"Airbrushed Out Of The Constitutional Canon": The Evolving Understanding Of Giles V. Harris, 1903-1925, Samuel Brenner Mar 2009

"Airbrushed Out Of The Constitutional Canon": The Evolving Understanding Of Giles V. Harris, 1903-1925, Samuel Brenner

Michigan Law Review

Richard H. Pildes argued in an influential 2000 article that the U.S. Supreme Court's opinion in Giles v. Harris, which was written by Justice Oliver Wendell Holmes, was the "one decisive turning point" in the history of "American (anti)-democracy." In Giles, Holmes rejected on questionable grounds Jackson W. Giles's challenge to the new Alabama Constitution of 1901-a document which was designed to disfranchise and had the effect of disfranchising African Americans. The decision thus contributed significantly to the development of the all-white electorate in the South, and the concomitant marginalization of southern African Americans. According to Pildes, however, the …

A Critical Guide To The Iraqi High Tribunal's Anfal Judgement: Genocide Against The Kurds, Jennifer Trahan Jan 2009

A Critical Guide To The Iraqi High Tribunal's Anfal Judgement: Genocide Against The Kurds, Jennifer Trahan

Michigan Journal of International Law

In the Anfal trial, the Iraqi High Tribunal (IHT or the Tribunal) in Baghdad convicted former Iraqi high officials of genocide, crimes against humanity, and war crimes. Unlike its predecessor-the Dujail trial-the Anfal trial included the presentation of a high volume of documentary and eye-witness evidence. This evidence clearly revealed the existence of a genocidal campaign by the former Iraqi government and military that eliminated an estimated 182,000 Iraqi Kurds in 1988, as part of the eight-phased "Anfal campaign" (the Anfal). Relying on this and other evidence, judges in the Anfal Trial Chamber explained fairly persuasively how genocide, crimes against …

Whatever Happened To Anarchism?: Renaissance And Adaptation In Postwar America, Ryan Thompson Jan 2009

Whatever Happened To Anarchism?: Renaissance And Adaptation In Postwar America, Ryan Thompson

Theses & ETDs

This project is a multidisciplinary study of anarchism in the postwar United States.Though anarchism--the philosophy of a new social order based on liberty unrestricted by man-made law--had been declared obsolete in America in thought and movement by 1940 it would reemerge by the early 1960s. Anarchisms classical period--the late nineteenth and early twentieth centuries--came with industrialization and modernity. Postwar anarchism evolved to another structural context: wealth, integration, centralization. The recovery of anarchism through historicization was contemporaneous with the renaissance. Paul Avrich was the exemplary chronicler of American anarchism. His research salvaged anarchism from distortion. The reassembly and continuity of anarchism …

Review Of Trial Of Modernity: Judicial Reform In Early Twentieth Century China, 1901-37, By Xiaoqun Xu, Nicholas C. Howson Jan 2009

Review Of Trial Of Modernity: Judicial Reform In Early Twentieth Century China, 1901-37, By Xiaoqun Xu, Nicholas C. Howson

Reviews

Observing these significant legal-political debates in the Chinese press and academy in the first decade of the twenty-first century, we might think they concern battles started only in the last decade and a half of Reform-era China. Now Professor Xu Xiaoqun reminds us that these struggles have a much longer pedigree, stretching back to the end of the nineteenth century and China's first fraught encounter with "the West" and one idea of "modernity."

The Taxpayer As Reformer: 'Pocketbook Politics' And The Law, 1860--1940, Linda Upham-Bornstein

Doctoral Dissertations

Taxes and the citizens' tax burden have always been at the hub of American politics. This dissertation opens up consideration of taxpayers as political and legal actors, who saw paying taxes as a source of political legitimacy and empowerment. It examines the powerful connection between organized taxpayer activity, political reform, and the law.

Organized taxpayers have relied heavily on the law in general, and on taxpayers' lawsuits in particular, to promote their interests and political reform. During the last half of the nineteenth century courts, and legislatures throughout the nation came to recognize the right of taxpayers to bring suit …

Outside The Circle: The Juxtaposition Of Powwow Imagery And Cherokee Historical Representation, Dana Brumley Jan 2009

Outside The Circle: The Juxtaposition Of Powwow Imagery And Cherokee Historical Representation, Dana Brumley

Electronic Theses and Dissertations

This thesis looks at the juxtaposition presented by the Eastern Cherokee's struggle to present an accurate historical representation of 'Cherokee' against the backdrop of the more lucrative 'Tourist-ready Indian', influenced by powwow imagery. The thesis gives a brief history of the contemporary powwow, discusses the debates surrounding its intrinsic value to American Indians as historically representative, and then examines the shared elements of Cherokee and powwow history. There is an analysis of the influence of powwow imagery on notions of Cherokee history and its correlation to the expectations of visitors to the Cherokee Reservation. Thus, the author argues that the …

Vibia Perpetua's Diary: A Women's Writing In A Roman Text Of Its Own, Melissa Perez Jan 2009

Vibia Perpetua's Diary: A Women's Writing In A Roman Text Of Its Own, Melissa Perez

Electronic Theses and Dissertations

Writing the history of women in antiquity is hindered by the lack of written sources by them. It has been the norm to assume that the only sources that can tell us something about them are the sources written by men. This thesis challenges this convention as it concerns the social history of Rome through the exploration of a written source by a woman named Vibia Perpetua. She was a Roman woman of twenty-two years from Roman Carthage, who was martyred on March 7, 203 C.E. The reason that we know of this Roman woman and what happened to her …
