Reckless Juveniles, Kimberly Thomas Feb 2019

Reckless Juveniles, Kimberly Thomas

Articles

Modern doctrine and scholarship largely take it for granted that offenders should be criminally punished for reckless acts.1 Yet, developments in our understanding of human behavior can shed light on how we define and attribute criminal liability, or at least force us to grapple with the categories that have existed for so long. This Article examines recklessness and related doctrines in light of the shifts in understanding of adolescent behavior and its biological roots, to see what insights we might attain, or what challenges these understandings pose to this foundational mens rea doctrine. Over the past decade, the U.S. Supreme …

Place: Anecdote, Theory And Practice, And A Young Princess?, M Punt Jan 2019

Place: Anecdote, Theory And Practice, And A Young Princess?, M Punt

School of Art, Design and Architecture

This article proposes that attention to the place of art and practice facilitates both a subject-to-object and object-to-object consideration of the artwork in a way that draws anecdote, history and theory together into a single perspective. It assumes an expansion of a number of established theoretical frameworks (new historicism, apparatus theory, object-oriented ontology and actor network theory), melding anecdote, theory and arts practice in a thick description of a single academic practice that encompasses theory, history and artworks. This expansion is contained by the consideration of apparatus theory, as it is understood and used in film studies, to the examine …

Advancing The Aquaculture Industry Through The Federal Crop Insurance Program, Matthew H. Bowen Jan 2019

Advancing The Aquaculture Industry Through The Federal Crop Insurance Program, Matthew H. Bowen

Ocean and Coastal Law Journal

In recent times, the aquaculture industry has experienced dramatic growth. The growth of the industry is a direct result of an increase in demand for seafood, and a decrease in supply from wild fisheries. The industry, however, is also experiencing growing pains. Aquaculture species, compared to their wild counterparts, are at a higher risk of catastrophic loss from a variety of different perils. These perils make investment in the aquaculture industry significantly risky. The federal crop insurance program could be a tool that mitigates these risks, but the program was designed around terrestrial agriculture, and while aquaculture may be covered …

History Of Archeological Investigations At Palo Duro Canyon State Park, Veronica M. Arias, Anthony S. Lyle, Rolla H. Shaller

Index of Texas Archaeology: Open Access Gray Literature from the Lone Star State

Palo Duro Canyon has been an important locale for human occupation with its distinct topography, fauna, and flora from the Paleoindian inhabitants to those of the Historic Period. There is archeological evidence of human habitation at Palo Duro Canyon throughout the past 12 millennia. Native Americans who lived in and around the canyon had access to resources not easily found on the adjoining upland plains. The canyon provided an abundance of sheltered camping and year-round supply to water, wood, stone tool materials, game, and wild plant resources. The bordering uplands, covered with grass and dotted with playa lakes, afforded campsites …

How Consumer Behavior In The 1930’S-1940’S Differed From Today, John Krusinski Jan 2019

How Consumer Behavior In The 1930’S-1940’S Differed From Today, John Krusinski

Writing Across the Curriculum

Over the years, consumer behavior has undergone a major evolution in terms of how people buy their products and what influences them. What was once limited by word of mouth and limited availability has now exploded into a major component of everyday life. In order to get more info on what consumer life was like before now, I conducted an interview with my grandmother, Mary Jane Krusinski, to see what consumer life was back in her time as well as her perceptions of consumer life today. However, the answers she gave may surprise some as her life as a consumer …

The Other Of Jacques Lacan, John Shannon Hendrix Jan 2019

The Other Of Jacques Lacan, John Shannon Hendrix

Architecture, Art, and Historic Preservation Faculty Publications

Language in the symbolic of Lacan is defined by the Other, which is the “intersubjectivity of the ‘we’ that it assumes,” as described in Écrits. The subject enters language in relationship to the other in perception, the per-ceived object or person, as recognized by the other. As described by Lacan, “What constitutes me as subject is my question. In order to be recognized by the other, I utter what was only in view of what will be [the future ante-rior of what I shall have been for what I am in the process of becoming].”

Theories Of Perception In Renaissance Humanism, John Shannon Hendrix Jan 2019

Theories Of Perception In Renaissance Humanism, John Shannon Hendrix

Architecture, Art, and Historic Preservation Faculty Publications

The hypostases of being consist of the terrestrial world of corporeal forms, dense, intertwined and in shadow; then the rationalization of the corporeal forms in the angelic mind; and finally the resolution of the forms in their absolute archetypal unity. The hypostases of being are modelled in the Universal Figure of Nicolas Cusanus, with the three figures of body, soul and mind inscribed in each of the three levels of the hierarchy, containing the nine choruses of Pseudo-Dionysius in the celestial hierarchies, representing the structure of the universe, as illustrated in a diagram, “Quator dictarum Monadum Schematica explicatio,” in Kircher’s …

The Imaginary And Symbolic Of Jacques Lacan, John Shannon Hendrix Jan 2019

The Imaginary And Symbolic Of Jacques Lacan, John Shannon Hendrix

Architecture, Art, and Historic Preservation Faculty Publications

The principal categories of Lacanian psychoanalysis in the structuring of the psyche are the imaginary, the symbolic, and the real. The imaginary (imaginaire) refers to perceived or imagined images in conscious and unconscious thought, sensible and intelligible forms; picture thinking (Vorstellung), dream images or manifest content, and conscious ego in discursive thought. The symbolic (symbolique) refers to the signifying order, signifiers, in language, which determine the subject; it refers to the unconscious, and the intellectual, the logos endiathetos and the logos prophorikos. It is the relation between the imaginary and symbolic in conscious and …

[Introduction To] Soda Goes Pop: Pepsi-Cola Advertising And Popular Music, Joanna K. Love Jan 2019

[Introduction To] Soda Goes Pop: Pepsi-Cola Advertising And Popular Music, Joanna K. Love

Bookshelf

From its 1939 “Nickel, Nickel” jingle to pathbreaking collaborations with Michael Jackson and Madonna to its pair of X Factor commercials in 2011 and 2012, Pepsi-Cola has played a leading role in drawing the American pop music industry into a synergetic relationship with advertising. This idea has been copied successfully by countless other brands over the years, and such commercial collaboration is commonplace today—but how did we get here? How and why have pop music aesthetics been co-opted to benefit corporate branding? What effect have Pepsi’s music marketing practices in particular had on other brands, the advertising industry, and popular …

Love And Refusal: Contrasting Dialectical Interpretations And Its Implications In The Works Of Erich Fromm And Herbert Marcuse, 1941-1969, Cole Mantell Jan 2019

Love And Refusal: Contrasting Dialectical Interpretations And Its Implications In The Works Of Erich Fromm And Herbert Marcuse, 1941-1969, Cole Mantell

Honors Papers

This thesis is an intellectual history of dialecticism and its use in the works of the Frankfurt School members, Erich Fromm and Herbert Marcuse. Famously, these two men had a ferocious and polemical debate in the pages of Dissent Magazine in 1955-56. The Fromm-Marcuse Debate has since become almost the sole lens in which the intellectual differences and similarities between these men are analyzed. Through a comparative and historical analysis of their individual work, largely removed from the Dissent Debate, I offer a new interpretation of their conflict, their personal relationship, and a new perspective on critical theory and its …

Killing Time: Historical Narrative And The Black Death In Western Europe, Kira Zimmerman Jan 2019

Killing Time: Historical Narrative And The Black Death In Western Europe, Kira Zimmerman

Honors Papers

Echo epidemics would sweep through Europe well into the eighteenth century, yet none would parallel the terror and drama particular to the Black Death (1348-1351), nor would they inflict as violent an injury upon paradigms of historical writing. This thesis explores and evaluates how the Black Death affected medieval historical narrative.

A Brief History Of Nutritional Rickets, Benjamin J. Wheeler, Anne Marie E. Snoddy, Craig Munns, Peter Simm, Aris Siafarikas, Craig Jefferies

Research outputs 2014 to 2021

Since first described almost a century ago, vitamin D preparations have been successfully used as a public health intervention to prevent nutritional rickets. In this manuscript, we document the periods in history when nutritional rickets was described, examine early efforts to understand its etiology and the steps taken to treat and prevent it. We will also highlight that despite the wealth of historical data and multiple preventative strategies, nutritional rickets remains a significant public health disorder. Nutritional rickets has both skeletal and extraskeletal manifestations. While the skeletal manifestations are the most recognized features, it is the extraskeletal complications, hypocalcaemic seizure …

Review: Faces Of Contemporary Russia: Advanced Russian Language And Culture, Snezhana Zheltoukhova

Cultural literacy is of the utmost importance for advanced language students. Olga M. Present And Future Adventures In Illustration, Jaleen Grove, Illustration Department Jan 2019

Present And Future Adventures In Illustration, Jaleen Grove, Illustration Department

Faculty & Librarian Work

This article discusses current trends and the future of illustration. Several illustrators and educators are interviewed, such as Anita Kunz, Armando Veve, Barbara Nessim, and Martin Salisbury. Topics include publishing, virtual reality, children's books, diversity and representation, high tuition, and the lesser respect and pay that many illustrators experience. The article also relates the history of American illustration 1959-2019 in the form of a tongue-in-cheek boardgame The Illustration Game, in which players advance through the years, encountering typical events in the industry. The game-board is scattered with historical funny-in-hindsight quotes of well-known illustrators, designers and other professionals, which illuminate …
