"Just Like One Of The Family": Domestic Violence Paradigms And Combating On-The-Job Violence Against Household Workers In The United States, Kristi L. Graunke
Michigan Journal of Gender & Law
This Article argues that the immense problem of on-the-job abuse experienced by domestic workers demands a multifaceted plan of attack. The proposed responses specifically draw upon the capacities, strengths, and resources of women, particularly comparatively privileged women, as both activists and employers of domestic workers. By describing the circumstances of domestic work in the United States from the nation's inception to the present, Part I demonstrates the prevalence and intractability of on-the-job physical and sexual abuse and argues that other women, as employers of domestic workers, have historically played a complex role in participating in, condoning, or failing to acknowledge …
Nature And Identity In The Creation Of Franconia Notch: Conservation, Tourism, And Women's Clubs, Kimberly Ann Jarvis
Nature And Identity In The Creation Of Franconia Notch: Conservation, Tourism, And Women's Clubs, Kimberly Ann Jarvis
Doctoral Dissertations
This dissertation analyzes the significance of the successful 1923--1928 conservation campaign that created a state park and war memorial in Franconia Notch in New Hampshire's White Mountains. The Franconia Notch campaign utilized a century's worth of artistic and literary interpretations that created Romantic images of the natural beauties of the White Mountains and Franconia Notch which, together with the ideas of the Progressive Era conservation movement and the cooperative efforts of the state of New Hampshire, the Society for the Protection of New Hampshire Forests, and the New Hampshire Federation of Women's Clubs, resulted in a combination of circumstances that …

Gendered Work: Women's Paid Labor In Barre, Vermont And Trinidad, Colorado, 1880--1918, Susan L. Richards
Doctoral Dissertations
Between 1880 and 1918, thousands of women in Barre, Vermont and Trinidad, Colorado entered the paid labor force. They worked as boardinghouse keepers, domestic servants, waitresses, laundresses, prostitutes, office workers, saleswomen, telephone operators, business owners, teachers, nurses, doctors, lawyers, artists, musicians, and midwives. By compiling and manuscript census records for 1880, 1900, and 1910, and city directories for the period 1880 to 1918, this study identified 3,634 working women in Barre and 3,886 working women in Trinidad. Cross-checking these names against probate, city, and county court records, marriage and death records, newspapers, local manuscript collections, and oral histories, stories of …

Ec02-174 Leafy Spurge, Robert A. Masters, Brady F. Kappler
University of Nebraska-Lincoln Extension: Historical Materials
Leafy spurge is an invasive weed that infests over three million acres in the northern Great Plains and the prairie provinces of Canada. It is commonly found in rangelands, pastures, roadsides, rights-of-way, and woodlands. Leafy spurge can reduce rangeland and pasture carrying capacity by as much as 75 percent because it competes with forages and cattle avoid grazing areas infested with this weed. In North Dakota where leafy spurge infests about 900,000 acres, estimates of direct and indirect losses exceed $100 million each year. In Nebraska, the direct loss in forage value attributed to leafy spurge has been estimated at …
The Canon Has A History, Richard A. Primus
The Canon Has A History, Richard A. Primus
Reviews
Legal Canons, edited by J. M. Balkin and Sanford Levinson, is a collection of fourteen essays on subjects related to canonicity in law and legal education. Balkin and Levinson have two principal aims. One is to expand the category of things that can be canonical: not just texts, they say, but also arguments, problems, narrative frameworks, and examples invoked in conversation or teaching. In their view, what makes something canonical is its ability to reproduce itself in the minds of successive generations.' If generation after generation of legal academics argues about the countermajoritarian difficulty, then the countermajoritarian difficulty is a …

This paper explores the theoretical history of developmental psycholinguistics from the publication of Noam Chomsky's Aspects of the Theory of Syntax, in 1965 to the present work of Steven Pinker with special attention paid to Roger Brown, Dan Slobin, Michelle Bowerman, Richard Cromer, and the research team, David Rummelhart and James McClelland. It begins with the psychological theories of language development of Jean Piaget and B.F. Skinner concluding with the Words and Rules Theory of Steven Pinker.

Part II of this Article therefore reviews the history of Native Hawaiians in the broader context of the history of federal Indian law, focusing on the vacillating congressional policies regarding Indians and how those policies almost always treated Indian tribes as political entities rather than ethnic communities. Part III reviews and analyzes the procedural history of the Rice case and its resolution by the Supreme Court. Part IV concludes with the argument that constitutionally-permissible alternative methodologies exist for accomplishing the same objective of self-determination for Native Hawaiians
From Sin To Sickness: A Sociological History Of The Problem Gambler, Bo Jason Bernhard
From Sin To Sickness: A Sociological History Of The Problem Gambler, Bo Jason Bernhard
UNLV Retrospective Theses & Dissertations
Long before medical and psychological experts determined that problem gambling qualified as a mental illness, moral experts determined that this problem could be "diagnosed" as a sin. This research examines pre-1915 gambling literature to determine the ways in which people who gambled too much were identified, named, and "treated" socially. Interestingly, virtually all of our current diagnostic criteria were identified by moral thinkers hundreds of years ago. Implications for the sociological history of problem gambling, the sociology of mental illness, and the sociology of religion and morality are discussed.

The Role Of Buddhism In The Changing Life Of Rural Women In Sri Lanka Since Independence, Lalani Weddikkara
The Role Of Buddhism In The Changing Life Of Rural Women In Sri Lanka Since Independence, Lalani Weddikkara
Theses: Doctorates and Masters
This research focuses on the role of Buddhism in the changing lives of rural women in Sri Lanka since Independence from the British in 1948 up to the present time. In this thesis I pose two questions: firstly, how important is Buddhism in the everyday lives of rural women and secondly, what impact has changes in Buddhism since Independence had upon laywomen and renunciants. I have chosen the rural village Athale, in the dry zone of southeast Sri Lanka as my area of investigation. The history of the village dates back to the times of the great hero King Dutugemunu …

Dial-In Testimony, Richard D. Friedman, Bridget Mary Mccormack
Articles
For several hundred years, one of the great glories of the common law system of criminal justice has been the requirement that prosecution witnesses give their testimony in the presence of the accused" face to face," in the time-honored phrase-under oath, subject to cross-examination, and, unless unfeasible, in open court. In the United States, this principle is enshrined in the Confrontation Clause of the Sixth Amendment, which provides that "[i]n all criminal prosecutions, the accused shall enjoy the right ... to be confronted with the witnesses against him." But now a new way is developing for witnesses for the prosecution …
A Control-Based Approach To Shareholder Liability For Corporate Torts, Nina A. Mendelson
A Control-Based Approach To Shareholder Liability For Corporate Torts, Nina A. Mendelson
Articles
Some commentators defend limited shareholder liability for torts and statutory violations as efficient, even though it encourages corporations to overinvest in and to externalize the costs of risky activity. Others propose pro rata unlimited shareholder liability for corporate torts. Both approaches, however, fail to account fully for qualitative differences among shareholders. Controlling shareholders, in particular, may have lower information costs, greater influence over managerial decisionmaking, and greater ability to benefit from corporate activity. This Article develops a control-based approach to shareholder liability. It first explores several differences among shareholders. For example, a controlling shareholder can more easily curb managerial risk …

Book Of Mormon Stories Diglot Reader On Computer, Neal S. Harmon
Theses and Dissertations
This report describes the design, development, and evaluation of a computer-based diglot reader of the Book of Mormon Stories of the Church of Jesus Christ of Latter-day Saints. Di means two and glot means language, thus a diglot reader combines two languages into one reader in order to teach a person to read in a new language. The program, which runs on both Macintosh and Windows computer platforms, contains fifteen chapters of the Book of Mormon Stories and introduces about four hundred Spanish words. This report includes a literature review on the diglot method and related materials, a description of …
Haunting And Hunting: Bodily Resurrection And The Occupation Of History In Thomas Pynchon's Mason & Dixon, Justin Scott Coe
Haunting And Hunting: Bodily Resurrection And The Occupation Of History In Thomas Pynchon's Mason & Dixon, Justin Scott Coe
Reconstruction: Studies in Contemporary Culture
[First paragraph]
Just before publication of Mason & Dixon, Thomas Pynchon wrote a review of Gabriel Garcia Marquez's Love in the Time of Cholera, in which he says that to assert the resurrection of the body [is] today as throughout history an unavoidably revolutionary idea (Heart's Eternal Vow). That this revolutionary idea is essentially a religious one is a fact that many Pynchon critics attempt to placate by identifying in his works a secularization of religious themes. Robert Hipkiss identifies, in place of religion, a search for an operative spiritual force in Pynchon's previous novels, which he assures us is …

...A Rendezvous With Kreplach: Putting The New Deal Court In Context, Richard D. Friedman
Reviews
The Supreme Court of the New Deal era continues to captivate lawyers and historians. Constitutional jurisprudence changed rapidly during the period. Moreover, some of the most significant changes seemed--whatever the reality--to result from pressure imposed in 1937 by President Franklin Roosevelt's plan to pack the Court. The structure of constitutional law that emerged within a few years of Roosevelt's death remains intact in significant respects today.

The Promise Of A Post-Genocide Constitution: Healing Rwandan Spirit Injuries, Adrien Katherine Wing, Mark Richard Johnson
Michigan Journal of Race and Law
This Article hopes to extend Critical Race Theory's social construction of race theory by emphasizing ethnicity as well as race. The Rwandans are undoubtedly within the so-called "Black race." Historically, they have also been socially constructed as consisting of different races and ethnicities, even though many scholars and Rwandans do not see ethnic, much less racial, distinctions. Some of these Rwandans who did see such differences participated in the genocide.

American Prophet, New England Town: The Memory Of Joseph Smith In Vermont, Keith A. Erekson
Theses and Dissertations
In December 1905, a large granite monument was erected at the birthplace of Joseph Smith on the one hundredth anniversary of his birth. This thesis relates the history of the Joseph Smith Memorial Monument from its origins through its construction and dedication. It also explores its impact on the memory of Joseph Smith in the local, Vermont, and national context. I argue that the history of the Joseph Smith Memorial Monument in Vermont is the story of the formation and validation of the memory of Joseph Smith as an American Prophet.

A History Of The Concepts Of Zion And New Jerusalem In America From Early Colonialism To 1835 With A Comparison To The Teachings Of The Prophet Joseph Smith, Ryan S. Gardner
Theses and Dissertations
This thesis discusses the role that the idea of Zion has played in the first three centuries of American religion. Millenarian themes, such as building New Jerusalem, were common religious themes in seventeenth- to nineteenth-century America. Understanding the doctrine of The Church of Jesus Christ of Latter-day Saints regarding this vital subject will be helpful for historians, scholars, and teachers.
When the Puritan colonists came to the New World in the early seventeenth century, they sought not only a land of religious liberty, but also a land of ultimate religious achievement: the establishment of Zion and/or New Jerusalem. Many of …

Transforming Defense An Era Of Peace And Prosperity, Conrad C. Crane Dr.
Books, Monographs & Collaborative Studies
The ideas and issues presented in this collection of papers from the Twelfth Annual Strategy Conference conducted by the U.S. Army War College in April 2001 will educate and inform anyone interested in the past and future course of American defense reform. Though conference attendees had many differing opinions about the barriers to defense transformation and how to overcome them, a broad consensus formed that some change is essential to meet future security requirements. They observed at the time that it is ironic that the peace which creates the prosperity and wealth to fund transformation and permits a window of …
