From Housewives And Mothers To Mules: The Case Of Latin American Women Prisoners In Spain, Joaquina Castillo-Algarra, Marta Ruiz-García

Journal of International Women's Studies

Latin American women play a key role in the international cocaine business as couriers or mules. Beginning from theoretical perspectives that explain the relationship between criminality and gender, we analyze why women without a criminal background become criminals, how they become involved in trafficking, their positions and functions in the criminal organization, and the risks and benefits of their participation. Qualitative fieldwork was carried out based on in-depth interviews with fifty-one female inmates and twenty members of prison staff from nine Spanish prisons. “Whilst drug trafficking has been a concern for several decades, wildlife trafficking has only fairly recently garnered international attention. Often media coverage of wildlife trafficking links it to the illegal trade of drugs. This article analyses wildlife and drug trafficking connections of various kinds. Organized crime related violence in Mexico remains at unprecedented levels despite decades of effort and billions of dollars spent attempting to weaken Transnational Criminal Organizations (TCOs) through the Mérida Initiative (MI): a bilateral security partnership established in October 2007 between US President George W. Bush and Mexican President Felipe Calderón. The MI sought to combat TCOs (often called cartels), their drug trafficking operations, and their networks of corruption. However, since then TCOs have expanded their businesses beyond drug trafficking, and they have adopted violent practices that target civilians. The rapid increase in the use of social media during the “war on drugs” in Mexico, especially in the first decades of the 21st century, has stimulated a growing research agenda in academia. To date, this scholarship has focused primarily on investigating the opportunities social media platforms such as Facebook, Twitter, and YouTube offer to civilians as organizing mechanisms, to fill the informational vacuum left by the tightly selfcensured mainstream media outlets, and as a tool for survival. When crime reaches across borders to threaten human security or undermine democracy, states often respond by adopting multilateral treaties that obligate each of them to suppress the transnational crime at home. These treaties help, but only to the extent that parties comply with them. Because states generally cannot enforce their laws outside their own territory, transnational criminals can evade prosecution as long as some states are unable or unwilling to meet these treaty commitments. Throughout the War on Drugs, South American governments have fought a difficult and many times losing battle against drug trafficking. Lack of resources and policing capabilities have lead a growing number of States to adopt so called “Shoot-Down Laws”, legislation designed to authorize use of lethal force against “hostile” aircraft suspected of being involved in narco-trafficking. This article examines said laws from the viewpoint of international law, humanitarian law and human rights law.
