Death And Disengagement: A Critical Analysis Of The International Community's Intervention Effort In Darfur, Victor Hodges Jan 2010

Death And Disengagement: A Critical Analysis Of The International Community's Intervention Effort In Darfur, Victor Hodges

Electronic Theses and Dissertations

This thesis seeks to analyze the international community's conflict management capabilities through its response to the Darfur crisis. Primarily, it aims to show through the lens of the Darfur crisis, which is widely accepted as the first genocide of the twenty-first century, that the international community has yet to develop a framework to collectively intervene in and resolve crimes against humanity. Additionally, this thesis will show the international community's recognition of their shortcomings through the gradual transformation of policies undertaken by several of its leading entities in response to the crisis. The research will pinpoint several major factors behind the …

Populist Retribution And International Competition In Financial Services Regulation, Adam C. Pritchard Jan 2010

Populist Retribution And International Competition In Financial Services Regulation, Adam C. Pritchard

Articles

The pattern of regulatory reform in financial services regulation follows a predictable pattern in democratic states. A hyperactive market generates a bubble, the bubble deflates, and much financial pain ensues for those individuals who bought at the top of the market. The financial mess brings the scrutiny of politicians, who vow "Never again!" A political battle ensues, with representatives of the financial services industry fighting a rearguard action to preserve its prerogatives amidst cries for the bankers' scalps. Regulations, carefully crafted to win the last war, are promulgated. Memories fade of the foolish enthusiasm that fed the last bubble. Slowly, …

Regulating Segregation: The Contribution Of The Aba Criminal Justice Standards On The Treatment Of Prisoners, Margo Schlanger Jan 2010

Regulating Segregation: The Contribution Of The Aba Criminal Justice Standards On The Treatment Of Prisoners, Margo Schlanger

Articles

Over recent decades, solitary confinement for prisoners has increased in prevalence and in salience. Whether given the label "disciplinary segregation," "administrative segregation," "special housing," "seg," "the hole," "supermax," or any of a dozen or more names, the conditions of solitary confinement share basic features: twenty-three hours per day or more spent alone in a cell, with little to do and no one to talk to, and one hour per day or less in a different, but no less isolated, setting-an exercise cage or a space with a shower. Long-term segregation units operated along these lines are extraordinarily expensive to build …

Wartime Prejudice Against Persons Of Italian Descent: Does The Civil Liberties Act Of 1988 Violate Equal Protection?, Joseph C. Mauro Jan 2010

Wartime Prejudice Against Persons Of Italian Descent: Does The Civil Liberties Act Of 1988 Violate Equal Protection?, Joseph C. Mauro

Michigan Journal of Race and Law

Most people know that the United States interned persons of Japanese descent during World War II. Few people know, however, that the government interned persons of German and Italian descent as well. In fact, the internment was part of a larger national security program, in which the government classified non-citizens of all three ethnicities as "enemy aliens" and subjected then to numerous restrictions, including arrest, internment, expulsion from certain areas, curfews, identification cards, loss of employment, and restrictions on travel and property. Four decades after the war, Congress decided to compensate persons of Japanese descent who had been "deprived of …

The History Of The Emergence Of The Seventh-Day Adventist Church In The State Of Manipur, India, Cornelius Kamei Jan 2010

The History Of The Emergence Of The Seventh-Day Adventist Church In The State Of Manipur, India, Cornelius Kamei

Doctor of Ministry Projects

Problem

The Seventh-day Adventist church emerged in the state of Manipur, India, through a lay-led church planting movement. Currently, no written account exists of the early history of this work in Manipur. Today, the work in Manipur is clergy-dependent and growth in this region has stagnated. In order for the work to move forward successfully, there is a need to remember the early history of the work in this region.

Method

In the absence of earlier written works on the rise of Adventism in Manipur, oral sources were relied upon as primary sources for accuracy. The sources were gathered through …

Public Policymaking In Ireland: The Case Of The Indigenous Interactive Media Industry, 1994-2004, Colm Murphy Jan 2010

Public Policymaking In Ireland: The Case Of The Indigenous Interactive Media Industry, 1994-2004, Colm Murphy

Doctoral

Ireland’s economic rollercoaster, going from one of western Europe’s poorest countries to one of its wealthiest during the late 1990s and early 2000s, to being bailed-out in 2010 by the EU and IMF, has attracted much international attention. But beneath this story of bust to boom to bust lies an interesting case study of how a small peripheral state attempted to develop an indigenous internationally competitive sector. This study argues that over the
period the state refined its ‘strategic future grabbing’ policymaking process. This flexible, fast reacting, non-bureaucratic policymaking system was informed by the small agile state’s American-leaning intelligence gathering …

The Exclusionary Rule Redux - Again, Lloyd L. Weinreb Jan 2010

The Exclusionary Rule Redux - Again, Lloyd L. Weinreb

Fordham Urban Law Journal

The exclusionary rule itself is not very complicated: if the police obtain evidence by means that violate a person’s rights under the Fourth Amendment, the evidence is not admissible against that person in a criminal trial. The basic provision, however, has been freighted with innumerable epicycles, and epicycles on epicycles ever since it was made part of Fourth Amendment jurisprudence. The exclusionary rule survives in a kind of doctrinal purgatory, neither accepted fully into the constitutional canon nor cast into the outer darkness. It survives, but its reach is uncertain, its rational questioned, and its value doubted. Hudson v. Michigan …

A History Of Moose Management In Utah, Michael L. Wolfe, Kent R. Hersey, David C. Stoner Jan 2010

A History Of Moose Management In Utah, Michael L. Wolfe, Kent R. Hersey, David C. Stoner

Wildland Resources Faculty Publications

During the first half of the 20th century a moose (Alces alces) population gradually established itself on the North Slope of Utah’s Uinta Mountains from founders in the Greater Yellowstone Ecosystem. Formal management of the species commenced with an aerial survey conducted in 1957, and the first legal hunt in 1958. From this small initial population moose have expanded into other areas of northern Utah and, augmented by transplants, the statewide population has increased to an estimated 3,200 animals as of 2009. In the northern portion of the state moose appear to prosper in riparian willow (Salix sp.) habitats as …

Impetuous Desire: A History Of Kettle Falls 1825-1860, Ryan W. Booth Jan 2010

Impetuous Desire: A History Of Kettle Falls 1825-1860, Ryan W. Booth

All Master's Theses

Kettle Falls has been the home to Natives, traders, missionaries and U.S. soldiers between 1825 and 1860. The middle ground created by these various groups first led to collaboration and eventually turned into collapse. The varied reasons for the downfall stem from problems of communication, commerce, cooperation and settlement among all four groups. The greatest hindrance was cultural miscommunication. Hudson Bay Company and the Society of Jesus (Jesuits) used old fashioned and outdated methods, which stemmed from their European roots, in their dealings with the tribes along the Columbia River. The Company and the Society could not keep pace with …

The Political Assassination Of Edmund Randolph: George Washington's Presidential Affair Of Honor, John C. Kotruch Jan 2010

The Political Assassination Of Edmund Randolph: George Washington's Presidential Affair Of Honor, John C. Kotruch

Master's Theses and Capstones

On 19 August 1795 George Washington ambushed Secretary of State Edmund Randolph in an impromptu tribunal to face the allegation of treasonous corruption in the service of France with evidence covertly provided by Great Britain.

A synthesis of the biographies of Washington and Randolph, histories of Jay's Treaty, the Whiskey Rebellion, the Battle of Fallen Timbers, and the diplomatic correspondence between Great Britain and the United States during the early republic reveals the motivations behind a British plot to manipulate the composition of the United States' government by implicating Randolph. The study dispels the myth that the intercepted French diplomatic …

The Development Of Modern Corporate Governance In China And India, Nicholas C. Howson, Vikramaditya S. Khanna Jan 2010

The Development Of Modern Corporate Governance In China And India, Nicholas C. Howson, Vikramaditya S. Khanna

Book Chapters

Corporate governance reform has become a topic of considerable debate both in the US and in many emerging markets. Indeed, the discussion is important because these reforms may have potentially long-standing effects upon the global allocation of capital, and in understanding the ways in which governance norms are communicated across markets and nations in an ever-globalizing world. In this chapter we examine the corporate governance reform efforts of the world's two biggest and fastest growing emerging markets, the People's Republic of China (PRC or China) and India. In the process we find that our understanding of how and why corporate …

Privilege And Property: Essays On The History Of Copyright, Ronan Deazley, Martin Kretschmer, Lionel Bently Jan 2010

Privilege And Property: Essays On The History Of Copyright, Ronan Deazley, Martin Kretschmer, Lionel Bently

Copyright, Fair Use, Scholarly Communication, etc.

Includes sixteen essays on the origins of copyright.

First paragraph:

What is Copyright History?

History has normative force. There was no history of colonialism, gender, fashion or crime until there were contemporary demands to explain and justify certain values. During much of the twentieth century, ‘copyright’ history (the history of legal, particularly proprietary, mechanisms for the regulation of the reproduction and distribution of cultural products – as opposed to the history of art, literature, music, or the history of publishers and art-sellers) was not thought of as a coherent, or even necessary field of inquiry. It was a pursuit of …

Last Man Standing: The American Who Stayed During The Rwandan Genocide - An Interview With Carl Wilkens, Jerri Shepard

Journal of Hate Studies

Carl Wilkens is a peace activist and an educator who headed up the Adventist Development and Relief Agency International in Rwanda (ADRA). He was the only American who chose to remain in Kigali, Rwanda during the genocide of 1994. His choice to remain in the country during that time of brutal atrocities resulted in the prevention of the murder of hundreds of children. Wilkens was featured in Frontline’s “Ghosts of Rwanda” and in “The Few Who Stayed: Defying Genocide,” an American Radio Works documentary broadcast on National Public Radio. He has received several humanitarian awards, including awards from Saint John’s …

Building Citizens Or Building Nations? Alternative Visions For Learning History In Germany And The United States: The Geschichtswettbewerb Des Bundespraesidenten And National History Day, 1974-1984, Crystal Johnson Jan 2010

Building Citizens Or Building Nations? Alternative Visions For Learning History In Germany And The United States: The Geschichtswettbewerb Des Bundespraesidenten And National History Day, 1974-1984, Crystal Johnson

Master's Theses

The German philanthropist Kurt Körber and the American historian David Van Tassel envisioned a future where students engaged in discovering the sources and interpreting the past for themselves rather than reciting facts filtered by a textbook or teacher. Their ideas developed into two strikingly similar programs: the Geschichtswettbewerb des Bundespräsidenten and National History Day. These endeavors became models for similar efforts in many other countries. This comparative history argues that such programs offer provocative insights into the civic nature and purpose of history education. Inquiry learning and enhanced access to sources gave students opportunities to ask their own questions of …

Aristocratic Revolution?, Kenneth. Posner Jan 2010

Aristocratic Revolution?, Kenneth. Posner

Electronic Theses and Dissertations 2010 - 2019

This thesis argues that in the wake of the Decembrist Revolt in Russia in 1825, the British Foreign Office was forced to address the tension between two conceptions of stability-one domestic and one international. It contends that the aristocratic ethos of the British diplomatic corps both magnified the fragile social condition of the Russian Empire and organized the political response which subordinated this concern to the international equilibrium of Europe. Ambassadors such as Lord Strangford and Edward Cromwell Disbrowe helped interpret the events of the Decembrist conspiracy while stationed in St. Petersburg and reported back to their Foreign Secretary, George …

Beethoven, Daniel. Padua Jan 2010

Beethoven, Daniel. Padua

Electronic Theses and Dissertations 2010 - 2019

Beethoven is widely considered to be one of the most influential composers of all time. His compositions denote a crucial turning point in the history of western music, and his influence can be discussed in numerous ways - musically, technically, theoretically and even philosophically. This treatise discusses one of the primary aspects of Beethoven's influence on later generations: the way that his symphonies contributed to the expansion of the genre and, consequently, to the development of the orchestra. Included is a detailed analysis of his nine symphonies, an overview of his personal life, and an exploration of the historical, social, …

Cooperation In The Midst Of Chaos, Harvey A. Schoonover Jan 2010

Cooperation In The Midst Of Chaos, Harvey A. Schoonover

Electronic Theses and Dissertations 2010 - 2019

Internal strife has plagued the South American country of Colombia for well over forty years. In an effort to combat the different subversive elements within its borders, the Government of Colombia developed an interagency counterinsurgency strategy that takes a whole-of-government approach. This approach takes many governmental functions and institutions and places them under one counterinsurgency "umbrella". The cornerstone of this interagency model is strong civil-military cooperation. What this research project seeks to accomplish is to first apply the Concordance Theory of Civil-Military Relations to Colombia's unique civil-military relationship. Secondly, this research project seeks to understand how the Colombian interagency counterinsurgency …

Documenting Cultural Transition Through Contact Archaeology In Tíhoo, Mérida, Yucatán, Rhianna C. Rogers

Electronic Theses and Dissertations 2010 - 2019

This dissertation is concerned with the role material culture played in transformation and/or retention of Maya authority, just prior to and after Spanish contact (A.D. 1100-1800s). The primary research data used to discuss this transition was derived from the author's analysis of precolumbian and colonial artifacts from the Ciudadela Structure (YUC 2) in Tíhoo/Mérida, Yucatán-an assemblage originally collected by John Goggin in 1956 and 1957 and currently housed at the University of Florida-Florida Museum of Natural History. As one of the last standing structures in the Maya site of Tíhoo, now buried beneath the Spanish capital city Mérida, the Ciudadela …

Effects Of Variables In Oral History, Lise M. Steinhauer Jan 2010

Effects Of Variables In Oral History, Lise M. Steinhauer

Electronic Theses and Dissertations 2010 - 2019

This study examines six oral history projects that were conducted over fifty years in Palm Beach County, Florida. The projects recorded the history of African American neighborhoods in Delray Beach and Boca Raton; individual lives in their place and times; the pioneer and Flagler eras in Palm Beach and West Palm Beach; and people, places, and events chosen by oral history students at Florida Atlantic University. As with oral histories generally, those studied inherently contain numerous variables concerning their (1) historical context, (2) format, and (3) participants, which clearly affect the outcome of recorded interviews and their written representations. Among …

Giving Voice To Historical Trauma Through Storytelling, Barbara K. Charbonneau-Dahlen

Electronic Theses and Dissertations 2010 - 2019

Objectives: This study documented events contributing to historical trauma among American Indian mission boarding school survivors, described residual effects of that trauma, and verified the Dream Catcher-Medicine Wheel model as a culturally appropriate tool that enhanced storytelling. Research Design and Methods: Nine women from two Upper Plains tribes were located through snowball sampling and participant referrals. A descriptive exploratory qualitative approach facilitated them in relating their survival stories. Seven were tape-recorded and two were hand-written on the Dream Catcher-Medicine Wheel, a model specifically designed for this study; this, combined with traditional spiritual grounding ceremonies, enhanced perspective for researcher and participants …

Power Of Memory, Tajana. Bjellos Jan 2010

Power Of Memory, Tajana. Bjellos

Electronic Theses and Dissertations 2010 - 2019

This thesis provides a rhetorical analysis of the Western representation of the Kosovo conflict and its resolution in the year 1999. By reviewing political, scholarly and media rhetoric, the thesis examines how the dominant narrative of "genocide in Kosovo" was created in Western discourse, arguing that it gained its persuasive force from the legacy of the collective memory of the Holocaust. Using the framework of Kenneth Burke's theory of Dramatism and Walter Fisher's theory of the narrative paradigm, this thesis aims to understand how language, analogy and collective memory function in rhetoric to shape audience perceptions and guide political and …

Vision Of Theophilus, Fatin Morris Guirguis Jan 2010

Vision Of Theophilus, Fatin Morris Guirguis

Electronic Theses and Dissertations 2010 - 2019

This study is a literary and ethnographic examination of The Vision of Theophilus, a fourth century Coptic narrative, as influential counter-narrative and source of counterdiscourse against the narrative created by the historically dominant Egyptian Arab Muslim state. It shows that The Vision has provided the Copts with the means to articulate their identity as different from their oppressors through its function as a repository of Coptic ideology, history and knowledge. Specifically, it has helped them resist the erosion of those aspects of their cultural identity targeted by colonial practices through its promotion of the Coptic language, pride in Coptic history, …
