Five Lessons From Ken Kersch’S Conservatives And The Constitution For The Present Moment, James E. Fleming, Linda C. Mcclain
Five Lessons From Ken Kersch’S Conservatives And The Constitution For The Present Moment, James E. Fleming, Linda C. Mcclain
Faculty Scholarship
Timothy Snyder’s On Tyranny, a New York Times bestseller, has the subtitle, “Twenty Lessons from the Twentieth Century.” Ken Kersch’s Conservatives and the Constitution: Imagining Constitutional Restoration in the Heyday of American Liberalism (2019) provides at least twenty lessons from the second half of the Twentieth Century about the development of conservative constitutional thought and activism. Although conservatism has changed in many ways since the 1954-1980 period on which Kersch’s book focuses, these lessons are relevant for understanding the present political moment, filled with concerns that the U.S., during the second Trump Administration, is lurching toward tyranny, authoritarianism, and …
The Punishment Paradox, Steven Arrigg Koh
The Punishment Paradox, Steven Arrigg Koh
Faculty Scholarship
What does criminal punishment do? Across centuries of criminal legal thought, a shared answer persists: punishment incapacitates the wrongdoer. And yet punishment sometimes yields its opposite. Paradoxically, punishment sometimes becomes a rallying point-expanding community identification and solidarity around the defendant. This Article shows this punishment paradox using the 2023-24 prosecutions of President Trump and recent and historical case examples-from Luigi Mangione to Karen Read to Rosa Parks. By arguing that criminal law can generate solidarity rather than stigma, the Article both rethinks foundational theories of punishment and reconsiders the role of criminal law in democratic politics. Such an approach transcends …

Drag’s Impact On Drag Lives
In light of recent political developments where Drag and Trans identities are being punished, why do people still participate in Drag? If there are repercussion to face for being a Drag Queen, then surely it must affect their lives for the better for them to continue the practice.
Through an autoethnographic approach to researching the Portland, OR Drag community, I collected transcripts of conversations with local Queens, took notes of community interactions, and put myself in Drag for the first time as a Queer man to better understand the Drag community and why they Drag. …

Text is a vehicle to convey information that reflects the writer’s linguistic style and communication patterns. By studying these attributes, we can discover latent insights about the author and their underlying message. This article uses such an approach to better understand patent applications and their inventors.
While prior research focuses on patent metadata (i.e., filing year or gendered inventor names), we employ machine learning and natural language processing to extract hidden information from the words in patent applications. Through these methods, we find that inventor gender can often be identified from textual attributes—even without knowing the inventor’s name. This ability …

Who's Afraid Of Copyright And Ai?, Deborah R. Gerhardt
Faculty Publications
Copyright and AI need not be a copyright no man’s land. Recent decisions by the Copyright Office have gotten so much media attention that many creators are unsure if they can secure copyright protection if they use AI as a creative tool. The proposed creative control paradigm can help us all tackle the challenge of determining when works created with the assistance of AI are copyrightable. Instead of relying on long-established nuanced precedent for protecting works generated with new technology, the Copyright Office asserts that any content generated with assistance from AI tools is unprotectable. This position is radically inconsistent …
Adolescent Relationships With Digital Actors And Their Influence In A Classroom Setting: An Interpretive Case Study, Kerry A. Hancock
Adolescent Relationships With Digital Actors And Their Influence In A Classroom Setting: An Interpretive Case Study, Kerry A. Hancock
Theses and Dissertations--Curriculum and Instruction
In this post-COVID-19 society students are strongly influenced by their use of digital text and electronic devices. The assumption of the study was that if students spend time with devices and digital text that it might be possible for them to develop relationships with the non-human actors that exist as part of the learning environments in schools. This interpretive case study rooted, in Posthumanist ideology, used Latour’s Actor Network Theory to approach data collection.
A comparative approach was adopted for this interpretive case study research and data were collected in three stages: initial classroom observation and analysis to determine the …

Industry To Classroom: The Role Of Academic Program Consultants In Building Self-Efficacy Among Occupation-Based Career And Technical Education Teachers, Erica L. Settelen
Theses and Dissertations--Educational Leadership Studies
Occupation-based career and technical education (CTE) teachers bring industry expertise to secondary classrooms but often begin teaching without traditional pedagogical preparation or familiarity with public school systems. In Kentucky’s New Teacher Institute (NTI), academic program consultants (APCs) provide program-area support to strengthen induction. Using the framework of self-efficacy and guided by Ivankova’s mixed methods action research (MMAR) framework, this study examined how occupation-based CTE teachers perceived APC engagement during induction and how APC-created asynchronous supports were experienced.
In the Reconnaissance Phase, a sequential Quantitative → Qualitative design included an initial survey followed by interviews. Survey results indicated midrange familiarity with …

Recruitment Messaging, Authenticity, And Representation: A Mixed Methods Action Research Study In A Public School System, Chavis A. Sims
Theses and Dissertations--Educational Leadership Studies
This study employed a Mixed Methods Action Research (MMAR) design to examine recruitment communication within a public school system facing persistent underrepresentation of minority educators. Recruitment prototypes were developed in collaboration with district leadership and evaluated in a formative pilot involving 15 educators who provided Likert-scale ratings and written feedback on clarity, cultural relevance, persuasiveness, and engagement. Quantitative findings indicated that messaging emphasizing professional purpose and pathways into teaching was perceived as clear and engaging. In contrast, cultural relevance consistently received the lowest ratings across prototypes. Qualitative responses revealed that reliance on non-local and AI-generated imagery weakened perceived authenticity and …
Perceptions Of Sport Psychology Efforts And Access In Women's Wheelchair Basketball, Lindsay C. Cohen
Perceptions Of Sport Psychology Efforts And Access In Women's Wheelchair Basketball, Lindsay C. Cohen
Theses and Dissertations--Kinesiology and Health Promotion
As the field of sport psychology grows, services and training programs must evolve to properly serve the evolution of athletes seeking care. This could mean discovering new measures, testing different types of interventions, or developing programs that can better accommodate specific populations that are looking for sport psychology services. One such population is para athletes, and although they have expressed interest in learning more about the field of sport psychology and how to implement mental skills efficiently, athletes have reported a lack of access to sport psychology services and sport psychology consultants (SPCs) (Dieffenbach et al., 2009). The purpose of …
Unveiling The Shadows: An Exploratory Study On Ghostwriting, Gray Markets, And The Ethics Of Contract Cheating, Micah Crawford
Unveiling The Shadows: An Exploratory Study On Ghostwriting, Gray Markets, And The Ethics Of Contract Cheating, Micah Crawford
Theses and Dissertations--Educational Policy Studies and Evaluation
Contract cheating has become an increasingly complex challenge for higher education, particularly as digital platforms, global academic labor markets, and generative artificial intelligence reshape the production and detection of academic work. While much of the existing literature examines contract cheating from the perspectives of students, faculty, and institutions, less attention has been given to the individuals who produce ghostwritten academic work. This dissertation addresses that gap by exploring how shadow scholars understand their roles, ethical boundaries, and participation within the academic integrity ecosystem.
Using an exploratory qualitative design, this study draws on twelve semi-structured narrative interviews with six freelance academic …

Leadership Perceptions In Mid-Major Ncaa Athletics: Exploring Women's Teams Head Coaches' Experiences With Athletic Department Senior Staff, Sydnie A. Steele
Theses and Dissertations--Education Sciences
Leadership practices within NCAA Division I athletic departments can shape the professional climate, well-being, and stability of the coaching staff. Yet, limited research has explored how senior administrators influence the experiences of coaches who lead women’s teams at mid-major institutions. This phenomenological inquiry study explored how head coaches interpret their interactions with senior athletic department staff and how these relational dynamics inform perceptions of support.
Twelve Division I head coaches participated in semi-structured Zoom interviews about their experiences at former institutions. The interview protocol integrated the LMX-7 framework with open-ended questions to capture the significance of the head coaches’ lived …

Critical Discourse Analysis Of Nil Policies: Examining Institutional Control And Economic Opportunities For Division I Football Athletes In Power Four Universities, Allen T. Alvarez
Theses and Dissertations--Educational Policy Studies and Evaluation
The adoption of Name, Image, and Likeness (NIL) policies has redefined the economic landscape of collegiate athletics, expanding opportunities for student-athletes and reshaping institutional authority. This dissertation nvestigates how NIL policy language at Division I universities frames economic possibilities for football student-athletes and sustains systems of governance. Through a Critical Discourse Analysis of policy documents from Power Four and mid-major institutions, this study reveals that NIL participation is persistently conditioned by institutional approval, compliance monitoring, and ambiguous definitions, especially regarding boosters and collectives.
Policy language presents NIL as an opportunity but embeds institutional control through oversight structures. The analysis further …
Contractual Democracy From Statehouse To School Board: Shifts In Legislation And School Board Authority In Kentucky, Hannah M. Edelen
Contractual Democracy From Statehouse To School Board: Shifts In Legislation And School Board Authority In Kentucky, Hannah M. Edelen
University of Kentucky Doctoral Dissertations
School boards have long been regarded as a cornerstone of American democracy, providing local governance over public education. While considerable scholarship highlights the increasing involvement of state and federal governments in education, relatively few studies examine with specificity how legislatures shape the local authority of these governance structures. This study investigates how the Kentucky State Legislature has influenced the authority of local school boards over three legislative sessions (2020–2022) and how board members perceive their evolving role. Using a multi-method approach and conceptualized in principal-agent theory, this research contributes to understanding how legislatures shape the governing responsibilities of school boards …

Caring For Your Heart During Survivorship After Pediatric Cancer: A Visual Education Guide On Chemotherapy-Induced Cardiotoxicity, Bryona Rose Hamilton
Caring For Your Heart During Survivorship After Pediatric Cancer: A Visual Education Guide On Chemotherapy-Induced Cardiotoxicity, Bryona Rose Hamilton
Theses
Chemotherapy is an effective weapon in the fight against pediatric cancer. However efficient, treatment can lead to side effects that last long after a patient finishes their last round of chemotherapy. This thesis examines current research on chemotherapy-induced cardiotoxicity, a side effect of chemotherapy treatment caused by a class of chemotherapy drugs called Anthracyclines (such as doxorubicin and daunorubicin). While effective chemotherapy agents, these drugs have been known to cause late long-term heart damage when used to treat pediatric cancers such as Acute Lymphoblastic Leukemia (ALL), Acute Myeloid Leukemia (AML) and Pediatric Sarcoma. A written portion of this thesis project …
A Novel Nephron: 3d Visualization Of Glomerular Filtration In The Kidney, Cassie Young
A Novel Nephron: 3d Visualization Of Glomerular Filtration In The Kidney, Cassie Young
Theses
Renal physiology, particularly the process of glomerular filtration, remains one of the most conceptually challenging topics in medical education due to its microscopic scale, dynamic pressure relationships, and structural complexity. Understanding how plasma passes through the glomerular filtration barrier requires spatial reasoning across multiple levels—from the gross anatomy of the kidney to the ultrastructure of capillaries, podocytes, and the glomerular basement membrane. This thesis addresses these challenges through the development of a scientifically accurate three-dimensional (3D) animation that illustrates glomerular filtration within its anatomical and physiological context. Designed as a visual teaching aid, the animation aims to improve comprehension of …
Understanding Computer-Mediated Human Experience In Digital-Physical Hybrid Space, Jiangnan Xu
Understanding Computer-Mediated Human Experience In Digital-Physical Hybrid Space, Jiangnan Xu
Theses
With the rapid development of mobile and immersive technologies, the boundary between the digital and real world is increasingly blurred, giving rise to hybrid spaces. Hybrid spaces have permeated daily life and reshaped spatial meaning-making and social interaction. Despite their growing prevalence, empirical understanding of human experiences in hybrid spaces remains limited. If left unexamined, hybrid spaces risk becoming technology-centered rather than human-centered environments that overlook socio-cultural dimensions, potentially leading to harmful consequences for individuals and society. To investigate human experience in hybrid spaces, this thesis comprises five studies and uses gameful systems as research probes. Prior literature identifies collaboration …
Crypto Exchanges In Market Regulation, Yesha Yadav
Crypto Exchanges In Market Regulation, Yesha Yadav
Vanderbilt Law Review
The cryptocurrency market has proven notoriously challenging to regulate despite a decade during which it has gained in economic size, sophistication, and cultural impact. Even as repeated crises have left ordinary savers wiped out, regulation has shown itself to be woefully absent as a means of mitigating risks ex ante or helping cover the cost of damage ex post. This Article looks to break this deadlock by proposing a tried-and-tested solution: It argues that regulators should task crypto exchanges with providing oversight as self-regulatory organizations of the crypto market in which they play an anchoring role. It offers three supporting …
The Ideological Work Of Penal Reform: How Reformers Justify Penal-Welfare Hybridization, John Halushka, Brandon Miller
The Ideological Work Of Penal Reform: How Reformers Justify Penal-Welfare Hybridization, John Halushka, Brandon Miller
Faculty Research, Scholarly, and Creative Activity
This article uses the Santa Clara County Reentry Resource Center (RRC) as a case study to explore the cultural content of penal reform. Specifically, we explore the discourses that officials use to publicly justify projects of penal-welfare hybridization, or the linking of state systems of punishment and welfare to manage criminalized populations. Our qualitative analysis draws on a dataset consisting of county planning documents, budgets, videos, press releases, and newsletters published online between 2011 and 2023. By examining these materials over time, we are able to chart patterns of consistency and variation in how officials justify hybridization. We find that …

Objectives
Creating community is not only therapeutic—it has been described as essential. This study explores a process of community-building among people with lived and professional experience in the dementia field, during Walking the Talk for Dementia (WTD), a week-long, immersive event on the Camino de Santiago in Spain. Absence of community can lead to fragmented support for both people living with dementia and their care partners and for those working in the field. Achieving a sense of community, however, can be complex.
Methods
A qualitative evaluation was conducted with 79 participants from 27 countries, incorporating pre-, during and post-event reflections. …
Breaking The Cycle: Rethinking Bar Exam Scoring And Portability For Nextgen Examinees, Steven Foster, Nachman Gutowski
Breaking The Cycle: Rethinking Bar Exam Scoring And Portability For Nextgen Examinees, Steven Foster, Nachman Gutowski
Scholarly Works
The development of the NextGen Bar Exam presents a crucial opportunity to address longstanding challenges in both bar exam scoring and portability concerns. The reliance on recent graduates' performance on the Uniform Bar Examination (UBE) as a baseline for setting future standards is flawed due to relative scoring and scaling. In addition to concerns regarding how the future bar exam is scored, there are also concerns regarding how the new scoring metric on the NextGen bar exam will be used for portability and, more specifically, what will happen between 2026 and 2028 as the NextGen bar exam is progressively adopted …

This Essay examines how developments in neuroscience (or brain science) affect our views of law, medicine, ethics, and religion. Part I shows how lack of clarity about brain death can lead to premature organ donation. Part II argues that health care too often provides inadequate brain care and incomplete rehabilitation. Part III explains why recovery may be possible for those braininjured patients who are told it is not. Part IV demonstrates how the fear of a brain-injured patient oddly affects my perspective on Tort and Criminal Law, which are being influenced by neuroscientific advances. Part V examines the new developments …

Organ Chips And Translational Research: Identifying And Examining New Ethical Issues, Melanie Jeske
Center for Medical Ethics and Health Policy Staff Publications
Organ chips, also known as organ-on-a-chip devices, tissue chips, or microphysiological systems, have emerged over the last decade as a promising translational technology amidst growing concern about the translational crisis between laboratory research and patient bedside. Pointing to high rates of failure between nonhuman animal models and safety and efficacy in humans, organ chips and similar new approach methods have attracted substantial public and private investment. As human-cell-based alternatives to animal models, organ chips promise more predictive, efficient, and ethical platforms for pharmaceutical and toxicity testing. Engineered cultivation systems that enable cells to assemble into tissue-like structures (e.g. kidney, brain, …

People living with endometriosis, a disease in which tissue similar to the lining of the uterus grows elsewhere in the body, often experience prolonged diagnostic journeys because of symptom variability, normalisation of period pain and other symptoms, and lack of awareness of the condition. In this article, we analyse the endometriosis diagnostic journey through the lens of epistemic injustice. Drawing on in-depth interviews with 52 people living with endometriosis in the United States, we introduce the concept of diagnostic buck-passing to characterise the phenomenon wherein individuals who seek treatment for their symptoms end up stuck in a cycle of seeing …

The emergence and rapid adoption of digital health technologies (DHT) present unprecedented opportunities to democratize and reduce disparities in health care by monitoring health and disease at the point of care in all patients. However, limited access to DHT is becoming a major obstacle to realizing these goals. Access to DHT is influenced not only by well-recognized social determinants of health, but also by digital determinants of health, such as digital literacy and the need for broad access to digital infrastructure, as well as commercial and economic factors. Addressing these challenges and designing unbiased systems of care are essential to …
