Learner-Centered Instruction: Inquiry-Based, Technology-Enriched, Integrating Workplace Reality: A Resource Guide For Teachers, Marjorie L. Mclellan Jan 2001

Learner-Centered Instruction: Inquiry-Based, Technology-Enriched, Integrating Workplace Reality: A Resource Guide For Teachers, Marjorie L. Mclellan

Geography Faculty Publications

Inquiry-based instructional strategies function best with motivated students whose interest and imagination are already enlivened and whose curiosity will help them master new learning skills. The responsibility for supplying the initial impetus falls upon many diverse entities across the student's educational life. College teachers often inherit students with years of spoon-fed, low-expectation instruction, challenging instructors in higher education to overcome this deficit. Fortunately, most students possess a native curiosity that is eventually heightened by academic success, especially when their achievements are perceived to stem from their own work and thought processes. This is the power of inquiry-based learning.

The Deconstruction Of Refugees And The Reconstruction Of History, Peter W. Van Arsdale Jan 2001

The Deconstruction Of Refugees And The Reconstruction Of History, Peter W. Van Arsdale

Human Rights & Human Welfare

A review of States and Strangers: Refugees and Displacements of Statecraft, by Nevzat Soguk. Minneapolis: University of Minnesota Press (Borderlines Series, No. 11) 1999. 328 pp.

I would characterize Nevzat Soguk as either a neo-liberal operating in the guise of a postmodern deconstructionist, or a post-modern deconstructionist operating in the guise of a neoliberal. This is not a trivial distinction, nor an attempt to play semantic games, but my attempt to classify a brilliant theorist (known for his work in political science) whose book has a great deal of merit—but whose writing at times seems aimed more at discursive analysis …

Law, Self-Pollution, And The Management Of Social Anxiety, Geoffrey P. Miller Jan 2001

Law, Self-Pollution, And The Management Of Social Anxiety, Geoffrey P. Miller

Michigan Journal of Gender & Law

This article considers the anxieties about masturbation and spermatorrhoea from the standpoint of cultural-legal analysis. Seen from this perspective, the worries about masturbation provided an object onto which social anxieties could be displaced and thereby managed. Norm entrepreneurs who played on public fears manipulated basic cultural polarities in order to present masturbation and spermatorrhoea as objects of horror and disgust-things that needed to be expelled, if possible, from the body social.

The South Won't Rise Again But It's Time To Study The Defunct Confederacy's Constitution, Ralph Michael Stein Jan 2001

The South Won't Rise Again But It's Time To Study The Defunct Confederacy's Constitution, Ralph Michael Stein

Elisabeth Haub School of Law Faculty Publications

The premise of this essay is not to espouse that the Southern ideological and constitutional theorists were correct. I propose, however, that an understanding of the historical basis of constitutional law, and a recognition of evolving doctrinal issues of Federalism, will enhance law school curriculum. Presentation of these topics dictates the introduction of the Confederate Constitution into the curriculum of required courses and electives. This effort, I propose, would be a prudent step, to be amply repaid in terms of higher understanding and scholarly benefit.

"In Passion And In Hope:" The Pilgrimage Of An American Radical, Martha Dodd Stern And Family, 1933--1990, John Francis Fox Jr. Jan 2001

"In Passion And In Hope:" The Pilgrimage Of An American Radical, Martha Dodd Stern And Family, 1933--1990, John Francis Fox Jr.

Doctoral Dissertations

This dissertation explores the literary/political pilgrimage of Martha Dodd Stern (1908--1990), an unusually promising writer. Using Martha's writings, government intelligence files like the Venona Transcripts, I develop a narrative and analytic family biography to analyze the faith of this leftist and develop a typology of the fellow traveler that shows its roots in the Progressive Era and their radicalization under the Great Depression and growth of fascism.

Martha's father, historian William E. Dodd (1869 to 1940), imparted to Martha his Wilsonian progressivism and resentment of social distinctions. Martha's experience in Nazi Germany (1933 to 1937) radicalized these roots. She placed …

Juggling With Three Identities: Ideology Of Yugoslavism Among The American Serbs (1900--1993), Vladimir B. Pistalo

Doctoral Dissertations

During the late 19th century and throughout the 20 th century, three waves of Serbian immigrants left the constant political flux of the Balkans to arrive in a constantly changing America. This dissertation examines how the political changes in the mother country and in the United States influenced the self-identification of each wave of immigrants as Serbs, Yugoslavs and Americans. I draw upon oral histories of Serbian-American intellectuals, Serbian language newspapers in the United States, immigrant memoirs and literature, and secondary sources in both Serbian and English to document the construction and reconstruction of Serbian, Yugoslav and American identity.

Preface, Tom Farer Jan 2001

Preface, Tom Farer

Human Rights & Human Welfare

A quarter century ago, when I was elected to the Inter-American Commission on Human Rights, the human rights institutional landscape had the appearance and analogical character of a largely undeveloped sub-division on the metropolitan fringe. In large part, the land was not even platted. Here and there a few structures poked out of the muddy soil. One, the Human Rights Commission of the United Nations, had the look of a community hall built with little hope and less conviction by largely disinterested city fathers obligated to intimate belief in the sub-division’s arresting features and future. Among public buildings, only the …

Universality By Consensus: The Evolution Of Universality In The Drafting Of The Udhr, Amy Eckert Jan 2001

Universality By Consensus: The Evolution Of Universality In The Drafting Of The Udhr, Amy Eckert

Human Rights & Human Welfare

A review of The Universal Declaration of Human Rights: Drafting, Origins & Intent by Johannes Morsink. Philadelphia: University of Pennsylvania Press (Pennsylvania Studies in Human Rights), 2000. 400pp.

The Universal Declaration of Human Rights (UDHR) has helped to define human rights standards and bring them to the forefront of global concern. Yet the UDHR continues to suffer from charges of cultural imperialism. While many scholars have answered these charges with philosophical justification for universal human rights, Johannes Morsink takes another approach to the question of cultural relativism in The Universal Declaration of Human Rights: Origins, Drafting & Intent.

Purchasing While Black: How Courts Condone Discrimination In The Marketplace, Matt Graves Jan 2001

Purchasing While Black: How Courts Condone Discrimination In The Marketplace, Matt Graves

Michigan Journal of Race and Law

Given the sweeping language of § 1981 and 1982, it cannot be that sellers of goods can engage in intentional discrimination, so long as they make relatively minor attempts to cover it up. By exploring the interaction between substantive law, procedural law, legal culture, and real-world context, Graves seeks to demonstrate that judges cannot offer any legal or practical justification for heightened pleading requirements in § 1981 and 1982 actions. Through this argument, a conclusion is reached that § 1981 and 1982 plaintiffs must be given the same opportunity to litigate their claims that virtually all other plaintiffs are given. …

Petroleum Tanker Shipping On German Inland Waterways, 1887-1994, Ingo Heidbrink Jan 2001

Petroleum Tanker Shipping On German Inland Waterways, 1887-1994, Ingo Heidbrink

History Faculty Publications

Tanker shipping today is one of the major branches of German inland navigation. Indeed, the transport of petroleum and its derivatives together comprise nearly twenty percent of total inland shipping; more than 42,000,000 tons of liquid petroleum products were shipped in 1996 by a fleet with a total cargo capacity of more than 500,000 tons.' Tanker shipping is by far the largest kind of specialist transportation on German inland waterways. But because of its very special technical requirements, a high degree of dependence on a small group of shippers, and a number of risks peculiar to this trade, there are …

Book Review, David S. Tanenhaus Jan 2001

Book Review, David S. Tanenhaus

Scholarly Works

This ambitious book impressively chronicles forms of imprisonment in American history from Columbus’s crossing in 1492, with at least four convicts among his crew, to the rise of five hundred years later of a “prison-industrial complex,” which employs over half a million people and incarcerates more than one million others. According to Christianson, a former investigative reporter and gubernatorial aide who is now contributing editor of The Criminal Law Bulletin, director of the New York Death Penalty Documentation Project, and chairman of the Board of the Safer Society Foundation, With Liberty for Some “is a history of how we …

Rocky Mountain National Park: History And Meanings As Constraints To African-American Park Visitation., Elizabeth B. Erickson

Graduate Theses, Dissertations, and Problem Reports (ETD)

The purpose of this study is to examine history and park meanings as constraints to visitation to Rocky Mountain National Park (RMNP) by the African-American community. Thirty-six one-hour interviews were conducted in Denver, Colorado with African-American participants who resided in the city. In addition eleven, fifteen-minute interviews were conducted with African-Americans while visiting Rocky Mountain National Park. Over the course of the interviews, participants discussed their current and past relationship with Rocky Mountain National Park, the meanings they ascribed to the park, and their perceived constraints to park visitation. Snowball sampling was used, the data was transcribed verbatim, and content …

The Icc’S Jurisdiction Over The Nationals Of Non-Party States: A Critique Of The U.S. Position, Michael P. Scharf Jan 2001

The Icc’S Jurisdiction Over The Nationals Of Non-Party States: A Critique Of The U.S. Position, Michael P. Scharf

Law and Contemporary Problems

Scharf analyzes the validity of the US argument against the International Criminal Court's jurisdiction over the national of non-party states in the context of historic precedent and the principles underlying international criminal jurisdiction, and demonstrates that it is not the jurisdiction of the ICC over the nationals of nonparty states, but the US government's legal argument, which rests on shaky foundations. He also highlights the potential unintended repercussions of the current US legal position.

Introduction, Sulochana R. Asirvatham, Corinne Ondine Pache, John Watrous

Classical Studies Faculty Research

This book gathers essays that are all, in one way or another, connected with ancient Greek and Roman religions. The essays cover a wide range—both chronological and geographical—of religious discourse and practice from Classical Athens on to seventeenth-century America via medieval Europe. Thus, there is no attempt at comprehensiveness. Rather, we hope that these essays will serve to problematize some common distinctions that readers generally bring to the study of ancient Greek and Roman religion and its legacy—such as the distinctions between Greece and Rome, Greco-Romans and barbarians, pagans and Christians, religion and politics, and religion and magic, to name …

Hard Water: Politics And Water Supply In Milwaukee, 1870-1995, Kate Foss-Mollan Jan 2001

Hard Water: Politics And Water Supply In Milwaukee, 1870-1995, Kate Foss-Mollan

Purdue University Press Books

Hard Water: Politics And Water Supply In Milwaukee, 1870-1995 by educator and urban studies specialist Kate Foss-Mollan is the documented and historical account of the water supply of Milwaukee, Wisconsin. Foss-Mollan blends urban history, technology, biology, research, and political science into a remarkably intriguing and informative saga. From conflicts over supplying poor neighborhoods to partisan debates regarding the necessity of a filtration plant, Hard Water spans over a century with an eye-opening account of the wrangling, machinations, and more all about a seemingly simple drink of water. Very highly recommended for American urban studies reading lists.
