This thesis examines how United States immigration policy transformed after September 11, 2001 and asks whether modern immigration enforcement remains consistent with constitutional principles, human rights protections, and the broader ideals associated with the American Dream. The project investigates how immigration shifted from a primarily civil administrative system into one increasingly defined by surveillance, detention, and punishment. The central question guiding this research is whether the securitization of immigration has reshaped not only enforcement practices, but also the meaning of constitutional protections and human dignity for both citizens and noncitizens.

This thesis examines why Chechnya’s independence movement shifted from a secular nationalist struggle in the First Chechen War (1994–1996) to a religiously framed insurgency in the interwar period and Second Chechen War (1999–2000; 2007). Drawing on presidential speeches, interviews, archival materials, and secondary scholarship, it argues that religious radicalization cannot be explained solely by external influence or Russian military brutality. Instead, three underexplored variables–strategic economic appeals to the Islamic world, culturally-embedded practices of vengeance, and the enabling conditions of poverty and mass armament–collectively shaped this transformation. According to Fredric Jameson’s Postmodernism, or, The Cultural Logic of Late Capitalism (1991), postmodern culture functions as an expression of the logic of late capitalism, manifesting in stylistic pastiche, the dominance of spectacle, a waning of historical consciousness, and a corresponding erosion of affect. Central to Jameson’s critique is the contention that postmodernism forecloses the possibility of imagining alternatives to capitalism. This article argues that Piersandro Pallavicini’s Il mostro di Vigevano (1999) exemplifies some of these features, and it shows how its description of immigrants to Italy as ingenuous, innocent, and simple-minded insinuates that they come from backward places …

From the beginning of its operation as fundamental law for the government of the United States, the Constitution has continually operated as supreme and judicially enforceable positive law. This is the principal claim I offer as an “original-law originalist” in response to contrary claims advanced by Professor Jonathan Gienapp in Against Constitutional Originalism: A Historical Critique. Gienapp argues in Against Constitutional Originalism that “[h]istoricizing the original Constitution . . . poses a foundational challenge to originalism as it has long been conceived.”2 Constitutional originalism depends on perceived continuity with the past. Since the earliest days of the republic, Congress has empowered private plaintiffs—called qui tam relators—to bring claims in court on behalf of the United States. Today, qui tam litigation accounts for billions of dollars in judgments and settlements each year. But despite qui tam’s modern significance and historical pedigree, its constitutionality has recently been questioned. To wit, several sitting Supreme Court Justices have suggested that qui tam violates the President’s Article II authority because it empowers private relators—who are neither appointed nor supervised by the President—to enforce federal law. The article argues that the Supreme Court's decision in United States v. Miller was wrongly decided because it failed to recognize that sovereign immunity is waivable and does not protect the government when it trespasses upon preexisting property rights. The analysis contends that fraudulent transfer claims are quasi in rem actions, meaning the sovereign is subject to the incidental procedures of bankruptcy once enmeshed in such proceedings.

Assignments of rents are a common feature of commercial real estate financing in New York. In connection with a mortgage or other secured loan, a borrower that owns income-producing property typically grants the lender an assignment of rents as additional security, entitling the lender to rental income generated by leases at the property upon the borrower’s default. These assignments are intended to protect the lender’s interest by providing an alternative source of repayment and by limiting the borrower’s ability to divert rental income during periods of financial distress.

The Bankruptcy Code establishes a tiered priority system for the payment of unsecured claims, governing the order of distribution when there are insufficient assets to pay all creditors in full. The priority system is fundamental to the operation of the Bankruptcy Code because in most bankruptcy cases, the debtor lacks adequate assets to fully pay all creditors. Cholera is currently on its seventh global pandemic, disproportionately affecting developing countries. Vibrio cholerae, the bacterial etiologic agent, is able to cause infection by adhering to intestinal epithelial cells and secreting cholera toxin (CT), an AB-type exotoxin that dysregulates signaling pathways. Previous research by the Teter lab has shown that Hsp90, a host cytosolic chaperone, is required for CT to enter the cytosol where it produces toxic effects. Hsp90 binds to CT at two specific motifs, RPPDEI and LDIAPA. The prolines in the RPPDEI motif are essential for binding, but the proline in the LDIAPA has yet to be …

This study examines whether frequently used correctional assessment instruments adequately capture the psychological impacts of maternal-child separation among incarcerated women. This research was conducted in response to growing criticisms that traditional risk and needs assessments fail to account for gender-specific experiences, specifically those related to caregiving roles and pregnancy. While civilian protests dominate historical narratives of the era, the impact of active-duty sailor resistance remains underexplored. John Rawls sought to articulate principles for a just democratic society. Those principles must be justified by reasons that could be accepted by all reasonable citizens, regardless of their personal philosophical, religious, or moral commitments—what Rawls refers to as public reason. Basic political concepts, such as citizenship and rights, must also be justified in terms of public reason. Rawls stipulates that citizens enter society at birth, a claim that shapes his answer to whether legal protections for the unborn are justified. This study aimed to explain how food delivery platform riders experience objectification in the context of platform-based work, with particular attention to how organizational practices and leadership shape experiences of marginalization, dignity, and voice. A qualitative design was employed using Descriptive Phenomenological Analysis. In-depth interviews were conducted with nine food delivery platform riders to describe the essential structures of their lived experiences of objectification. Subaltern Theory was used as an interpretive lens in making sense of the findings. The chapter maps contemporary approaches to the Right to Repair along a spectrum from decentralised freedoms to centralised standard setting and product design. Decentralised approaches propose a Right to Repair that resembles a 'negative right' in that it protects user autonomy through dismantling legal and market barriers. Centralised repairability models, on the other hand, align more with a positive right that is built through stringent product design standards, obligations on manufacturers to repair products directly, and situate repair within larger circular economy governance models.

This article explores the reception of international human rights law(IHRL)in Canada. Focusing on the Charter context, it demonstrates that how IHRL applies in Canada continues to lack clarity despite repeated (and recent) efforts by the Supreme Court of Canada to provide it. This article argues that this lack of clarity is an important matter for the Court to address, particularly as IHRL is increasingly being invoked before courts and other tribunals around the world. This report examines a men’s ceremonial hanbok from the May Weber Ethnographic Study Collection, attributed to South Korea in the mid-twentieth century. It discusses the garment’s materials, construction, and decorative techniques, as well as its function as wedding attire. The report situates the object within the historical context of Joseon dynasty court dress, particularly dallyeong robes, and analyzes its symbolic motifs, including crane rank badges. It also considers issues of attribution, provenance, and the broader cultural significance of hanbok in relation to class, tradition, and modern production.

Breast cancer is the leading cause of cancer-related mortality in African American (AA) women. In this study we evaluated the serum proteomic profile of AA women with breast cancer using an integrated proteomic framework with multivariate pattern analysis. Using 2D-DIGE, thousands of serum protein spots were detected across 33 gels; 46 spots met criteria for presence, statistical significance, and differential expression. Proteins from the spots were identified by MALDI-TOF/TOF and matched in curated databases, highlighting serum biomarkers including ceruloplasmin, alpha-2-macroglobulin, complement component C3 and C6, alpha-1-antitrypsin, alpha-1B-glycoprotein, alpha-2-HS-glycoprotein and haptoglobin-related protein. LC-MS/MS analysis revealed 163 differentiating peptides after imputing and …

One critical dispute surrounding the rights of LGBTQ people and societal recognition of their existence is the legal debate regarding very different types of gender therapy. On the one hand, several states have banned the provision of gender-affirming medical care to transgender youth, positing that it is a dangerous form of mutilation. A separate set of states has banned the practice of so-called gay or gender conversion therapy that seeks to transform youth away from their queer identities, concluding that it is a form of abuse. The law endows corporations and other business organizations with the awesome power of perpetual life—unless the charter expressly provides for a certain duration, such as ten years. But does anyone ever actually choose limited life? Why would they?

This article reveals that limited-life business entities—finite ventures—play a significant and underappreciated role in modern commerce. Private equity and venture capital funds, SPACs, and insurance syndicates are all organized with a limited lifespan.
