Reorganizing Corrections: Revisiting The Recommendations Of The National Advisory Commission, N. E. Schafer

In 1973 the National Advisory Commission on Standards and Goals recommended that correctional services be consolidated under a single state agency, arguing that cost efficiencies, improved communication, and greater employee professionalism would result. The National Advisory Commission advocated state rather than local control of probation, and executive rather than judicial branch control of probation services. It encouraged development of regional rather than local jails and recommended that states assume the operation and control of all local detention and correctional functions. The Spring 1993 issue of the Alaska Justice Forum compares data on criminal justice processing of Alaska rape cases in1986–1991 with similar data for the violent crimes of homicide, rape, robbery, and assault, finding that the percentage of persons arrested, prosecuted, and brought to trial on the original arrest charge is lowest for rape among the four violent crimes. Other differences between dispositions for persons arrested for rape and those arrested within the other three crime categories are also evident. The Interstate Compact for the Supervision of Parolees and Probationers (ICSPP) provides for the supervision of offenders in states other than those in which they were sentenced. It is assumed that the number of offenders entering a state for supervision is, over time, approximately equal to the number leaving for supervision elsewhere. Thus the net "cost" to the state would, over time, be zero. Data on Alaska's participation in the Interstate Compact formed the impetus for a study of Interstate Compact clients processed through the Anchorage probation office. The Justice Data Base Directory, first published in 1988 with new chapters added annually through 1992, presents information about the primary databases maintained by Alaska justice agencies and the procedures to be followed for access to the data. Its availability should substantially reduce the work required to identify the sources of data for research and policy development in law, law enforcement, courts, and corrections. An exploratory survey of visitors to two men's prisons finds that the visitors differ in some significant ways from prisoners' families previously described in the literature. The results raise some questions about the correlation that has been established between visits and post-release success and provoke suggestions for in-depth research into visitor/prisoner relationships.

Based on empirical evidence that visiting is significantly related to parole success, correctional administrators have begun to view family visits as one component of the rehabilitation process. Several authorities have encouraged correctional institutions to maximize visiting opportunities. Previous studies have noted geographical and architectural limits to such maximization. This paper reports the results of a national survey of visiting policies and draws comparisons with surveys reported in 1978 and 1954 to determine the extent to which prisons have increased efforts to make visiting a priority.

The Spring 1990 issue of the Alaska Justice Forum reviews evidence that charge bargaining in Alaska occurs — despite the formal ban on plea bargaining in Alaska in 1975 — and analyzes the impact of charge bargaining on sentencing practices. Visiting rules and regulations from 71 long-term adult correctional facilities from 31 states were collected and reviewed. Most of the rules cover five distinct areas: visitor application, visitor processing, contraband, conduct, and dress codes. The rules are described and discussed in light of recent standards which stress the importance of encouraging visitors. Suggestions and recommendations are included.

The Alaska Pretrial Intervention (PTI) program of the Alaska Department of Law operated in 13 locations throughout the state from 1983 to 1986, when economic pressures resulted in the program's termination. The program was intended to provide an alternative to full prosecution in cases where the offense behavior did not appear to warrant it. This paper analyzes recidivism in the PTI program through examination of chronic offenders, defined as PTI clients who were rearrested for the same charge as that for which they had initially been referred to the program.

Impact Of The Delegation Doctrine On Prison Privatization, Ira Robbins

Few people would argue that the state of our nation's prisons and jails is ideal. Apart from whatever other ills plague these institutions, overcrowding is pervasive. Populations have doubled in a decade, and with preventive detention, mandatory minimum sentences, habitual offender statutes, and the abolition of parole in some jurisdictions, there is no relief in sight. Some states are even leasing or purchasing prison space in other states. And it is costing the taxpayers more than seventeen million dollars a day to operate the facilities, with estimates ranging up to sixty dollars a day per inmate.
