rooting out of wasteful and inefficient government agencies and programs as a means by which to lower taxes. In doing so, Reagan created a private sector survey for cost control that placed the responsibility of identifying such waste and inefficiencies under the purview of J. Peter Grace and the private sector—a group of corporate businessmen who shared Reagan’s deregulatory ideology yet were accountable to their own shareholders rather …
