The Probative Weight Of The "Mainstreaming" Requirement Under The Eha, Linda S. Abrahamson
Northern Illinois University Law Review
This comment examines the case law which has developed around the "mainstreaming" provision of the EHA. It focuses on the fact that placement decisions made by school districts are nearly always upheld, regardless of the desires of parents or handicapped students. The author contends that this inequity does not properly respect the role of parents under the EHA, as advocates for their handicapped children. The author concludes by developing a factor test to determine the appropriate placement for a handicapped student when the degree of mainstreaming is the only issue before a reviewing court.

We are living in an information based society that has resulted in the availability of new technology for use by students and teachers. The video camera is an ideal tool for disseminating information and teaching skills; it is easy to use, produces immediate results and feedback, and catches the students' attention in an instant. Yet, many teachers shy away from incorporating the video camera as a part of their classroom curriculum. Some are wary of the camera itself. The purpose of the study was to determine the current status of nonprint media production in the public secondary schools. A questionnaire was administered to the media specialists/librarians at all Louisiana schools containing grades seven through twelve including schools listed as junior highs containing the sixth grade. A 90.909 percent response rate was achieved. Findings included the following: (1) In the order of occurrence, nonprint media produced in the public secondary schools of Louisiana were: overhead transparencies; cassette and/or reel to reel audio tapes; video tapes, photographic slides and photographic film development; slide/tape programs; computer programs; and 8mm films; (2) …

The investigator studied the application of the First Amendment of the United States Constitution to secondary school students' right to free expression. The investigator examined landmark cases such as Tinker v Des Moines Independent Community School District in order to depict the historical development of extending constitutional rights to secondary school students.
The study encompasses both landmark cases (those cases involving highly significant decisions that established a precedent) and relevant cases which led to the present judicial posture regarding secondary students' right to free expression.
