Equity, Due Process And The Seventh Amendment: A Commentary On The Zenith Case, Patrick Devlin
Equity, Due Process And The Seventh Amendment: A Commentary On The Zenith Case, Patrick Devlin
Michigan Law Review
The seventh amendment to the United States Constitution requires that "[i]n Suits at common law . . . the right of trial by jury shall be preserved." What exactly is a suit at common law? When the amendment was enacted in 1791, there was no law that was common to all the states. In 1812 Supreme Court Justice Story, in a Circuit Court ruling, held that the common law alluded to was the common law of England, "the grand reservoir of all of our jurisprudence." This means that when today an American judge has to decide whether in any set …

Forgotten Points In The "Exclusionary Rule" Debate, James Boyd White
Forgotten Points In The "Exclusionary Rule" Debate, James Boyd White
Michigan Law Review
Most contemporary discussions of the "exclusionary rule" assume or assert that this "rule" is not part of the fourth amendment, nor required by its terms, but is rather a judicial "remedy" that was fashioned to protect those rights (against unreasonable search and seizure) that actually are granted by the fourth amendment. The protection is said to work by "deterring" official violations; this is, however, an odd use of the word, for the rule does not punish violations but merely deprives the government of some of the benefits that might ensue from them, namely the use in the criminal case of …

John Muir, The Geologist Of The Yosemite., John Muir
John Muir: A Reading Bibliography by Kimes (Muir articles 1866-1986)
JOHN MUIR, THE GEOLOGIST OF THE YOSEMITE" ROBERT ENGBERG One reason for John Muir's successful leadership of the Sierra Club was his reputation for being morally correct and righteous in his cause. During his years as club president he also became the incorruptible figurehead for the entire American conservation movement, and in the public's eye became something more than the simple "mountaineer" Muir claimed to be. Muir knew the importance of his role as conservation leader, however, and willingly cultivated it; he sensed that his personality as well as his convictions were needed to bind together the different groups who …

The History, Usage, And Technique Of The Chinese Cheng, Jeanne E. Stiegel
The History, Usage, And Technique Of The Chinese Cheng, Jeanne E. Stiegel
Honors Capstones
Throughout Chinese history, music has been an integral part of the lives of the Chinese people. It was very symbolic; it was considered part of the universe. The entertainment value of music was secondary to its use for religious purposes and for the education of gentlemen. The instruments of China generally fall into one of two categories: metal and string. Among the major string instruments are the ‘pi-p’a (a four-stringed, lute-type instrument), the erhu (a two-stringed, bowed instrument), the sanxian (a three-stringed, banjo-like instrument), and the zither family. The two main Chinese zithers are the ch’in and the cheng. The …

Strangers In The Land: The Southern Clergy And The Economic Mind Of The Old South., Kenneth Moore Startup
LSU Historical Dissertations and Theses
The antebellum southern clergy has often been characterized as narrow-minded and reactionary with little or no social vision and with little or no commitment to social reformation. My study, which is based upon an expansive survey of the sermons and religious writings of protestant slave state ministers, reveals instead an insightful, critical, and outspoken clergy determined to change southern society; principally to turn southerners from materialism and greed to spirituality and altruism. In their attempt to reform southern society, they condemned explicitly what they considered the ostentation, arrogance, and selfishness of the upper classes and called for a more equitable …
Platonic Economic Theory: The Economics Of Moderation., Kenneth Neal Townsend
Platonic Economic Theory: The Economics Of Moderation., Kenneth Neal Townsend
LSU Historical Dissertations and Theses
This dissertation analyzes the contributions to the economic analysis of welfare made by the ancient Greek philosopher Plato. Heretofore unexamined, these contributions demonstrate the importance of the development of notions of sufficiency and moderation as integral parts of welfare analysis. This dissertation also examines the significance of Plato's method of inquiry into matters of social science for contemporary economic analysis. In particular, the importance of metamathematical induction for the acquisition of knowledge of the values upon which welfare depend is analyzed in the form that it is employed in Plato's dialogues. This analysis is conducted to the end that economists …
