From "Navigable Waters" To "Constitutional Waters": The Future Of Federal Wetlands Regulation, Mark Squillace

Wetlands regulation in the United States has a tumultuous history. The early European settlers viewed wetlands as obstacles to development, and they drained and filled wetlands and swamps at an astounding rate, often with government support, straight through the middle of the twentieth century. As evidence of the ecological significance of wetlands emerged over the last several decades, programs to protect and restore wetlands became prominent. Most notable among these is the permitting program under section 404 of the Clean Water Act. That provision prohibits dredging or filling of "navigable waters, " defined by law to mean "waters of the …

The Public Trust In Surface Waterways And Submerged Lands Of The Great Lakes States, Bertram C. Frey, Andrew Mutz

University of Michigan Journal of Law Reform

The modern public trust doctrine compels each Great Lakes state to protect the sustainable future of the Lakes and to preserve traditional public uses. At the same time, the doctrine constrains the states' powers to allow exploitation of trust resources. This Article provides a brief historical overview of the public trust doctrine in waterways and their submerged lands. It next explores how the eight Great Lakes states have applied the doctrine, discusses the surprising number of differences in the doctrine's development from state to state, and provides comparison charts. There have been numerous studies conducted concerning how various businesses, management groups and library science organizations address the preservation of their history, the development of goals, the evaluation of those goals and how these lead to the positive development of their organization. The Food and Drug Administration has mandated a cumbersome program for monitoring isotrentinoin usage, its analogue barely comes under scrutiny. iPledge is just a plain nightmare. The acumen of the board certified dermatologist is being challenged by Maintenance of Certification proposals because other specialties are doing it; yet, the neighborhood pharmacist is unhampered in dispensing all sorts of advice about treatment. Wright was careful in her approach to slavery, saying it “is not for a young and inexperienced foreigner to suggest remedies for an evil which has engaged the attention of native philanthropists and statesmen and hitherto baffled their efforts.” This changed and eventually she would have no problem asserting her views as well as the accompanying remedies, as is evidenced in Nashoba. She spoke briefly on emancipation and colonization, but only to say that unless they became programs of national concern, they would never be implemented successfully. Dorothea Dix : Student, Reformer And Crusader, Megan Kokontis

Constructing the Past

Dix began her prison reform work by visiting prisons across the country, and two systems emerged as the models of reform. Dix sought a total reform of the system, of both its physical structures, and more importantly, its programs and systems. In order to have a better understanding of the prison systems, Dix traveled throughout the country, visiting prisons, meeting with wardens and evaluating the various systems for their effectiveness. From 1841 to 1843, she visited state prisons, evaluating their respective benefits. Despite her efforts to remain objective, her opinions were always colored by her deeply held religious convictions. This essay addresses a serious deficiency in the literature on women and politics in the United States today: the lack of attention to regional variation and, more specifically, the absence of research on women’s representation in New England. This deficiency is particularly troubling since political analysts of all stripes typically portray New England as imbued with ideological, individual, and structural characteristics likely to lead to rates of political representation higher than the nation as a whole.
