Family History: Inside And Out, Kerry Abrams
Family History: Inside And Out, Kerry Abrams
Michigan Law Review
The twenty-first century has seen the dawn of a new era of the family, an era that has its roots in the twentieth. Many of the social and scientific phenomena of our time - same-sex couples, in vitro fertilization, single-parent families, international adoption - have inspired changes in the law. Legal change has encompassed both constitutional doctrine and statutory innovations, from landmark Supreme Court decisions articulating a right to procreate (or not), a liberty interest in the care, custody, and control of one's children, and even a right to marry, to state no-fault divorce statutes that have fundamentally changed the …

Rusticus: Notes On Class And Culture In Rural New Hampshire, Donald Hall
New England Journal of Public Policy
Old New Hampshire Highway Number Four was incorporated by an act of the New Hampshire legislature in the autumn of 1800. It wound out of Portsmouth, a seaport that once rivaled Boston, drove west through Concord, north past Penacook, through Boscawen, Salisbury, Andover, and Wilmot on its way to Lebanon and the Connecticut River. These names string history like beads. The Penacook tribe assembled each year on the banks of the Merrimack at the site of the present town that bears their name. I grew up thinking Boscawen an unusual Indian name; it is Cornish, surname of an admiral victorious …

Dr. Robert L. Bennett: Pioneer And Definer Of Modern Physiatry., John F. Ditunno, Jr, Richard E. Verville
Department of Rehabilitation Medicine Faculty Papers
Few physiatrists today would appreciate Dr. Robert L. Bennett’s contributions to our specialty, since he most commonly was associated with poliomyelitis, a cured disease for over a half century. Less are aware of the pioneering fusion of physical medicine in 1941 by Krusen’s first resident with the independent living environment of the Georgia Warm Spring Foundation (GWSF) created by a USA president. Bennett recognized polio/GWSF as the workshop and laboratory for showcasing the new specialty of Physical Medicine and Rehabilitation (PMR). He taught us that accurate muscle testing determined the plan of muscle reeducation, which led to functional training with …

The Practical Theology Of The General Rules, Andrew C. Thompson
The Practical Theology Of The General Rules, Andrew C. Thompson
The Asbury Journal
The “General Rules of the United Societies” were a central component of the early Methodist movement under John Wesley’s leadership. Examinations of the General Rules in contemporary literature tend to focus on their role in personal and organizational discipline for early Methodists and for the movement as a whole. Yet a close examination of the rules shows that they served a greater purpose: as the practical theological articulation of how Methodists could expect to experience sanctification in the context of their lives. This crucial aspect of the General Rules’ use can be seen by exploring Wesley’s understanding of the means …
A Great Invisible Crashing: The Rise And Fall Of Patent Eligibility Through Mayo V. Prometheus, Scott Pierce
A Great Invisible Crashing: The Rise And Fall Of Patent Eligibility Through Mayo V. Prometheus, Scott Pierce
Fordham Intellectual Property, Media and Entertainment Law Journal
Title 35 of the United States Code at Section 101 states that “[w]hoever invents or discovers any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof, may obtain a patent therefor, subject to the conditions and requirements of this title.” Despite the apparent simplicity of the statute and its predecessors, the boundaries of patent eligibility dictated by the term “process” and the term “art” that it replaced, along with the terms “machine,” “manufacture” and “composition of matter,” have become increasingly uncertain over the course of the last two-hundred years. Recently, the lack …

Kennesaw State University: The First Fifty Years, 1963-2013, Thomas A. Scott
KSU Press Legacy Project
In fifty short years, Kennesaw had far exceeded the expectations of its founders. Decade after decade, the dreams of campus visionaries reached fruition and became the foundation stones for the plans of new generations of builders. The first eight yellow-brick structures still stood in 2012, but not one retained its original name or function.
Kennesaw was blessed throughout its history with visionary leadership, an excellent faculty and staff, and a foundation of extraordinarily talented individuals who donated their time, creativity, and financial resources to the betterment of the university. Kennesaw was always blessed with outstanding students and alumni. Like many …

Department of Surgery Gibbon Society Historical Profiles
In the early 20th century, an established surgical specialty catering to pediatric surgery did not exist, and pediatric surgical ailments were operated on by general surgeons. With his devotion to childhood diseases and his unique thinking in surgical development, William E. Ladd would become a leading figure in America by pioneering the field of pediatric surgery.

An Incomplete Revolution: Feminists And The Legacy Of Marital-Property Reform, Mary Ziegler
An Incomplete Revolution: Feminists And The Legacy Of Marital-Property Reform, Mary Ziegler
Michigan Journal of Gender & Law
As this Article shows, the conventional historical narrative of the divorce revolution is not so much incorrect as incomplete. Histories of the divorce revolution have focused disproportionately on the introduction of no-fault rules and have correctly concluded that women's groups did not play a central role in the introduction of such laws. However, work on divorce law has not adequately addressed the history of marital-property reform or engaged with scholarship on the struggle for the Equal Rights Amendment to the federal Constitution. Putting these two bodies of work in dialogue with one another, the Article provides the first comprehensive history …

The Role Of Networks, Mentors, And The Law In Overcoming Barriers To Organizational Leadership For Women With Children, Terry Morehead Dworkin, Aarti Ramaswami, Cindy A. Schipani
Michigan Journal of Gender & Law
The 2012 election brought headlines such as "Another 'Year of Women' in Congress." Although the number of women in the highest legislative offices increased, their numbers are still significantly lower than those of men. Fewer than 100 women hold office in both houses of Congress. Corporate America similarly reflects significantly low female leadership numbers. For example, "fewer than 20% of finance industry directors and executives are women, and [there are] no women leading the 20 biggest U.S. banks and securities firms." Women make up nearly half the workforce and hold 60% of bachelor degrees, yet they hold only 14% of …
Historical And Modern Conceptualization Of Adhd: A Neurobiological Perspective, Nikolas Santamaria
Historical And Modern Conceptualization Of Adhd: A Neurobiological Perspective, Nikolas Santamaria
Theses & ETDs
This paper seeks not only to analyze the current neurobiological concepts of attention deficit disorder, but to examine the disorder from a historical perspective and to study its development. The historical review begins with Hippocrates and studies its evolution of the disorder throughout the 20th century, including early neurobiological theories such as minimal brain damage/dysfunction and the catecholamine hypothesis. Through studying the history, it seems that some but not all of the behavioral disorders observed could have been fact attention deficit disorder. Due to the complexity and diversity of the symptoms of attention deficit disorder, symptoms closer to the genetic …
Ed Cooper, Rule 56, And Charles E. Clark's Fountain Of Youth, Steven S. Gensler
Ed Cooper, Rule 56, And Charles E. Clark's Fountain Of Youth, Steven S. Gensler
University of Michigan Journal of Law Reform
Nobody had a greater impact on the formulation of the original Civil Rules than Clark. His role as both the principal architect2 and the principal draftsman3 of the Civil Rules is well known. As Professor Wright once put it, although the Civil Rules were a joint effort, "the end product bears the unmistakable Clark stamp."4 But Clark started shaping the Civil Rules even before drafting began.5 Initially, Chief Justice Hughes thought the civil rules project should be limited to creating rules for actions at law (leaving in place-and separate-the existing equity rules).6 A passionate advocate for merging law and equity …

Disability History: Humanity Worth Defending, Darren W. Minarik, Timothy Lintner
Faculty Publications
The authors consider the potential impact of teaching disability history and awareness in social studies classrooms. Social studies educators are encouraged to use disability history to move the concept of disability beyond Individualized Education Program (IEP) labels and medical pathology, allowing students to study and better understand the evolving social and cultural context of disability. An examination of disability “models” and the historical evolution of disability language is followed by strategies and resources for incorporating disability history and awareness in the social studies classroom. Ohio social studies educators are encouraged to support a Disability History and Awareness week or month …
