Sea level rise requires a new paradigm for controlling the development of coastal lands that are in harm’s way, calling for adjustments in the law, legal practice, and legal education. This article discusses the historical tendency of the law to adjust to changes in society and the recent emergence of new legal institutions and strategies for mitigating and adapting to climate change, particularly sea level rise. There is a growing sense of the fragility of agricultural production in the Global North and South and of increasing risks to food security, as scientific observations confirm significant changes in the Gulf Stream, polar ice, atmospheric CO2, methane release, and other measures of climate change. As scholars debate whether climate change warrants more or less active management in wilderness, this baseline study identifies what is happening on the ground. This study focuses attention on National Park Service units that administer designated wilderness. Representatives who had been identified by the superintendents from each of these units responded to an online survey (with a 94% response rate). Respondents reported on their concerns, monitoring, and management projects driven by climate change happening in their wilderness. Respondents also discussed whether and how these activities affected wilderness character. This is the first study to characterize the response to climate change …

This thesis presents findings from research conducted in Southern Kyrgyzstan, which followed nongovernmental organization (NGO) efforts to support climate change adaptation, and to support more “resilient” community-managed irrigation systems. Findings suggest that current NGO partnerships with Water User Associations (WUAs) frequently amount to financial and technical transactions, to preserve inherited infrastructure and resist disturbance. “Enhancing resilience” is pursued in an effort to maintain existing technical configurations of canals and water resources, despite altered socio-political and environmental conditions. Findings suggest increasing disassociation between irrigation constituents and the institutions and managers that are supposed to direct their grievances through legitimate democratic channels. …

Changes in climatic and demographic trends are sparking renewed interest in cities generally and sustainable communities particularly. On the one hand, residents and workers in denser, mixed-use neighborhoods served by transit have half the carbon footprint of those in spread-out suburban areas. On the other hand, many of the smaller households that characterize the nation’s growing population prefer to live in precisely those compact, mixed-use neighborhoods. Efforts to develop extensive forest-based climate change vulnerability assessments have informed proposed management and policy options intended to promote improved on-the-ground policy outcomes. These assessments are derived from a rich vulnerability literature and are helpful in modeling complex ecosystem interactions, yet their policy relevance and impact has been limited. We argue this is due to structural-functional logic underpinning these assessments in which governance is treated as a procedural “black box” and policy-making as an undifferentiated and unproblematic output of a political system responding to input changes and/or system prerequisites. This study investigated a terrestrial climate proxy, phytoliths, as a complimentary approach to documenting the dynamics of present and past vegetation on Sanak Island, the largest island in a small island group in the eastern Aleutian archipelago, and as a new basis by which to interpret Holocene environmental variability in Alaska. A phytolith reference collection was established from 59 selected plant species of maritime tundra belonging to 27 families. The grass species and a sedge species produced abundant phytolith forms whereas the majority of dicotyledons in this study were trace producers of phytoliths. What, is truly "environmental" about environmental law? This Article is the first attempt to answer this question by integrating Law & Literature scholarship with the study of environmental law. I argue that competing narratives of nature and culture common to the American environmental imagination play a more significant role in environmental law and litigation than previously acknowledged. These competing narratives, communicated through a known set of environmental stories and tropes, are used by attorneys to establish, frame, narrate and argue their cases, and they are absorbed, reimagined, reframed and retold by judges in their written opinions, making environmental law a …

While there are several studies on the distribution ofVibrio vulnificusandVibrio parahaemolyticusin estuarine waters around the world, there is little information on the distribution of both organisms in South Carolina waters. Monthly sampling of surface and bottom water from 9 sites in Winyah Bay was conducted over the period April-October 2012. Both organisms were enumerated on CHROMagarVibriomedia. TheVibriocounts obtained were mainly less than 20 Colony Forming Units (CFU)/ml which is typical for what was found elsewhere along the coast of the Carolinas. Fundamental differences in the distribution of oceans and landmasses in the Northern and Southern Hemispheres potentially impact patterns of biological diversity in the two areas. The evolutionary history of conifers provides an opportunity to explore these dynamics, because the majority of extant conifer species belong to lineages that have been broadly confined to the Northern or Southern Hemisphere during the Cenozoic. Incorporating genetic information with a critical review of fossil evidence, we developed an age-calibrated phylogeny sampling ∼80% of living conifer species. The accuracy of our knowledge about the total CO2 content of the atmosphere, its growth and seasonal variations depends on the size of geographic coverage of the CO2 monitoring network. A good opportunity to enhance the monitoring network arose recently due to the launch of the Greenhouse gases Observing Satellite (GOSAT). Climate models and studies indicate that the changes in the northern latitudes will be serious and accelerated. Climate warming may impact structures in the northern latitudes through permafrost settlement affecting the performance of infrastructure and increasing costs for maintenance. The material presented is organized in three main chapters. Chapter 1 describes the motivation for the research. Chapter 2 addresses the permafrost settlement hazard in Alaska. I developed the Permafrost Settlement Hazard Index, which considered anticipated climate warming and ecological characteristics which regulate permafrost settlement. In the Pacific Northwest, warming climate has resulted in a lengthened growing season, declining snowpack, and earlier timing of spring runoff. This study characterizes the impact of climate change in two basins in Idaho, the Spokane River and the Boise River basins. We simulated the basin-scale hydrology by coupling the downscaled precipitation and temperature outputs from a suite of global climate models and the Soil and Water Assessment Tool (SWAT), between 2010 and 2060 and assess the impacts of climate change on water resources in the region. For the Boise River basin, changes in precipitation ranged from −3.8 to 36%. …

This Article argues courts should apply a relatively liberal approach in deciding standing issues for private plaintiffs pursuing climate change suits even if courts ultimately conclude that it is inappropriate to grant relief on the merits to those same plaintiffs because the Supreme Court has clearly declared that standing is a preliminary question that should be treated separately from decisions on the merits and standing causation requires less proof than proximate causation on the merits. While a growing scientific consensus recognizes that anthropogenic greenhouse gas emissions are contributing to the global phenomenon known as climate change, little progress has been made to pass comprehensive legislation addressing climate change. Many concerned with the effects of climate change have turned to the American court system as a means of addressing climate change or reducing greenhouse gases. Climate change management involves strategies that mitigate its causes and adapt human communities to its consequences. This article describes a legal strategy that does both: a national biological sequestration policy. This policy will increase the amount of carbon dioxide emissions that biological sequestration currently removes from the atmosphere and will enable human settlements to adapt to the harsh effects of a changing climate, while realizing a number of other objectives that preserved open space preservation achieves. Oriental rugs contaminated with Category 3 floodwater potentially harbor environmental bacteria known to be human pathogens. River water inoculated with three species of gram positive and gram negative environmental bacteria (Escherichia coli, Enterococcus faecalis, Pseudomonas aeruginosa) were used to assess the effectiveness of disinfectant type, cleaning methodology and drying practices by examining the survival rates of bacteria. Rug sections were immersed for one hour in contaminated water, saturated in one of three EPA registered disinfectant products (Phenol, Quaternary chloride, and Thyme oil) or tap water as a control, followed by cleaning and drying. The U.S. Supreme Court by an equally divided vote offour to four affirmed the Second Circuit's decision finding standing and jurisdiction in the case in American Electric Power Co. v. Connecticut. While not binding as precedent beyond the Second Circuit,the case offers clues to how the Court is likely to rule in future standing cases. Climate change affects the water available in a region. It also affects the water demand, because of the increase in temperature. A system dynamics model was developed for the Colorado River Basin (CRB), operating at a monthly time scale, to assess the potential impacts of climate change on streamflow in the Colorado River and its subsequent impact on the water resources management in the Las Vegas Valley (LVV). This article identifies the current state of knowledge in the literature regarding the possible impacts of future climatic change on archaeological sites and ensembles. Drawing on the literature review a matrix of potential impacts is collated to provide a simplified overview. This theoretical ‘menu’ is then tested by applying it to a vulnerability assessment of the World Heritage site of Skellig Michael in Ireland. The case study results reveal some knowledge gaps, particularly in regard to the impacts of climate change on buried archaeological remains.

This paper presents an empirical analysis of the effects of global warming on Nigerian agriculture and estimation of the determinants of adaptation to climate change. Data used for this study are from both secondary and primary sources. The set of secondary sources of data helped to examine the coverage of the three scenarios (1971-1980; 1981-1990 and 1991-2000). The primary data set consists of 900 respondents’ but only 850 cases were useful. The objective of this research study was to evaluate the consequences of climate change on shifts in distributions of plant species and the vulnerability of the species in Peninsular Thailand. A sub-scene of the predicted climate in the year 2100, under the B2a scenario of the Hadley Centre Coupled Model, version 3 (HadCM3), was extracted and calibrated with topographic variables. A machine learning algorithm based on the maximum entropy theory (Maxent) was employed to generate ecological niche models of 66 forest plant species from 22 families.
