The Right To Share: Affording Americans Meaningful Control Over Their Data, Kevin Frazier Jan 2026

The Right To Share: Affording Americans Meaningful Control Over Their Data, Kevin Frazier

Minnesota Journal of Law, Science & Technology

Americans today face unprecedented opportunities to leverage their personal data for health, education, and economic benefit; yet state and federal privacy laws increasingly restrict their ability to do so. This Article argues that the prevailing regulatory paradigm—rooted in paternalism, behavioral assumptions, and a deep distrust of both firms and individuals— has produced a system that paradoxically denies people meaningful control over their own information. As artificial intelligence tools grow more capable, the inability of individuals to share data freely threatens to entrench inequities, concentrate access to high-quality AI systems among the wealthy, and accelerate the formation of an “AI abyss” …

From Data To Decisions: Why Ai Inferences Should Count As ‘Effects’ Under The Fourth Amendment, Susan Tanner Jan 2026

From Data To Decisions: Why Ai Inferences Should Count As ‘Effects’ Under The Fourth Amendment, Susan Tanner

Minnesota Journal of Law, Science & Technology

This Article argues that AI-driven microtargeting, enabled by large-scale data brokerage and increasingly acquired by government actors, creates a dual constitutional problem. First, it undermines Fourth Amendment protections through what has become known as the ‘data broker loophole.’ Second, it amplifies inequality and civic distortion by segmenting political information flows in ways that evade traditional constitutional checks and statutory privacy regimes. Building on Carpenter v. United States, Riley v. California, and United States v. Jones, this Article proposes a doctrinal framework that treats government acquisition of granular behavioral datasets and model outputs as ‘searches,’ even when intermediated by private actors, …

You'll Loan Nothing And Be Happy, Becky Chambers Jan 2026

You'll Loan Nothing And Be Happy, Becky Chambers

Minnesota Journal of Law, Science & Technology

Digital lending of eBooks offers flexibility to patrons, but it also exacerbates the existential threats libraries face. Libraries cannot own eBooks—they can only license and lend them on publishers’ terms—which means libraries are paying more for less. This is known as the “digital lending problem.” Access to older books is even more limited, as publishers and copyright holders rarely offer them as eBooks, creating the “20th century book problem.” These problems are chilling libraries’ creative approaches to digital lending and are further exacerbated by the Trump Administration’s attacks on libraries and the continuing effects of the COVID-19 pandemic. These developments …

Trends In Pharmaceutical Patent Settlements Since Actavis And Private Plaintiffs' Causation Requirement, Kelly Lear Nordby Jan 2026

Trends In Pharmaceutical Patent Settlements Since Actavis And Private Plaintiffs' Causation Requirement, Kelly Lear Nordby

Minnesota Journal of Law, Science & Technology

In January 2025, the U.S. Federal Trade Commission (FTC) reported that a new form of “possible compensation” from brand drug manufacturers to generic (or biosimilar) manufacturers, specifically “quantity restrictions,” has become “increasingly prevalent” in pharmaceutical patent settlement agreements filed with FTC under the Medicare Prescription Drug, Improvement, and Modernization Act of 2003. As the FTC noted, “quantity restrictions” may reduce the settling firm’s incentives to compete, resulting in supracompetitive prices for the brand and generic drug. This article summarizes trends in pharmaceutical patent settlement agreements and reverse-payment antitrust litigation since the Supreme Court’s landmark decision in FTC v. Actavis. Focusing …

Hyperscalers In The Heartland: How A Climate-First Framework Can Incentivize Sustainable Data Center Development And Grid Decarbonization, Eli Dotson Jan 2026

Hyperscalers In The Heartland: How A Climate-First Framework Can Incentivize Sustainable Data Center Development And Grid Decarbonization, Eli Dotson

Minnesota Journal of Law, Science & Technology

This Note proceeds in three parts. Part II surveys the rise of AI and hyperscale data centers, the technical and legal challenges their loads pose, and the evolving policy landscape, both nationwide and in Minnesota. Part III argues that Minnesota should build on its emerging data center framework in two ways. First, the PUC should institutionalize the framework’s most promising features by setting a “clean energy floor” to ensure that data centers contribute to, rather than prevent, the decarbonization of Minnesota’s grid. Second, the PUC should create an additional “distributed flexibility pathway” by forcing utilities to consider alternative ways of …

Many patients with advanced solid tumors ultimately develop resistance to conventional therapies, with especially limited options for those experiencing rapid progression or poor performance status, highlighting the need for personalized immunotherapies capable of inducing durable responses. In this retrospective case series, we describe the clinical course and outcomes of five adults (4 male, 1 female; median age 51 years [range, 39-62]) with metastatic solid tumors who achieved complete and durable remission following doubly loaded autologous dendritic cell therapy after failure of standard treatments, such as immune checkpoint inhibition, radiation, surgery, or endocrine therapy. Five patients, including prostate adenocarcinoma (n=1), malignant …

Reconstituting A Constitution, And A Republic: The Architecture Of Authoritarian Rule, J. Maria Glover Jan 2026

Reconstituting A Constitution, And A Republic: The Architecture Of Authoritarian Rule, J. Maria Glover

Georgetown Law Faculty Publications and Other Works

A constitution can be remade without tearing it down, or even changing a single word. It is done by law. It is being done now—by the Supreme Court.

In each case, real people win, real people lose, real people suffer. Outcomes matter. But across the span of cases, the Court is tearing down our constitutional order of divided power—taking authority from the courts below, from Congress, the agencies, the states, and us, the people—and building a structure of unchecked power in itself. Procedure and remedies are constitutive of the judicial power. In a time of authoritarian threat, they are the …

Five Promises More Powerful Than Fear, Trevor A. O'Reggio Jan 2026

Five Promises More Powerful Than Fear, Trevor A. O'Reggio

All Books

The genesis of this book grew out of an unforgettable experience with students from the SDA Seminary at Andrews University during the summer of 2023, when we traveled to Zambia to conduct a series of evangelistic meetings. Each day, I encouraged the students to memorize and recite Isaiah 41:10 as a source of courage, strength, and inspiration. That powerful verse became a daily reminder that God’s presence is greater than any fear or challenge we may face.

After returning from Zambia, I felt impressed to preserve the impact of that experience by writing this small book based on Isaiah 41:10. …

The Civil Justice Business, J. Maria Glover Jan 2026

The Civil Justice Business, J. Maria Glover

Georgetown Law Faculty Publications and Other Works

Our civil justice system rests on foundational commitments: to make rights real for those the law protects, whatever their station; to hold wrongdoers accountable, whatever their power; and to deter misconduct in a system that depends heavily on private enforcement. We put great faith in these values.

Civil justice, for all its lofty goals, is also a business. Attorneys and liability insurers have long held economic stakes in litigation, bounded by their own professional and regulatory norms. Now, a new litigation finance industry has arisen: outside investors supply equity capital—divorced from legal representation and liability management—and take returns directly from …

The Effect Of Coercive Control With Digital Devices On Emotion Regulation In Preschool-Age Children: An Experimental Approach, Gina Burroughs Jan 2026

The Effect Of Coercive Control With Digital Devices On Emotion Regulation In Preschool-Age Children: An Experimental Approach, Gina Burroughs

UNF Graduate Theses and Dissertations

The experiment was an investigation on the differences in child emotion regulation between two groups during a disappointing gift task. Fifteen four-to-five-year-olds were randomly assigned to either receive coercive control with a digital tablet or an emotion-coping intervention. All children received a disappointing gift a second time as emotion regulation strategies (cognitive reframing, self-soothing, comfort-seeking) were recorded. A χ2 test revealed a nonsignificant difference between frequency of post-manipulation emotion regulation strategies. Three cognitive-reframing subtypes were coded and an independent-samples t-test revealed between-group differences approaching significance, suggesting that adults can teach cognitive reframing to this age range. Additional analysis revealed …

Objective: Screening is an effective tool for detecting colorectal lesions in asymptomatic subjects. There is a positive correlation between fecal immunochemical test (FIT) values and the size of tumors. Despite the efficacy of screening, the detection of colorectal cancer (CRC) remains low. The primary objective was to evaluate the best FIT cutoff value for detecting advanced adenomas and CRC among individuals at average risk in a country with a high incidence and morbidity from CRC.

Methods: This observational and prospective study analyzed consecutive cases in 1461 asymptomatic subjects with a positive FIT (≥ 100 ng hemoglobin [Hb]/ mL) referred for …

Gendered Punishment? How The Corruption Of Female Politicians Affects Public Opinion Of Female Political Leadership, Byung-Deuk Woo, Mi-Son Kim, Tracy Osborn Jan 2026

Gendered Punishment? How The Corruption Of Female Politicians Affects Public Opinion Of Female Political Leadership, Byung-Deuk Woo, Mi-Son Kim, Tracy Osborn

Political Science Faculty Publications

Does the corruption of a woman politician decrease public support for other women political leaders? To answer this question, this article examines how the impeachment of Park Geun-hye, the first female president of South Korea, affects people’s perceptions of women’s political leadership in South Korea. We argue that in South Korea, the high-level political corruption scandal of the first woman president led to lower evaluations of women’s political leadership because of the intense and gendered media coverage of Park’s failure. Using the two waves of the World Values Survey conducted in South Korea before and after Park Geun-hye’s impeachment in …

Let Them Hear It: Peaceful Protests Near The Homes Of Supreme Court Justices, Srikanth Reddy

Lewis & Clark Law Review

All of us—not just attorneys and politicians—need to be more critical and skeptical of the Supreme Court. Criticism by ordinary people is good and appropriate, even if it hurts the Justices’ feelings. That includes public protests. When a case matters enough to them, members of the public can and should criticize the Court and its Justices, including by peacefully gathering and protesting near a Justice’s home, or when a Justice appears out in the world.

Surface Marker Identification To Capture Live Circulating Tumor Cells In Metastatic Triple-Negative Breast Cancer, Bree M Lege, Khushali J Patel, Brendan Panici, Ping Gong, Michael T Lewis, Matthew J Ellis, Chonghui Cheng

Faculty, Staff and Students Publications

Metastatic triple-negative breast cancer (TNBC) is highly aggressive and lacks targeted therapies. Circulating tumor cells (CTC) are invaluable for monitoring metastatic tumor progression and treatment response but are difficult to capture because of their rarity and heterogeneity. Surface-based staining for live CTCs is essential to preserve RNA quality in single cells, but current markers tend to perform poorly on more mesenchymal tumor cells such as TNBCs. To enhance live TNBC CTC detection, we developed a workflow for live CTC capture and single-cell RNA sequencing (scRNA-seq). Using a mouse model of metastatic TNBC, we identified four new CTC surface markers, AHNAK2, …

Centrosomes play a fundamental role in nucleating and organizing microtubules in the cell and are vital for faithful chromosome segregation and maintenance of genomic stability. Loss of structural or functional integrity of centrosomes causes genomic instability and is a driver of oncogenesis. Here we identify lysine demethylase 4A (KDM4A), an epigenetic 'eraser' of chromatin methyl marks, as a centrosome-localized protein, visualized at the nanometer-scale resolution. We additionally uncovered that KDM4A demethylase enzymatic activity is required to maintain centrosome homeostasis and integrity; a previously unknown functionality unlinked to altered expression of genes regulating centrosome number. We find that KDM4A interacts with …

Unraveling Posttranslational Modification Complexity: Advances In Quantitative Histone Proteoform Mass Spectrometry, Karl F Poncha, Alyssa T Paparella, Nicolas L Young

Faculty, Staff and Students Publications

Histone proteins and their posttranslational modifications are central to chromatin structure and function. These modifications often occur in combinations, generating a diverse array of histone proteoforms that contribute to the dynamic regulation of chromatin architecture. Advancements in mass spectrometry-based proteomics, particularly top-down and middle-down approaches, have significantly enhanced our ability to characterize these proteoforms and elucidate PTM crosstalk. This review provides an analysis of the epigenetic machinery involved in the addition, recognition, and removal of histone PTMs, emphasizing the complexity introduced by histone variants and combinatorial PTM patterns. We examine the challenges and limitations of traditional antibody-based methods for PTM …

There is growing recognition of the need for human-based models of the nervous system and its diseases. Studies have investigated the electrophysiological properties of neurons in ex vivo human brain tissue, but the maintenance of other cell types remains unclear. We therefore used single-nucleus RNA sequencing of six patient samples to determine how well various cell types maintain their transcriptional identities over two weeks in organotypic slice culture (day 0, with 83 501 nuclei, and day 14, with 45 738). For each patient sample (two pediatric temporal lobectomies, one adult frontal cortex, two glioblastomas, and one medulloblastoma), we generated correlations …

Astrocytes play essential roles in the brain, and their dysfunction is associated with nearly every form of neurological disease. Despite their ubiquity, knowledge of how astrocytes contribute to disease pathogenesis is incomplete; accordingly, harnessing their biology toward therapeutics remains a major challenge. Here we show that the transcription factor Sox9 plays a context-specific role in maintaining astrocyte function and circuit activity in the aging hippocampus and Alzheimer's disease (AD) models. We found that Sox9 overexpression in astrocytes in AD models clears existing amyloid beta (Aβ) plaques and preserves cognitive function. Mechanistically, Sox9 promotes the phagocytosis of Aβ plaques by astrocytes …
