Pragmatism And Parity In Appointments, Yxta Maya Murray Jan 1996

Pragmatism And Parity In Appointments, Yxta Maya Murray

Michigan Journal of Gender & Law

This review uses Carter's two foci as a springboard for analyzing the Article II, Section II appointment process. First, Carter's discussion of indecency in modern appointments may be a valuable theoretical insight into the process instead of a mere sociological observation. "Indecency" in appointments, or what is known as "borking" in Carter parlance, may also be a symptom of race and gender bias in the administration of the Article II, Section II power. To ameliorate the effects of this bias, I suggest the incorporation of pragmatism (a thread of philosophical and legal thought) and parity concepts into the existing appointments …

Friend Of Government Or Damned Tory: The Creation Of The Loyalist Identity In Revolutionary New Hampshire, 1774-1784, James Leslie Walsh Jan 1996

Friend Of Government Or Damned Tory: The Creation Of The Loyalist Identity In Revolutionary New Hampshire, 1774-1784, James Leslie Walsh

Doctoral Dissertations

The dissertation examines the creation of loyalist identity during the American Revolution. Two distinct identities were fashioned, one by the loyalists themselves and a second competing identity which was created for them by their opponents, the radical faction of the revolutionary movement. Both identities were created consciously and for political or economic motives.

The identity created by the loyalists through their actions and words is to be found in a close reading of the claims filed with the Claims Commission created by Parliament in 1783. The dissertation argues that loyalists self-fashioned an individual political identity, as part of the creation …

"Getting America Told": The Black Press And Its Dialogue With White America, 1914-1919, William George Jordan Jan 1996

"Getting America Told": The Black Press And Its Dialogue With White America, 1914-1919, William George Jordan

Doctoral Dissertations

This dissertation examines the role of African-American newspapers as a forum for interracial discourse during World War I. The black press addressed itself to white America, arguing that African-Americans' participation in the war made them worthy of full citizenship, pointing out the similarity between the nation's aim of championing democracy in Europe and the goal of creating racial justice in America, and drawing parallels between atrocities against civilians in Europe and the lynching of African Americans in the Southern states. Some influential white Americans paid attention to these arguments and responded to them. In doing so, they sought to use …

In Search Of A Transcendental Film Style: The Cinematic Art Form And The Mormon Motion Picture, Thomas J. Lefler Jan 1996

In Search Of A Transcendental Film Style: The Cinematic Art Form And The Mormon Motion Picture, Thomas J. Lefler

Theses and Dissertations

This project is an effort to establish a paradigm for reading and tracing transcendence in film art and film propaganda. It addresses the intersection of aesthetic and spiritual planes which is supported by a long and complex tradition of art within religious worship. The study selects a single film as a microcosm of larger issues of cinematic representation and spirituality, in particular the theology of the Church of Jesus Christ of Latter-day Saints (Mormons). It makes a formalistic comparison of structural and and stylistic elements between a Mormon long-form narrative, Legacy (1994) with the classic Hollywood narrative on the one …

The Dangers Of Misappropriation: Misusing Martin Luther King, Jr.'S Legacy To Prove The Colorblind Thesis, Ronald Turner Jan 1996

The Dangers Of Misappropriation: Misusing Martin Luther King, Jr.'S Legacy To Prove The Colorblind Thesis, Ronald Turner

Michigan Journal of Race and Law

This Article focuses on one particular aspect of the colorblind thesis: the misuse of Martin Luther King, Jr.'s image and legacy by liberals, neoliberals, conservatives, and neoconservatives "who cheaply invoke Dr. King's words even as they kill the substance and spirit of his radical message." The campaign supporting the adoption of Proposition 209, the California Civil Rights Initiative ("CCRI"), directly illustrates the misappropriation of King's legacy. Supporters of this anti-affirmative action proposal which calls for racial neutrality and a colorblind America, regularly invoked King's name, suggesting that he would have embraced such a measure. The California Republican Party prepared a …

History Of The Lds Southern States Mission, 1875-1898, Heather M. Seferovich Jan 1996

History Of The Lds Southern States Mission, 1875-1898, Heather M. Seferovich

Theses and Dissertations

This in-depth study of late nineteenth-century missionary work in the Southern States Mission examines the encounter of The Church of Jesus Christ of Latter-day Saints with the American South. It highlights some of the region's varying conditions affecting missionary work and reports the elders' responses to new and different situations, peoples, and subcultures. Examining missionary work from the elders' viewpoint creates a better understanding of what the missionaries experienced and how they reacted to new situations outside the Mormon "corridor" of settlement in the American West. The statistical analysis of the 1,689 elders in the Mission reveals new details about …

[Introduction To] The Postmodern In Latin And Latino American Cultural Narratives: Collected Essays And Interviews, Claudia Ferman Jan 1996

[Introduction To] The Postmodern In Latin And Latino American Cultural Narratives: Collected Essays And Interviews, Claudia Ferman

Bookshelf

In Latin America the postmodern debate contains two big areas of controversy, which are deeply rooted in history and which have profound cultural and political significance. First, the postmodern debate encompasses a series of aesthetico-cultural subjects, such as questions related to literary genre, the processes of literaturization and deliteraturization or the questions of gender associated with textual production. Secondly, the postmodern debate relates to considerations about the processes of the transnationalization of economic and cultural production, and their complex implications concerning questions of identity and cultural production in Latin America.

Partisanship Within The American Civil Libterties Union: The Board Of Directors, The Struggle With Anti-Communism, And Elizabeth Gurley Flynn, Douglas Colin Post Nov 1995

Partisanship Within The American Civil Libterties Union: The Board Of Directors, The Struggle With Anti-Communism, And Elizabeth Gurley Flynn, Douglas Colin Post

Master's Theses

The American Civil Liberties Union and an overwhelming majority of its historians have maintained that the organization has devoted its efforts solely to the protection of the Bill of Rights. This thesis examines that claim, focusing on the events that culminated in the expulsion of Elizabeth Gurley Flynn from the Union's Board of Directors. Relying primarily on the organization's own publications and archives, as well as several insiders' accounts, the analysis concludes that the issue of communism increasingly polarized the Board and, in a gross violation of its nonpartisan commitment to the defense of civil liberties, led ultimately to the …
