Liberating Genocide: An Activist Concept And Historical Understanding, Tony Barta
Liberating Genocide: An Activist Concept And Historical Understanding, Tony Barta
Genocide Studies and Prevention: An International Journal
From the outset, historians of genocide have seen themselves as activists. Among historians of colonial societies that is what distinguishes them most in relation to indigenous peoples. An ethnographic sensibility should be visible in any such study, and the more so when a question of genocide is raised. After all, if we do not have a sense of difference between peoples we fail the test of genocide at the first hurdle. And if we do not have an ethnographic sensibility towards our own cultures (including academic cultures) we will fail to make the most of our role in affecting deeply …
Medicine As A Public Calling, Nicholas Bagley
Medicine As A Public Calling, Nicholas Bagley
Michigan Law Review
The debate over how to tame private medical spending tends to pit advocates of government-provided insurance—a single-payer scheme—against those who would prefer to harness market forces to hold down costs. When it is mentioned at all, the possibility of regulating the medical industry as a public utility is brusquely dismissed as anathema to the American regulatory tradition. This dismissiveness, however, rests on a failure to appreciate just how deeply the public utility model shaped health law in the twentieth century— and how it continues to shape health law today. Closer economic regulation of the medical industry may or may not …

The Living Heritage Of Prepping, Julianna Marilyn Lindsay
The Living Heritage Of Prepping, Julianna Marilyn Lindsay
Student Theses and Dissertations
Within the prepping community there are a subgroup of preppers, homesteaders, and survivalists who to varying degrees base their behaviors and motivations on heritage connections. These connections are found in the form of heritage values which inform their actions. Prepping, survivalism, and homesteading are not a monolithic movement or even necessarily seen as a movement at all by participants who may share no connections with others involved in the same activities. Although preppers, homesteaders, and survivalists may display some of the same behaviors such as stockpiling food or other aspects of material and intangible culture, their motivations may vary widely. …

The Keyes To Reclaiming The Racial History Of The Roberts Court, Tom I. Romero, Ii
The Keyes To Reclaiming The Racial History Of The Roberts Court, Tom I. Romero, Ii
Michigan Journal of Race and Law
This Article advocates for a fundamental re-understanding about the way that the history of race is understood by the current Supreme Court. Represented by the racial rights opinions of Justice John Roberts that celebrate racial progress, the Supreme Court has equivocated and rendered obsolete the historical experiences of people of color in the United States. This jurisprudence has in turn reified the notion of color-blindness, consigning racial discrimination to a distant and discredited past that has little bearing to how race and inequality is experienced today. The racial history of the Roberts Court is centrally informed by the context and …

Coming To America: An Examination Of The U.S. Immigration Debate In Its Historical Context, Julie R. Davidson
Coming To America: An Examination Of The U.S. Immigration Debate In Its Historical Context, Julie R. Davidson
Kaleidoscope
The United States is considered a country of immigrants, but a historical tension has existed between new arrivals and the “native” population. Policies regarding immigration have frequently mirrored the nativist fervor that is created in opposition to large influxes of immigrants. The debate about revamping immigration policy, that has been a key issue in Congress in 2006, is not surprising in an historical context. The concern about large numbers, the fear of draining social services, dilution of American culture, loss of American jobs, and the compromising of national security are all concerns that have been voiced recently, and are almost …

How Do You Make A Society Wise?, Barry Jason Mauer

A wise society looks after the well-being of its citizenry. In order for there to be a wise society, though, many or most of its citizenry also must be wise since they create the society. But the society must educate its citizens to be wise.

On The "Poverty Of Responsibility": A Study Of The History Of Child Protection Law And Jurisprudence In Nova Scotia, Ilana Luther
On The "Poverty Of Responsibility": A Study Of The History Of Child Protection Law And Jurisprudence In Nova Scotia, Ilana Luther
PhD Dissertations
This thesis presents a history of child protection law and jurisprudence in Nova Scotia. The thesis begins by examining the development of the first child protection statute in Canada, the Nova Scotia Prevention and Punishment of Wrongs to Children Act in 1882. The Act was developed amidst a climate of reform in late-19th century Halifax, at the urging of the Society for the Prevention of Cruelty to Animals. The Act, along with a number of other pieces of “domestic relations” legislation at the time, was focused on protecting children in poverty. With the passing of the Act, the legislature not …
Weathering The Empire: Meteorological Research In The Early Nineteenth-Century Straits Settlements, Fiona Williamson
Weathering The Empire: Meteorological Research In The Early Nineteenth-Century Straits Settlements, Fiona Williamson
Research Collection School of Social Sciences
This article explores meteorological interest and experimentation in the early history of the Straits Settlements. It centres on the establishment of an observatory in 1840s Singapore and examines the channels that linked the observatory to a global community of scientists, colonial officers and a reading public. It will argue that, although the value of overseas meteorological investigation was recognized by the British government, investment was piecemeal and progress in the field often relied on the commitment and enthusiasm of individuals. In the Straits Settlements, as elsewhere, these individuals were drawn from military or medical backgrounds, rather than trained as dedicated …

A wide gap exists between the phenomenon of cultural appropriation and historical claim. How do you justify when you are 12 and at that age you have been programmed by an information structure and culture that has defined every identifying feature?
The migration phenomenon, the informal market, and the constant flow between the idealization of the First World in the northern corner and the underworld in the backyard, made it possible for me one day, while walking with my grandmother in a street market in Mexico, to stumble across a cassette tape with Ice Cube’s face on it that said …
Chateaubriand And His Influence On The Early French Romantics' Perspective On Nature, Kyra Kalina Sanchez Clapper
Chateaubriand And His Influence On The Early French Romantics' Perspective On Nature, Kyra Kalina Sanchez Clapper
Electronic Theses and Dissertations Archive
This work analyzes Chateaubriand's writings on America and compares them to Rousseau's philosophical writings on nature. In doing so, Iargue that Chateaubriand showed an exception interest in nature without human intervention - unlike Rousseau, who had an anthropomorphic approach to nature. By emphasizing Chateaubriand's nonanthropomorphic approach to nature, this paper rejects the monolithic view of FrenchRomanticism and contributes a deeper understanding of this important trend eighteenth century onwards. In order to arrive at a global picture of Chateaubriand's idea of nature, the primary source I will analyze are Chateaubriand's Atala, Voyage en Amerique, and Memoires d'outre-tombe and Rousseau's Discours sur l'origine …

Underground Fieldwork – A Cultural And Social History Of Cave Cartography And Surveying Instruments In The 19th And At The Beginning Of The 20th Century, Johannes Mattes
Underground Fieldwork – A Cultural And Social History Of Cave Cartography And Surveying Instruments In The 19th And At The Beginning Of The 20th Century, Johannes Mattes
International Journal of Speleology
At the turn of the 20th century, the practical examination of caves went through a radical change. Governmental organizations and private clubs were founded in an attempt to establish speleology as an independent academic subject. In contrast to earlier cave visitors, travelers began entering underground areas and attributing the names of “explorers” or “researchers” to themselves. Fieldwork—especially cave surveying and cartography—became common practice in speleology and such work provided important clues on speleogenesis, which was a controversial issue in the first half of the 20th century. Due to the fact that speleologists began separating themselves from ordinary …
Originalism As Thin Description: An Interdisciplinary Critique, Saul Cornell
Originalism As Thin Description: An Interdisciplinary Critique, Saul Cornell
Res Gestae
My essay was intended as a critique of originalism from the perspective of intellectual history. I pointed out that originalism lacked a rigorous empirical method for analyzing what texts meant in the past. I suppose in some sense it is flattering that Solum has devoted much of his recent article to an attack on my earlier essay. Of course, flattery aside, it would have been more useful if Solum had stated my thesis correctly. For purposes of clarity, I have juxtaposed Solum’s description of my argument with what my essay actually said. Readers will be able to judge for themselves …
To Use Or Not To Use: Nepal Samvat, The National Era Of Nepal, Bal G. Shrestha
To Use Or Not To Use: Nepal Samvat, The National Era Of Nepal, Bal G. Shrestha
HIMALAYA, the Journal of the Association for Nepal and Himalayan Studies
This paper presents the importance of Nepal Samvat in Nepalese cultural life and compares it with Vikram Samvat, the official calendar of Nepal. Presenting a discussion on eras prevalent in Nepal, this paper examines the significance of the Nepal Government’s recent recognition of Nepal Samvat as the national calendar of Nepal. It presents a historical and cultural overview of the different eras and calendars that are in use in Nepal. It attempts to demonstrate a continuous historical legitimacy of Nepal Samvat, in contrast with Vikram Samvat, which is shown to be a fairly recent imposition associated with the Rana period, …
Which Medicine? Medicine-Taking And Changing Sherpa Lives, Susan Heydon
Which Medicine? Medicine-Taking And Changing Sherpa Lives, Susan Heydon
HIMALAYA, the Journal of the Association for Nepal and Himalayan Studies
An increasing quantity of medicines, including medicines of different healing systems, have become available since the nineteen fifties to the mainly Sherpa inhabitants of the Mt. Everest region of Nepal. Considerable change and economic development has occurred in which this mountainous and remote area has become one of Nepal’s principal tourist destinations and people have gained access to education, health services, and modern means of communication. Many Sherpa travel regularly in Nepal and overseas, especially for work, education, or pilgrimage, or have migrated permanently. Focusing on oral histories, this article explores factors that have influenced people’s use of different medicines …
