This phenomenological study was undertaken to describe the meaning of living with HIV infection. Descriptive phenomenology was utilised to investigate the lived experiences of persons who had human immunodeficiency virus infection (HIV/ AIDS), describe common elements, themes or patterns of lived experiences of persons with HIV / AIDS, and analyse the meaning of lived experiences of persons with HIV/ AIDS. Twelve Australians, experiencing HIV infection and participating in the community support groups in Perth, volunteered as participants. Two participated in the pilot study. Courts in more than a dozen states have decided cases in which a person has claimed money damages for his or her fear of getting acquired immunodeficiency syndrome (AIDS). Although most courts have rejected such claims in the absence of actual exposure to the human immunodeficiency virus (HIV), their reasoning has varied slightly from state to state. This article argues that negligence law should not permit people who are HIV negative to recover damages for an unfounded fear of AIDS. Public health statements intended to educate the public about preventing HIV transmission may have encouraged some fear-of-AIDS lawsuits against health …

Calming Aids Phobia: Legal Implications Of The Low Risk Of Transmitting Hiv In The Health Care Setting, American Bar Association Aids Coordinating Committee

Scientists are concluding that the risk of becoming infected with the virus that causes AIDS based on transmission from an infected health care worker is infinitesimal: in fact, only one health care worker has ever been documented as the source of HN transmission to a patient. This Article sets forth the medical evidence concerning this low risk and argues that legal decision making should incorporate these facts into its analysis of legal problems involving HN-infected health care workers. Confusion In The Courts: What To Do With Hiv-Positive And Aids-Infected Public Employees , Erika J. Crandall

Journal of Law and Health

This paper is divided into five sections. Part one deals with background information on AIDS. Part two discusses current federal legislation. Part three examines how AIDS falls under federal legislation and case law, including the resulting impact of hiring AIDS-infected individuals. Part four evaluates possible violations of the Fourth Amendment resulting from the federal legislation and from an employer's mandatory testing of employees for the HIV virus. The last section discusses the government's liability when a public employee transmits AIDS to another individual during the course of employment.

This paper will examine the creation of a federal AIDS compensation scheme for victims of injuries caused by vaccines which are distributed as a part of a national immunization program. As a preliminary inquiry, I will examine the impact of perceived liability on potential manufacturers to determine whether the risk of liability for manufacturers decreases the possibility that a successful AIDS vaccine will be introduced into the market. I will then discuss whether, given the present laws and economic incentives surrounding the vaccine industry, a federal compensation scheme for an AIDS vaccine is necessary. The Relationship Between Nurses' Knowledge Of Hiv, Fear Of Aids, And Use Of Universal Precautions, Carol Jones

This study examined the relationship between knowledge of HIV, fear of AIDS, and use of universal precautions in registered nurses. A descriptive survey design used a battery of questionnaires, including the National League for Nursing's Caring for Persons with AIDS Test, the University of Texas Fear of AIDS Scale, and a demographic questionnaire. The random sample consisted of 109 registered nurses working at a county hospital in the southwestern United States. The Health Belief Model guided the study. Research hypotheses were: (1) There is a positive correlation between knowledge of HIV/AIDS and use of universal precautions among nurses; (2) there …

The resurgence of tuberculosis (TB) in urban areas has direct and alarming consequences within the criminal justice system. Lock-up facilities, jails and prisons are TB breeding grounds. TB strikes with vengeance in populations with physical vulnerabilities caused by alcoholism, drug addiction, malnutrition, and HIV/AIDS and other immune-suppressing conditions. This Essay argues that it is time for New York State to reevaluate the mandatory sentencing laws and restrictions on plea bargaining. Few studies have been done that examine the acceptance of nurse practitioners as providers of care by persons infected with the Human Immunodeficiency Virus (HIV). The purpose of this study was to evaluate the level of satisfaction with care as experienced by the HIV-infected client in an outpatient setting who has received care from both nurse practitioners and physicians. The Health Belief Model (HBM) developed by Rosenstock, Hochbaum, and Kegeles in the 1950s, and specifically the concept of self-efficacy, was chosen as the conceptual framework for this study. Homeless persons with AIDS and HIV infection face significant health hazards during the daily struggle for survival on the streets and in the crowded shelters of our cities. This article offers a historical perspective on the evolution of the AIDS epidemic within the homeless population of Boston and examines the demographics, risk behaviors, and survival statistics of that epidemic. In October of 1991, Kimberly Bergalis, a weak and frail AIDS victim, made a physically taxing journey to Washington D.C. She went, despite her deteriorating condition, to testify on behalf of a proposed bill that would require health care practitioners to be tested for the HIV virus before performing any invasive procedures. Kimberly was unknowingly infected by her dentist, who had the HIV virus.

After a decade of fighting AIDS, the public health community has come to recognize that strategies to combat the infection must be premised on voluntarism and not on coercion. Attempts to combat AIDS with coercive public health strategies stem from a desire to force AIDS into an ill-fitting traditional disease-response framework, overlooking the differences between HIV and other sexually transmitted diseases, including the limitations in available treatment modalities for HIV. A return to such a cramped, narrowly-medicalized view of the AIDS epidemic has enormous social implications and a coercive strategy would frustrate efforts to stem the spread of the disease. …

This note will seek to determine if granting a physician the right to warn third parties at risk is the appropriate solution to the above scenario and others like it. Part I will supply a background on the virus that causes AIDS. Part II will review possible legal justification for this breach of the confidential doctor/patient relationship. Part III discusses why there is a need to maintain strict confidentiality of AIDS-related information. Finally, Part IV will discuss alternatives to granting physicians the right to warn.

An analysis of the restrictive proposals provoked by the case of Kimberly Bergalis and four other patients apparently infected with HIV during the course of dental treatment reveals that they resulted from an inability to evaluate appropriately the infinitesimal risk of HIV transmission from practitioner to patient. The proposals also resulted from an effort to create risk prevention policy without appreciating the distinction between regulating things or procedures, which have no human rights, and regulating people, who have rights that should not be infringed without serious justification. This practicum was aimed to improve AIDS awareness through a staff development program for teachers in an elementary school setting. Two broad aims were to increase teacher knowledge regarding the transmission of AIDS and to teach them how to protect themselves and others with regards to this disease.

Twelve (12) workshops designed to develop essential skills and to impart information on the transmission and personal risk factors involved with Acquired Immune Deficiency Syndrome/Human Immunodeficiency virus were held during the implementation phase of this practicum.
