The Lost English Roots Of Notice-And-Comment Rulemaking, Rephael G. Stern

Notice-and-comment rulemaking is arguably the most important procedure in the modern administrative state. Influential accounts even frame it as the 1946 Administrative Procedure Act’s “most important idea.” But its historical origins are obscure. Scholars have variously suggested that it grew out of the constitutionally sanctioned practice of congressional petitioning, organically developed from the practices of nineteenth-century agencies, or was influenced by German conceptions of administrative rulemaking. These histories, however, are incomplete. Using original archival research, this Article demonstrates that notice-and-comment rulemaking was the product of a series of American transplantations of English rulemaking procedures that developed in the late nineteenth …

This Article examines the topics of all lead articles in Washington Law Review during its past ninety-eight years of publication. The analysis illustrates the changing interests of legal academics, student editors, and the working lawyers and judges who have read and used the articles over a century. For its first fifty years, the journal focused on general topics of interest to practitioners, Washington law matters, business and tax law, and government regulation. Computed tomography (CT) imaging has become a cornerstone of modern medical diagnostics, thanks to the groundbreaking work of Sir Godfrey Hounsfield. However, the significant role played by his employer, Electric and Musical Industries (EMI), in providing financial support for his research is often overlooked. In this paper, we explore the connection between EMI's success in the music industry, particularly its signing of the Beatles, and Hounsfield's pioneering work on CT imaging. EMI’s success in the music industry provided the financial stability for Hounsfield's research endeavors. In 1971, he developed the first CT scanner, which revolutionized diagnostic medicine. Historic relationships with the federal government, converged with the strong cultural heritage, autonomy and self-reliance of the Metlakatla Indian Community (MIC) created foundations for strategic resilience during the COVID-19 pandemic. Sentinel milestone events impacting the MIC during the 19th, 20th, and 21st centuries, initiated by the President of the United States, Congress, and the Federal Courts, are analyzed in the context of their impact and support of evolving tribal-centered development and enaction of protections for the MIC.

BACKGROUND: Chiari's Malformation surgical treatment has significantly changed since the "classical" technique description by Gardner (1950). It is probably the most commonly performed approach, even when multiple techniques are available because no substantial changes nor any clear surgical objectives have been made. OBJECTIVE: To demonstrate a new cutting-edge surgical technique mastering the advantage of each surgical procedure ever described in the history of Chiari's Malformation establishing three critical points in surgical technique: clear patient-specific surgical goals, dynamic posterior fossa reconstruction, and extradural occipitoatlantal dense-adhesions release. This chapter examines the state of apprenticeship programs in the United States and Virginia, assessing their role in the labor market. We begin with an overview of national apprenticeship policy, tracing major laws and initiatives that have influenced the system’s evolution and expansion. We then review trends in apprenticeship participation, highlighting the states that lead in registrations and program growth. The discussion pivots to Virginia, where we analyze current occupation, wage and demographic data, and regional apprenticeship examples that connect education and industry. Finally, we consider whether apprenticeships represent a sustainable and scalable solution to the Commonwealth’s workforce challenges.

The Tenth Anniversary Of Marriage Equality: How Traditional Marriage Law Led To Constitutional Protection For Same-Sex Marriage, Joanna L. Grossman

This essay explores how the history of interstate marriage recognition law was central to the Supreme Court’s recognition of constitutional protection for the right of same-sex couples to marry. Prior to the 1990s, there were essentially no laws on same-sex marriage in the United States. That changed in the 1990s, when the Hawaii Supreme Court issued a ruling in Baehr v. Lewin that made authorization of same-sex marriage seem inevitable in that state. The threat fueled the adoption first of the federal Defense of Marriage Act (DOMA) in 1996 and then mini-DOMAs in most states. Those laws were broad and …

Cardiac arrest remains a leading cause of death worldwide and is a global health crisis. First described in the medical literature in the 18th century, modern cardiopulmonary resuscitation (CPR) with closed chest compressions has remained the standard of care since 1960. Despite exponential advances in basic science research and technological innovations, cardiac arrest survival remains a dismal 10%. The standard of care closed chest compressions provide only 20–30% of baseline cardiac output to the body. Have modern therapies plateaued in effectiveness? This article reviews the history of cardiac arrest, its therapies, and opportunities for future treatments. Through an exploration into …

Playing Through Music History: The Contextualizing Function Of Western Historical Music In Fantasy Role-Playing Video Games, Laney Abigail Sheehan

This thesis focuses on the presence of Western historical music in contemporary video games. Through a combination of music-theoretical analysis, iconography, and Peircean semiotics, the author demonstrates that the nondiegetic soundtracks of fantasy role-playing video games utilize elements of major style periods in music history—including the Middle Ages, Renaissance, Baroque, and Classical eras—to enhance existing representations of time and place in their visual environments. This phenomenon is particularly apparent in three games, which serve as case studies: Baldur’s Gate 3 (2023), The Legend of Zelda: Breath of the Wild (2017), and Elden Ring (2022). The history and controversy concerning aluminum use in beverage and food preparation and storage are reviewed. This review on aluminum in drinking water, foods, and beverages updates and exceeds prior reviews. Country and international organization regulations that permit incorporation of aluminum containing food additives, their use limit, and purposes are presented. The aluminum concentration in beverages and foods consumed worldwide was gleaned from approximately 2100 sources available to the author. The approximately 17700 values are compiled in 175 tables by beverage or food category that include the analytical method used, sample source, and reference. The tables are posted on the …

Valuing Cheap: Constructing, Consuming, And Contesting The Dollar Store Economy, Frances Evelyn Barrett

In Valuing Cheap, Barrett traces the histories of Dollar General, Family Dollar, and Dollar Tree from the firms’ twentieth century origins in three distinct southern locales into corporate behemoths with more stores than McDonald’s or Walmart. Valuing Cheap provides an important chapter of the late twentieth century history of racial capitalism, detailing how dollar stores at once “served” local communities while capitalizing on existing spatialized, racialized, classed, and gendered inequalities. This history illuminates the interwovenness of business, consumer, and labor histories, emphasizing the fundamental entanglements of power, material and cultural production, and consumption. This dissertation is a history of the interdisciplinary field of systems theory from the perspective of Central European scientists and intellectuals who migrated to North America during the 20th century. It is a story about how people, ideas, and techniques circulated in new ways across a period of global upheaval, about how the philosophy of science became a stage for urgent political questions, and about how scientists tried to grasp the whole without surrendering authority over its constituent parts. This project will summarize findings from six oral histories of LGBTQ+ people who lived in Montana, but have left or are leaving in the near future. This project will explore the questions: Why are queer and transgender people leaving Montana? What are common experiences for LGBTQ+ people living in Montana? The answer to these questions will be derived from the stories of the Narrators who provided their oral histories. The questions utilized in the oral histories covered topics of identity, “coming out,” living history, cultural observations, community experiences and perceptions, well-being, healthcare, laws, and reasons for leaving. This thesis critically examines the exclusion of LGBTQ+ and disabled voices in African American history curricula at predominantly white institutions (PWIs) in Ohio, advocating for a decolonial pedagogical approach that centers intersectional narratives. By analyzing course descriptions, syllabi, and faculty communications from PWIs such as Wright State University, it reveals a pervasive omission of queer and disabled Black experiences, reinforcing a narrow historical lens. The study proposes a 15-week, praxis-based syllabus that integrates critical pedagogy, intersectionality, queer and disability theory, and service learning to foster inclusive historical engagement. Aestheticizing And Engendering Disease: The Case Of Tuberculosis, Abigail Dollries

This thesis examines how tuberculosis, known in the nineteenth century as “consumption,” was aestheticized in American cultural and medical discourse, particularly in industrial cities of the North between 1830 and 1850. It addresses the paradox at the heart of the disease’s representation: while tuberculosis was medically pathologized, it was simultaneously romanticized, especially when afflicting elite white women. The central problem explored is how this aestheticization of illness functioned to reinforce gender, class, and racial hierarchies by transforming suffering into a symbol of virtue, refinement, and social status.
