Verdict According To Conscience: Perspectives On The English Criminal Trial Jury 1200-1800, Thomas A. Green Jan 1985

Verdict According To Conscience: Perspectives On The English Criminal Trial Jury 1200-1800, Thomas A. Green

Books

This book treats the history of the English criminal trial jury from its origins to the eve of the Victorian reforms in the criminal law. It consists of eight free-standing essays on important aspects of that history and a conclusion. Each chapter addresses the phenomenon that has come to be known as "jury nullification," the exercise of jury discretion in favor of a defendant whom the jury nonetheless believes to have committed the act with which he is charged. Historically, some instances of nullification reflect the jury's view that the act in question is not unlawful, while in other cases …

The Evangelical New Light Clergy Of Northern New England, 1741-1755: A Typology (Great Awakening, Maine, New Hampshire, Revival), Laura Broderick Ricard Jan 1985

The Evangelical New Light Clergy Of Northern New England, 1741-1755: A Typology (Great Awakening, Maine, New Hampshire, Revival), Laura Broderick Ricard

Doctoral Dissertations

Based on the prosopographical analysis of twenty-five Maine and New Hampshire clergymen, this dissertation corrects the prevailing treatment of New Lights, who emerged during the Great Awakening, as if they were of a monolithic "mind." It counters the oversimplified labeling of mid eighteenth-century evangelicals with a typology that establishes subtle gradations of New Light piety according to appreciable differences in theology and religious practice. It examines the mysticism of the most extreme New Lights, and suggests that the strong pneumatic impulse that manifested itself in their violent yearnings for an emotionally satisfying relationship with God was a thread that continued …

Sebastian Brant And The Northern Renaissance, Charles T. Eby Jan 1985

Sebastian Brant And The Northern Renaissance, Charles T. Eby

Sacred Heart University Review

It is the purpose of this paper to investigate the response of Sebastian Brant, one of the leading figures of German Humanism in the late fifteenth century, to the changes that the Renaissance stirred in Northern Europe. By concentrating in particular on his vernacular works, an attempt will be made to determine the elements in Brant's life and thought that were inspired by this Renaissance movement. Another aspect of Sebastian Brant that will be analyzed is the manner in which he differed from the basic trends of the Northern European Renaissance. Finally, Brant will be placed among the ranks of …

Rusticus: Notes On Class And Culture In Rural New Hampshire, Donald Hall

New England Journal of Public Policy

Old New Hampshire Highway Number Four was incorporated by an act of the New Hampshire legislature in the autumn of 1800. It wound out of Portsmouth, a seaport that once rivaled Boston, drove west through Concord, north past Penacook, through Boscawen, Salisbury, Andover, and Wilmot on its way to Lebanon and the Connecticut River. These names string history like beads. The Penacook tribe assembled each year on the banks of the Merrimack at the site of the present town that bears their name. I grew up thinking Boscawen an unusual Indian name; it is Cornish, surname of an admiral victorious …

UNF Graduate Theses and Dissertations

Text specific reading/learning strategies that reflect recent theoretical research in the reading process were incorporated into the 10th grade world history curriculum. These methods were intended to afford success for a specific group of students who had a history of failure and so lead those students toward independent reading and learning. They were also intended to motivate the world history teachers to use procedures that are congruent with the findings of research in reading and learning.

The European Community And The Requirement Of A Republican Form Of Government, Jochen Abr. Frowein May 1984

The European Community And The Requirement Of A Republican Form Of Government, Jochen Abr. Frowein

Michigan Law Review

The European Community - that is, the factual entity composed of three legally separate communities which has been and still is one of the basic concerns of Eric Stein - cannot be understood without taking into account European history after 1933. As an irony of history, the stage for a new beginning was set by the man who destroyed the old Europe and who was the reason that so many academics left the "old country" for the new world. This new start was not only influenced by the determination of those Europeans who had lived through the darkness to overcome …

Probable Cause And Common Sense: A Reply To The Critics Of Illinois V. Gates, Joseph D. Grano Apr 1984

Probable Cause And Common Sense: A Reply To The Critics Of Illinois V. Gates, Joseph D. Grano

University of Michigan Journal of Law Reform

Part I of this article reviews Gates's actual holding. Although one can view much of the Court's more interesting discussion of the two-pronged test as dicta, the majority and dissenters clearly did not regard it as such. The majority and dissenters disagreed, however, not only over the appropriate hearsay test but, more fundamentally, over the nature of probable cause itself. I will argue that one must resolve this more basic disagreement before properly addressing the hearsay issue.

Part II examines probable cause from an historical perspective. In this part, I attempt to demonstrate that both the English common law …
