History Of Grassland Birds In Eastern North America, Robert A. Askins

Until recently the severe decline in the populations of many species of grassland birds in eastern North America has aroused relatively little concern or conservation action. This response appears to be rooted in the perception that grassland birds invaded the East Coast from western grasslands after European settlers cleared the forest. Detailed historical accounts and analysis of pollen deposits, however, show that open grasslands existed on the East Coast of North America at the time of European settlement. Extensive grasslands resulted from burning and agricultural clearing by Native Americans. Natural disturbances, such as wildfire and beaver (Castor canadensis) activity, produced …

Brigham Henry Roberts, a Book of Mormon scholar in the early twentieth century, was a pioneer in his field. He conducted research regarding the culture and the geography of the Book of Mormon peoples in an attempt to determine the setting of the Book of Mormon. His extensive work in this area has significantly influenced the progress of Book of Mormon research. Roberts also enthusiastically defended the book when others criticized it. He was able to do so effectively because of his study of and familiarity with the Book of Mormon. Roberts did, however, have a few limitations, the most …

Establishing New Legal Doctrine In Managed Care: A Model Of Judicial Response To Industrial Change, Peter D. Jacobson, Scott D. Pomfret

University of Michigan Journal of Law Reform

Courts are struggling with how to develop legal doctrine in challenges to the new managed care environment. In this Article, we examine how courts have responded in the past to new industries or radical transformations of existing industries. We analyze two historical antecedents, the emergence of railroads in the nineteenth century and mass production in the twentieth century, to explore how courts might react to the current transformation of the health care industry.

In doing so, we offer a model of how courts confront issues of developing legal doctrine, especially regarding liability, associated with nascent or dramatically transformed industries. Our …

"Billy Yank" On The Northern Plains: The Lives Of Union Soldiers On The Minnesota-Dakota Frontier From The Great Sioux Uprising To 1866, Darrin F. Boehm

This thesis will tell the generally forgotten story of the Civil War era soldiers on the Minnesota-Dakota frontier who fought in the Great Sioux Uprising from 1862 to 1865. It will also compare the frontier soldiers’ campaign experience with the experiences of Bell Irvin Wiley’s Civil War ‘'Billy Yanks.”

This thesis covers enlistment procedures, food, clothing, shelter, discipline, disease, boredom, combat, the “galvanized” Yankees, the Dakota landscape, and the role of the cavalry. On the morning of August 14, 1909, a small, diverse group including Professor Byron Cummings of the University of Utah, Government Land Office surveyor William Douglass, pioneer archaeologist and trader John Weatherill, and Paiute guide Nasja Begay gazed at the largest structure of its kind in the world-Rainbow Bridge. Their presence marked the official discovery of the magnificent natural bridge, which spans 275 feet and towers 291 feet above the stream bed below it. This collection consists of the professional and personal papers of Cornell-trained naturalist Dr. Francis Harper. Materials span 1904-1972 and include field notebooks, correspondence, photographs, and audiovisual materials documenting the plant and animal life as well as human ecology of the Okefenokee Swamp area of South Georgia. The photographs within Series 1 show the flora, fauna, and people of the Okefenokee swamp. The photographs were taken by the Harpers while on their trips to the swamp. Investigations into the composition, spatial and temporal distribution of the Black Sea zooplankton were reviewed in context with its historical development. The review comprises the main zooplankton studies published by the riparian countries of the Black Sea beginning with the earliest faunistic publications in the 1860s and 1870s up to the recent multinational ecosystem investigations carried out within the framework of the NATO-TU-Black Sea Project. The reviewed material covers a wide subject range of zooplankton investigations from descriptive studies to distribution and the production mechanisms in the ecosystem. This Article explores the long and intricate history of federalism, the arrangement between the federal and local governments to serve the people, in the United States. It begins with the beginnings of federalism in pre-colonial times and continues to discuss how recent Supreme Court decisions have failed to articulate a cohesive test for federalism issues. Ultimately, the Article proposes a method for resolving federalism disputes. This method focuses on the sociopolitical and economic benefits of federalism as the Framers intended. This Article seeks to explain the negative perception the legal profession and lawyers have in the eyes of the American public. Disregarding common answers such as the disproportionate amount of influence lawyers have or high salaries and extravagant lifestyles, this Article argues that a cultural shift has led many Americans to see the law as an arbitrary device. Consequently, this belief is reinforced by lawyers and and perpetuated by law schools, leading to the negative perception of the legal profession. Students place tens of thousands of posters around law schools each year in staircases, on walls, and on bulletin boards. Rarely, however, do formal disputes about postering arise. A Troublesome Commerce: The Interstate Slave Trade, 1808-1840., Robert Harold Gudmestad

The interstate slave trade grew from a haphazard and intermittent enterprise in the early years of the nineteenth century to a central aspect of southern society. With the decline of the international trade and the decline of white migration to the frontier, southerners turned to the trade to supply their labor needs. Farmers in the Chesapeake region increasingly sold their "excess" bondservants to slave traders. These speculators brought a measure of systemization and regularity to the trade. As they did so, however, a significant number of Upper South citizens questioned the trade's efficacy. The wanton exploitation and naked cruelty of …
