EXECUTIVE SUMMARY The community of Opportunity, Montana, is surrounded by an area many consider to be the largest Superfund site in the United States. The nearby Opportunity Ponds is a major consolidation area for mining-related contaminated wastes in the state of Montana, and Opportunity residents have voiced concerns about their well water, windblown dust, and other issues since at least the late 1990s. Furthermore, the community has been subjected to ongoing environmental injustices: they feel they have been left to bear an unfair environmental burden without compensation and feel left out of important decision-making processes that affect them. This article analyzes power dynamics in Vieques, Puerto Rico in the immediate aftermath of the U.S. Navy's closure of its five fire range on the island. The essay examines several aspects of Vieques' continuing struggle in a post-Navy world. It considers residents' hopes and views of different kinds of development; the ramifications of former Navy-occupied land being classified as "environmentally protected"; and finally, potential organizing principles for directing Vieques' development, looking at the challenges and opportunities facing activists. Analysis suggests that several residential areas in Newark, New Jersey (USA) have Black/African-American and Hispanic populations, which may be "at high risk" with respect to the adverse health effects of particulate air pollution. This study analyzes the community locations and evaluates literature and other available air pollution data for the target communities in the city of Newark. The study focuses on asthma or reactive airway diseases as a target health risk. It also performs data collection on particulate pollutants and levels of trace metals in particulate matter in target communities and schools of preschool children in two of the five …

The purpose of this qualitative study was to evaluate a community's beliefs, attitudes, and experiences regarding their neighborhood's environmental health issues and the ways in which individuals utilize social capital (the degree to which a community collaborates and cooperates) to improve their environmental health. Research correlating social capital with health status shows that the higher the level of social capital in a community, the better the health. An understanding of why some groups exhibit more social capital than others is important in improving the public health system. This paper is divided into four parts. Part one consists of a general overview of the problem of environmental discrimination. Part two gives a brief discussion of relevant Equal Protection jurisprudence. The section begins with a summary of general Equal Protection law. Then, the section analyzes the primary cases that established the foundation of modem-day Equal Protection doctrine. Part three examines the current application of the intent requirement in environmental discrimination cases. The transport of contaminants to the Arctic and their presence in traditional foods in the region is causing concern about potential adverse health impacts resulting from exposure to these globally-borne chemicals. In this study, ten stakeholders in the issue of contaminants in traditional foods in Alaska were interviewed to determine how they define the problem, and in doing so, to determine if they perceive that the situation constitutes an environmental injustice for Alaska Natives. The interview transcripts were analyzed using five sub-frames of the environmental justice framework: distributive justice, procedural justice, indigenous rights, corrective justice, and ecological sustainability. The United Nations Millenium Development Goals (MDG) focus on key social, economic and political issues; gender and environment are just some of the areas noted. What are the lessons learnt from Kenya’s Green Belt Movement (GBM), spearheaded by Wangari Maathai? MDG analysts might benefit from understanding an NGO’s strategies, like GBM. It will be argued that GBM’s consensus movement mobilized urban and rural women around tree planting income-generating activities, consciousness raising, women’s rights, and political empowerment. GBM’s harambee spirit has the potential of replication across the continent.

This paper analyzes water as a social justice issue in South Africa, a nation that has undergone tremendous political and legal transformations over the last fifteen years, but whose population nonetheless continues to suffer from severe inequities in access to freshwater resources. In light of growing water scarcity worldwide, this paper highlights that legal treatment of water resources has significant socioeconomic and distributive justice impacts, even in progressive constitutional democracies that have embraced principles of human rights and international legal norms. Legal scholarship on the role of cost-benefit analysis in environmental law is often stimulating, but does not seem to be changing anybody's mind. The entrenchment of a camp of detractors and a camp of advocates of cost-benefit analysis parallels the impasse that has stymied environmental law for over a decade. Professors Frank Ackerman and Lisa Heinzerling have coauthored a book that captures most of the arguments from the detractor side, and they have done so skillfully and powerfully. People across the country have witnessed the quality of their local environment decline in the name of progress but Lewis argues that tow-income and minority persons have observed the disproportionate placement of environmental hazards in their communities. That disparity has partially resulted from environmental discrimination based upon class and race. This dissertation presents an alternative mapping approach which challenges the hegemony of abstract space and instrumental reason propagated by the U.S. Environmental Protection Agency (EPA) in its 1998 study of the Louisiana Department of Environmental Quality's (DEQ) permitting process. The "other truth" is presented through application of concepts from critical theory, critical geography, and the works of Henri Lefebvre to a specific environmental justice struggle in St. James Parish, Louisiana. In the late 1970s and early 1980s, the grassroots environmental movement brought national attention to the issues related to inequities in environmental quality. Previous research addressing these environmental inequities has progressively increased and advanced methodologically. However, the arguments and focus have been primarily limited to examining the socio-demographics in an ongoing debate of race and class. This thesis extends past the methodological stalemate focusing on the application of Geographic Information Systems (GIS) using survey data in an environmental justice case study of a community in south Florida. Within the well-established human rights system, there exist at least three ways to promote environmental ends (each of which is discussed further in Section III below): (1) mobilizing existing rights to achieve environmental ends; (2) reinterpreting existing rights to include environmental concerns; and (3) creating new rights, such as the right to a clean environment. To justify engaging in any one of these processes, an advocate must recognize both their moral legitimacy and legal utility. A private lawyer representing a private client is seldom a crusader. When environmental justice is relevant to a particular matter – the client proposes to build a facility and engages the lawyer to help secure necessary governmental approvals, for example-the lawyer's primary duty must be to the client.

The client in such a case faces two primary types of questions: substantive, such as where and how to build the facility; and procedural, deciding what processes to follow and how much to involve the community in the planning.
