The “Academic Bill of Rights” movement, launched by right wing activists in

2003, has sought to legislate control over student rights, the hiring of faculty members,

and curricula. It activists claims to seek academic freedom in an academy that has been

virtually taken over by leftists aiming at indoctrinating students into their vision of the

world. Through a variety of groups, including Students for Academic Freedom, the

movement claims to base its initiatives on principles established by the American

Implementing Collective Bargaining "Enabling Legislation": Washington Universities Join The Party, Laurie Connelly, Rodney B. Younker Esq., Gary Pagels, Gary Mcneil, Michael Jennings

Journal of Collective Bargaining in the Academy

In 2002, Washington passed enabling legislation that, for the first time, expressly granted

to the faculty at the state’s public four-year colleges and universities the right to bargain

regarding their terms and conditions of employment. To date, faculty at four of the state’s

six four-year public institutions of higher education have formed unions, and two of those

unions have negotiated first contracts. This paper describes the history of that process,

the legal framework in which it took place, and the issues of greatest importance at the

bargaining table.

In December 2002 the University of Michigan received notice from the Michigan

Employment Relations Commission (MERC) that a petition had been filed for

representation of the non-tenure track instructional faculty. The petitioning union was

the Lecturers’ Employee Organization (LEO), an affiliate of what is now called AFT

Michigan. The petition asked to cover all non-tenure track instructional faculty (lecturers,

adjunct faculty, visiting faculty and clinical track faculty) at all three campuses (Ann

Arbor, Dearborn and Flint) except for the Medical School, Dental School, Business

School and Law School at Ann Arbor.

Organizing of professionals at institutions of higher education presents a number of unique issues. More than 25 years ago, the Supreme Court ruled in the Yeshiva University case that faculty members at that school were managers, exempt from the National Labor Relations Act (“NLRA”), because of their authority in the academic governance of the University. Since that time, there have been numerous cases applying the Yeshiva decision and further developing the factors used by the National Labor Relations Board (“NLRB”) and the courts in determining whether full time faculty are managerial. Unions & Faculty Senates: A Cross-Case Analysis Of Governance Within Private Universities, Carlene Blake

Academic governance within higher education is a complex decision-making

process that creates college and university policies and actions. The interactions

between faculty senates, unions, and administrators have been explored by a number of

models, including collegial, bureaucratic, and political models, as well as senate

structures, but little data is available for private universities.

The governance process was examined at two private universities: Adelphi and

Hofstra. A semistructured interview was constructed to answer questions concerning

perceptions of the senate, faculty union, governance, leadership styles, and power

structures. Thirty participants, 15 from each university, were interviewed. Interviews

Luck Or Design? The Unionization Attempt At Bowling Green State University, Mary Ellen Benedict

This discussion will attempt to meet two goals. First, it presents the case and preliminary

findings related to the examination of the failed unionization attempt. The study investigates

what features in this event may be important factors in higher education unionization. Second,

the paper discusses the challenges using qualitative research methods to study faculty

unionization. The rest of my talk will describe the events at BGSU from 1991 through 1994,

after presenting a brief literature review that explains why faculty form unions. The analysis of

these facts will help us to make some general conclusions about faculty organizing.

This paper discusses rallying public support for financing of public higher education, focusing on four points: First, appeals to sentiment are ineffective and perhaps damaging. Second, the support that counts is financial. Third, the best leverage is provided by parents of students or prospective students. Finally, if we want a different social contract for higher education, we must provide different consideration for that contact.

There is mounting evidence to suggest there is cause for concern regarding the ability of pensions to provide the primary source of income in retirement for members of an aging U.S. workforce. Furthermore, the rising cost of health care and changes in accounting rules may put additional strains on the system, resulting in the erosion of retirement as a social institution as we now know it.
