Searches And The Misunderstood History Of Suspicion And Probable Cause: Part One, Fabio Arcila

ExpressO

This article, the first of a two-part series, argues that during the Framers’ era many if not most judges believed they could issue search warrants without independently assessing the adequacy of probable cause, and that this view persisted even after the Fourth Amendment became effective. This argument challenges the leading originalist account of the Fourth Amendment, which Professor Thomas Davies published in the Michigan Law Review in 1999.

The focus in this first article is upon an analysis of the common law and how it reflected the Fourth Amendment’s restrictions. Learned treatises in particular, and to a lesser extent a …

Changing Maine, 1960-2010: Teaching Guide, Richard Barringer, New England Environmental Finance Center

Maine History & Policy Development

Unlike forty years ago, none of us is now certain what the future holds for Maine – except that it will be different. Maine has been transformed by the events of the recent decades. We have come into a new world, a new time – a new historical era, if you will. This new era, like previous eras in Maine history, will require of us new ways of thinking, new ways of understanding, new ways of organizing ourselves as a community of people, if the values and culture we share and cherish are to endure and flourish.

Redefining Multicultural Education And Its Applications In The General Music Classroom, Emily C. Hardwick Jul 2006

Redefining Multicultural Education And Its Applications In The General Music Classroom, Emily C. Hardwick

Theses and Dissertations

"Understanding music in relation to history and culture" is the ninth standard for music education developed by the National Association for Music Educators (MENC) in 1994 (Mark, 1996, p. 50). This principle is very broad and it is up to individual teachers to make sure they include history and multiculturalism in their curriculum. The term multicultural education is extensive and because many teachers do not understand what all it entails, some students do not get a comprehensive multicultural education.

In the general music class for example, teaching students a Japanese folk song is a typical multicultural lesson. I do not …

Man-Made Menopause, Madeline Horwitz Jan 2006

Man-Made Menopause, Madeline Horwitz

Undergraduate Research Symposium (UGRS)

In this study I suggest that there are three distinct time periods mark new developments in society’s understanding of menopause, Victorian America in the mid and late nineteenth century, mid-twentieth century America, and contemporary America. This is the case not only in terms of advances in biological science, but also the ways in which the medical establishment has viewed menopause has also changed, and in terms of changes in prevalent gender assumptions. In this paper I hope to expose the ways science, history, and society has medicalized menopause, and the ways in which menopause has been viewed by individual women, …

Research Manuscript Series

This monograph, bearing the unpretentious subtitle "Evidence from the Arts and Sciences Building" stands as an elegant contradiction to all of those easy excuses. Russell Skowronek and his co-investigators have produced a report that stands not only as a template for what can be done with a modest data-set of ten prehistoric burials, but as a template for cooperation with the Ohlone descendants of those who, well over a millennium ago, carefully prepared their loved ones for eternity.

Working from ancient maps and city directories, Carlson and associates have produced a fine summary of virtually everyone who ever occupied what …
