"Airbrushed Out Of The Constitutional Canon": The Evolving Understanding Of Giles V. Harris, 1903-1925, Samuel Brenner

Michigan Law Review

Richard H. Pildes argued in an influential 2000 article that the U.S. Supreme Court's opinion in Giles v. Harris, which was written by Justice Oliver Wendell Holmes, was the "one decisive turning point" in the history of "American (anti)-democracy." In Giles, Holmes rejected on questionable grounds Jackson W. Giles's challenge to the new Alabama Constitution of 1901-a document which was designed to disfranchise and had the effect of disfranchising African Americans. The decision thus contributed significantly to the development of the all-white electorate in the South, and the concomitant marginalization of southern African Americans. According to Pildes, however, the …

Passions We Like… And Those We Don't: Anti-Gay Hate Crime Laws And The Discursive Construction Of Sex, Gender, And The Body, Yvonne Zylan

Michigan Journal of Gender & Law

This Article proceeds as follows. In Part II, the author catalogs the history of anti-gay hate crime laws in the United States, describing the rapid spread of state-level laws extending race- and religion-based hate crime laws to LGB people. The Article also provides an overview of federal legislation addressing anti-gay hate crime. In Part III, it examines the policy environment within which anti-gay hate crime laws have been, and continue to be, considered. Specifically, the jurisprudential frameworks that shape, define, and constrain discourses of equality, rights, and social identity are analyzed. Lee Oser. The Return Of Christian Humanism: Chesterton, Eliot, Tolkien And The Romance Of History, Alan Blackstock Jan 2009

Lee Oser. The Return Of Christian Humanism: Chesterton, Eliot, Tolkien And The Romance Of History, Alan Blackstock

English Faculty Publications

In The Return of Christian Humanism: Chesterton, Eliot, Tolkien, and the Romance of History, Lee Oser, a professor of literature at Holy Cross College, follows Chesterton's lead in taking on the heretics, decadents, and aesthetes within the postmodernist critical establishment, extolling Chesterton, Eliot, and Tolkien as defenders of reason and romance and vilifying influential late twentieth-century critics such as Harold Bloom and Helen Vendler, whose alleged attacks on the liberal humanist tradition Oser sees as having eroded not only literary scholarship but indeed the very underpinnings of democratic society. In his preface Oser asserts, "Without scruple or debate, our schools …

A Critical Guide To The Iraqi High Tribunal's Anfal Judgement: Genocide Against The Kurds, Jennifer Trahan Jan 2009

A Critical Guide To The Iraqi High Tribunal's Anfal Judgement: Genocide Against The Kurds, Jennifer Trahan

Michigan Journal of International Law

In the Anfal trial, the Iraqi High Tribunal (IHT or the Tribunal) in Baghdad convicted former Iraqi high officials of genocide, crimes against humanity, and war crimes. Unlike its predecessor-the Dujail trial-the Anfal trial included the presentation of a high volume of documentary and eye-witness evidence. This evidence clearly revealed the existence of a genocidal campaign by the former Iraqi government and military that eliminated an estimated 182,000 Iraqi Kurds in 1988, as part of the eight-phased "Anfal campaign" (the Anfal). Relying on this and other evidence, judges in the Anfal Trial Chamber explained fairly persuasively how genocide, crimes against …

Lost In Legislation: The Cultural And Political Meanings Of "Organic", Lauren Alexandra Cardella Jan 2009

Lost In Legislation: The Cultural And Political Meanings Of "Organic", Lauren Alexandra Cardella

Theses & ETDs

In 2002, the United States Department of Agriculture launched the National Organic Program, which promises that any food labeled "organic" has been grown and processed according to nationally uniform and recognized standards. But what does "organic" mean? Organic agriculture has a long history in the United States as a radical, grassroots movement promoting human health, environmental stewardship, and a decentralized food system. The USDA has a long history of promoting chemical- and capital-intensive agriculture that leads to serious degradation of ecosystems, destruction of small farms and rural communities, and feeds a highly centralized, corporate-controlled food system. How did organic agriculture …

"Soldiers Of Paper And Ink": American Intellectual Interpretations Of The Spanish Civil War, Adam D. Schafer Jan 2009

"Soldiers Of Paper And Ink": American Intellectual Interpretations Of The Spanish Civil War, Adam D. Schafer

Theses & ETDs

This thesis, concentrating on History and Spanish Language and Culture, analyzes the works of four intellectuals who matured between the World Wars: two North Americans, Langston Hughes and Edwin Rolfe; and two Latin Americans Pablo Neruda and César Vallejo. These men viewed the Spanish Civil War as the defining moment of their era. A close fascism in Spain. Rolfe portrayed American volunteers as the descendants of an American revolutionary tradition that had a crucial part in liberating the working class, starting in Spain. For Neruda, the egalitarianism of the Spanish peasantry took the moral high ground against the subhuman, foreign …

The Nobel Effect, Roger P. Alford Jan 2009

The Nobel Effect, Roger P. Alford

Journal Articles

For the first time in scholarly literature, this article traces the history of modern international law from the perspective of the constructivist theory of international relations. Constructivism is one of the leadings schools of thought in international relations today. This theory posits that state preferences emerge from social construction and that state interests are evolving rather than fixed. Constructivism further argues that international norms have a life cycle composed of three stages: norm emergence, norm acceptance (or "norm cascades"), and norm internalization. As such, constructivism treats international law as a dynamic process in which "norm entrepreneurs" interact with state actors …

A Wild Web: The Tangled History Of Attitudes Toward Wildlife In A Dynamic New England Culture, 1945--1985, Mary H. Hopkins

Doctoral Dissertations

Attitudes toward wildlife are considerably more complex than one might suspect. This dissertation started with a hypothesis that population growth would correlate with increasing negative attitudes toward wildlife, but historical evidence only partially supports this hypothesis. Information about the frequency and types of wildlife references appearing in newspapers between 1945 and 1985 was gathered from a systematic sampling of six New Hampshire newspapers that represented towns with differing growth trends. While analysis of quantitative data minimized any correlation between growth and negative attitudes, qualitative data from newspaper articles, archival sources, government reports, books and articles, and other sources provided evidence …

Outside The Circle: The Juxtaposition Of Powwow Imagery And Cherokee Historical Representation, Dana Brumley Jan 2009

Outside The Circle: The Juxtaposition Of Powwow Imagery And Cherokee Historical Representation, Dana Brumley

Electronic Theses and Dissertations

This thesis looks at the juxtaposition presented by the Eastern Cherokee's struggle to present an accurate historical representation of 'Cherokee' against the backdrop of the more lucrative 'Tourist-ready Indian', influenced by powwow imagery. The thesis gives a brief history of the contemporary powwow, discusses the debates surrounding its intrinsic value to American Indians as historically representative, and then examines the shared elements of Cherokee and powwow history. There is an analysis of the influence of powwow imagery on notions of Cherokee history and its correlation to the expectations of visitors to the Cherokee Reservation. Thus, the author argues that the …

Determining The (In)Determinable: Race In Brazil And The United States, D. Wendy Greene Jan 2009

Determining The (In)Determinable: Race In Brazil And The United States, D. Wendy Greene

Michigan Journal of Race and Law

In recent years, the Brazilian states of Rio de Janeiro, So Paulo, and Mato Grasso du Sol have implemented race-conscious affirmative action programs in higher education. These states established admissions quotas in public universities for Afro-Brazilians or afrodescendentes. As a result, determining who is "Black'' has become a complex yet important undertaking in Brazil. Scholars and the general public alike have claimed that the determination of Blackness in Brazil is different than in the United States; determining Blackness in the United States is allegedly a simpler task than in Brazil. In Brazil it is widely acknowledged that most Brazilians are …
