Natural Law And The Rhetoric Of Empire: Reynolds V. United States, Polygamy, And Imperialism, Nathan B. Oman

Faculty Publications

In 1879, the U.S. Supreme Court construed the Free Exercise Clause for the first time, holding in Reynolds v. United States that Congress could punish Mormon polygamy. Historians have interpreted Reynolds, and the anti-polygamy legislation and litigation that it midwifed, as an extension of Reconstruction into the American West. This Article offers a new historical interpretation, one that places the birth of Free Exercise jurisprudence in Reynolds within an international context of Great Power imperialism and American international expansion at the end of the nineteenth century. It does this by recovering the lost theory of religious freedom that the Mormons …

The Texas Wind Estate: Wind As A Natural Resource And A Severable Property Interest, Alan J. Alexander Feb 2011

The Texas Wind Estate: Wind As A Natural Resource And A Severable Property Interest, Alan J. Alexander

University of Michigan Journal of Law Reform

In 2011, Texas is again at the forefront of an energy boom: the wind energy boom. In 2006, Texas surpassed California and became the US. state with the most installed capacity to produce wind energy, and Texas' level of installed capacity has continued to grow. But the law has not kept pace with this growth. Similar to the initial growth of the oil and gas industry in Texas, the wind energy industry was also born, and continues to grow, in the absence of clear legal and regulatory standards. Lack of regulation in the early development of the oil industry contributed …

Collateral Damage: The History Of United States Case Law On Today's Military Hunger Strike Doctrine, Adrian Mora Jan 2011

Collateral Damage: The History Of United States Case Law On Today's Military Hunger Strike Doctrine, Adrian Mora

Yale Medicine Thesis Digital Library

HYPOTHESIS/AIMS: In the Global War on Terror (GWOT), hunger strikes by detainees in Guantanamo Bay, Cuba have been managed by military physicians through force feedings. This thesis answers the question of how did the United States justify its current practice of force feeding prisoners against prevailing medical ethics? The author hypothesizes that U.S. case law history of approximately 1979 to 1997 enabled the current military doctrine to force feed international detainees in GWOT.

METHODS: A qualitative and comprehensive review of the relevant literature was undertaken. The sources used for conclusive analysis included press releases, ethics commentary, law reviews, medical association …

Candy Land, Brittney Champagne Jan 2011

Candy Land, Brittney Champagne

Theses & ETDs

Sweetness functions as a symbolic prop for human desire. My artwork questions the cost of this desire, troubling what can and should be consumed, while negotiating the environmental and social histories of human desire for sugar. This project generates a subjective history for the strange, perhaps unnatural, commodities that people desire, through which I aim to plant them more firmly into the natural world from which they have been separated by so much plastic, foil, and ornament.

Courting The Iron Horse: How The United States Exacted Limited Controls Over The Railroads In The Second World War, Carl Nieman

Honors Capstones

This thesis explores the extent of US Government control over the railroads during the Second World War. The purpose of this project is to discover how much government regulation there was regarding the railroads and how intrusive it was. This is achieved by looking over government documents between 1930 and 1950. These documents were reviewed and were assessed on how intrusive they were or were not and also the period in which they were wrote, during the war or before or after, was also taken into account. The findings of this thesis were that the US Government did increase its …

In Response To Need, A History Of The Western Australian Department Of Agriculture - 1894 To 2008, E N. Fitzpatrick Jan 2011

In Response To Need, A History Of The Western Australian Department Of Agriculture - 1894 To 2008, E N. Fitzpatrick

Books & book chapters

The department was not always such a significant organisation; it came from very small beginnings. However, it has been a major component of the engine which has produced an agricultural industry in a Mediterranean climate zone which is superior to all others operating in this zone. This book is a summary of its work. There are many more fascinating chapters to be recorded of work on specific issues of development, investigation or conservation. I hope they will be written by someone one day. With this in mind the department has decided to put the book on a web page where …

From Sweetwater To Seawater: An Environmental History Of Narragansett Bay, 1636--1849, Christopher L. Pastore Jan 2011

From Sweetwater To Seawater: An Environmental History Of Narragansett Bay, 1636--1849, Christopher L. Pastore

Doctoral Dissertations

This dissertation examines environmental change on and around Narragansett Bay from first European settlement in 1636 to the dissolution of the Blackstone Canal Company in 1849. It uses one of the largest estuaries on the East Coast and one situated at the heart of early English settlement in New England as a means to write estuaries into Atlantic history. Examining the ecological and epistemological complexities that arose at the nexus of land and sea, where improvable space and the push of "progress" met an eternal or "profound" ocean, this study reframes estuaries as watery borderlands that people used but never …

The North Comes South Northern Methodists In Florida During Reconstruction, Heather K. Bollinger Jan 2011

The North Comes South Northern Methodists In Florida During Reconstruction, Heather K. Bollinger

Electronic Theses and Dissertations

This thesis examines three groups of northern Methodists who made their way to north Florida during Reconstruction: northern white male Methodists, northern white female Methodists, and northern black male and female Methodists. It analyzes the ways in which these men and women confronted the differences they encountered in Florida‟s southern society as compared to their experiences living in a northern society. School catalogs, school reports, letters, and newspapers highlight the ways in which these northerners explained the culture and behaviors of southern freedmen and poor whites in Jacksonville, Gainesville, and Monticello. This study examines how these particular northern men and …

Human Sanitary Wastes And Waste Treatment In New York City, David J. Tonjes, Christine O'Connell, Omkar Aphale, R. Lawrence Swanson

Technology & Society Faculty Publications

Henry Hudson first sailed toNew Yorkharbor 400 years ago. Since then,New York Cityhas both affected and been affected by water quality in greaterNew YorkHarbor. In this paper, we focus on sewers, sewerage, and sewage treatment inManhattanand their effects on theHudson River. It is clear that feedbacks among drinking water quality and quantity, population, public perceptions, regulations, and estuarine water quality exist, although their strength and character have varied over time. Early land uses damaged local water supplies found on ManhattanIsland. New Yorkthen began to exploit the large fresh water resources available to its north, which helped the City to expand …

Definition, Andrew Kania Jan 2011

Definition, Andrew Kania

Philosophy Faculty Research

Much of the time most of us can tell whether, and which of, the sounds we are currently hearing are music. This is so whether or not what we are listening to is a familiar piece, a piece we have not heard before, or even music from a culture or tradition with which we are unfamiliar. In cases where we are unsure, or initially mistaken in our judgment, we will often change our opinion based on further information. This near-universal agreement suggests that the concept of music is one shared by different people, and has boundaries which we are implicitly …

Toward An Environmental Conservatism, Terri S. Winters Jan 2011

Toward An Environmental Conservatism, Terri S. Winters

Master's Theses and Capstones

The Evangelical Climate Initiative (ECI) argues that climate change is real and human-induced and represents a moral challenge for Christians to which an urgent response is required. The ECI demonstrates that there is common ground between conservatism and environmentalism. The actions of the ECI fit within an "environmental conservatism" whose elements have historical precedence. We find the seeds of parallel ideas in the writings of the Southern Agrarians in the 1920s and 1930s---ideas that were brought to full flower by Richard Weaver, an important figure in the development of a post-World War II traditional conservatism. We also find a similar …
