Forging Literary History: Historical Fiction And Literary Forgery In Eighteenth-Century Britain, Anne H. Stevens Jan 2008

Forging Literary History: Historical Fiction And Literary Forgery In Eighteenth-Century Britain, Anne H. Stevens

English Faculty Research

In this essay, I wish to explore a similar dialectic of historical positivism and skepticism in eighteenth-century Britain. Over the course of the century, but particularly in the second half, new and more scientific standards of historical investigation developed, with practitioners expressing a greater confidence about their ability to know the past. During these years, a series of monumental achievements in historiography appeared: David Hume’s History of England (1754–62), Edward Gibbon’s Decline and Fall of the Roman Empire (1776), and William Robertson’s History of Scotland (1759), to name just three of the most celebrated. As part of this increased interest …

Caregiving And The Case For Testamentary Freedom, Joshua C. Tate Jan 2008

Caregiving And The Case For Testamentary Freedom, Joshua C. Tate

Faculty Journal Articles and Book Chapters

Almost all U.S. states allow individuals to disinherit their descendants for any reason or no reason, but most of the world's legal systems currently do not. This Article contends that broad freedom of testation is defensible because it allows elderly people to reward family members who are caregivers. The Article explores the common-law origins of freedom of testation, which developed in the shadow of the medieval rule of primogeniture, a doctrine of no contemporary relevance. The growing problem of eldercare, however, offers a justification for the twenty-first century. Increases in life expectancy have led to a sharp rise in the …

Christianity And The Legal Status Of Abandoned Children In The Later Roman Empire, Joshua C. Tate Jan 2008

Christianity And The Legal Status Of Abandoned Children In The Later Roman Empire, Joshua C. Tate

Faculty Journal Articles and Book Chapters

Late Roman imperial legislation relating to abandoned or exposed children has been the subject of much debate. Some have argued that the constitutions of Constantine relating to abandoned children marked a new Christian influence, and that the years between Constantine and Justinian merely refined and explained Constantine's legislation. This paper argues that the legislation of Constantine was not distinctly Christian in content, but that some Christian influence can be seen in the rhetoric of imperial constitutions beginning in the fifth century, and that Christian ideas seem to have affected both the substance and the rhetoric of Justinian's legislation. The paper …

Watchmen Of The New Jerusalem: Jedidiah Morse, The Bavarian Illuminati And The Refashioning Of The Jeremiad Tradition In New England, Rachel A. Snell Jan 2008

Watchmen Of The New Jerusalem: Jedidiah Morse, The Bavarian Illuminati And The Refashioning Of The Jeremiad Tradition In New England, Rachel A. Snell

Master's Theses and Capstones

On May 9, 1798, the Reverend Jedidiah Morse of Charlestown, Massachusetts introduced a threat to both American government and religion in the form of the Bavarian Illuminati. This thesis argues that the Bavarian Illuminati sermons represent an attempt by the orthodox Congregational clergy in Massachusetts to mediate between republican ideology and traditional New England religious expectations by utilizing the clerical role of social watchmen to instill a sense of virtue in the American public and guide the development of a New Jerusalem in republican America. The goals of the clergy in propagating the Bavarian Illuminati threat ultimately failed catastrophically. Although …

"I Will Learn You Something If You Listen To This Song": Southern Women Writers' Representations Of Music In Fiction, Courtney George

LSU Doctoral Dissertations

This dissertation offers a rhetorical analysis of the formation of women’s memory, history, and communities in intersections of musical and literary expression in the American South, a region graced with a vital but underexamined tradition of female musicianship. Recent scholars have deconstructed the imagined narrative of southern culture as static, patriarchal, and white to uncover alternative stories and cultures that exist outside of canonical literature. This project significantly expands current understandings of these conflicting narratives by investigating how women writers recall, reclaim, and re-envision women’s roles in southern music to challenge, comply, and/or identify with women’s prescribed place in the …

Target Saving In An Overlapping Generations Model, Ashok S. Guha, Brishti Guha Jan 2008

Target Saving In An Overlapping Generations Model, Ashok S. Guha, Brishti Guha

Research Collection School Of Economics

We examine a model in which the utility function has been engineered so that it is optimal for consumers to aim for a fixed target level of retirement resources. In this case consumption displays excess sensitivity to current income as well as perfect old age insurance. In an overlapping generations model, this leads naturally to multiple and unstable equilibria. Under static expectations, it also leads to a well-defined dynamics, including possible historical traps, implosions involving ever-diminishing capital stock and ever-increasing interest rates, and the feasibility of optimal one-time interventions.

In The Trenches: Searches And The Misunderstood Common-Law History Of Suspicion And Probable Cause, Fabio Arcila Jan 2008

In The Trenches: Searches And The Misunderstood Common-Law History Of Suspicion And Probable Cause, Fabio Arcila

Scholarly Works

A detailed analysis of the common law during the Framers’ era, and of how it reflected the Fourth Amendment’s restrictions, shows that many judges believed they could issue search warrants without independently assessing the adequacy of probable cause, and that this view persisted even after the Fourth Amendment became effective. This conclusion challenges the leading originalist account of the Fourth Amendment, which Professor Thomas Davies published in the Michigan Law Review in 1999.

Learned treatises in particular, and to a lesser extent a few case decisions, had articulated a judicial duty to monitor probable cause. But it is a mistake …

Immigration Reform From The Outside In, Bill Piatt Jan 2008

Immigration Reform From The Outside In, Bill Piatt

Faculty Articles

Immigration reform is made up of two differing extreme positions, but by seeking common ground, a more fair and balanced approach may be adopted in the best interests of all.Rather than trying to analyze positions as conservative or liberal, it makes more sense to view the extremes as a “closed border” versus “open border” approach. The extreme positions will not work, so a more middle-ground position would require a thoughtful examination of a number of issues. Those issues are what are the costs and benefits of removing those already illegally here; what role should the federal, state, and local governments …

Micropolitics Of Transition In Yugoslavia, Martin Y. Marinos Jan 2008

Micropolitics Of Transition In Yugoslavia, Martin Y. Marinos

Electronic Theses and Dissertations 2000 - 2009

The thesis provides a cultural analysis on the micropolitics of Yugoslavia wars in 1992-1995, examining local and global media coverage along with grassroots and historical dimensions. The study offers an extensive overview of scholarly literature on the Balkans, arguing that often omitted local, cultural and historical narratives of the war events reveal complex perspectives on the rationales provided on civil war. Investigating the nationalist social movements in Yugoslavia (1992-1995), the thesis articulates the need to revisit Deleuze and Guattari's framework of micropolitics to understand the cultural and historical dimensions operational in such movements. The study presents local media coverage in …

More Than "Just A Hunch", Sheela Celeste Dominguez

Electronic Theses and Dissertations 2000 - 2009

The rise in popularity of the female sleuth television programs makes it important to explore representations of gender and knowledge. This investigation analyzes interpretations of intuition in the television sleuth genre and relevant paratexts, examines gendered public and private spheres and raises broader questions about gendered knowledge in the series Medium, Crossing Jordan, Law and Order: Criminal Intent, Veronica Mars, Monk, The Profiler and True Calling. Rooted in feminist cultural studies, historical and sociological analysis, television and film theory and work on the detective genre, this investigation establishes common frames, or filters, through which the television sleuth genre represents intuition …

Evolution Of Numeracy And The National Numeracy Network, Bernard L. Madison, Lynn Arthur Steen Dec 2007

Evolution Of Numeracy And The National Numeracy Network, Bernard L. Madison, Lynn Arthur Steen

Numeracy

The National Numeracy Network grew from heightened awareness of the complex and sophisticated nature of quantitative literacy and the resulting need for interdisciplinary attention to education for quantitative literacy in schools and colleges. This complexity and sophistication applies especially to the US where it is fueled by an agile economy and the needs of a democratic society. This paper describes the environment surrounding the National Numeracy Network’s establishment, some of its activities, and some complementary and synergistic actions by other professional societies. The paper concludes with a sample of quantitative literacy programs in colleges and universities
