This paper examines the impact of artificial intelligence (AI) and digital technologies on the financial technology (FinTech) industry and demonstrates how AI- enabled strategies are increasing the ability of businesses not only to grow, but also to better serve their customers through operational efficiencies. But as immersive as the technological advancements may be, they present challenges in connection with increasingly complicated licensing regulations and a constantly evolving technological landscape. We examine the way AI and algorithms are streamlining workflows, enhancing productivity and expanding access to financial resources for traditionally under – served populations. The paper also discusses the macroeconomic implications …

Does The Acquirer's Complexity Affect The Market Reaction To M&A Decisions?, Rajib Chowdhury, John A. Doukas Jan 2025

Does The Acquirer's Complexity Affect The Market Reaction To M&A Decisions?, Rajib Chowdhury, John A. Doukas

Finance Faculty Publications

We examine whether and how acquiring firms' complexity affects investor perception at the announcement of M&A decisions. Using well-established data of firm complexity developed through combining machine learning and a lexicon of words, we find a significant positive relationship between acquiring firm complexity and cumulative abnormal returns (CAR), indicating that more intricate firms are viewed as more valuable or competent in mergers and acquisitions. This association is stronger for acquirers with high operating risk, organizational capital, R&D intensity, large and independent boards, and larger targets. We also present evidence that high-complexity bidders offer higher takeover premiums. Our study contributes to …

Let's Break Some Rules: Immodest Proposals For Evidence Reform, Len Niehoff Jan 2025

Let's Break Some Rules: Immodest Proposals For Evidence Reform, Len Niehoff

Articles

In 1975, when the American Bar Association launched LITIGATION, its editors dedicated the entirety of one of the journal's first issues to evidence. Authors included distinguished practitioners, respected judges, and academic giants like Margaret A. Berger, Irving Younger, and Jim McElhaney. Subjects varied, but the articles shared a common sensibility: The recently adopted Federal Rules of Evidence were a good thing.

High Tech Touts, Sherman J. Clark Jan 2025

High Tech Touts, Sherman J. Clark

Articles

This essay has three interrelated aims. First, it articulates a set of capacities I call virtues of attention—capacities for intuitive discernment, good judgment about what is worth sustained focus, and the ability to engage deeply with worthwhile things. These are eudaimonist virtues in that they help us live well, not merely act rightly. Second, the essay explores what I call poisonous persuasion: the idea that rhetorical appeals, especially those used in marketing, may not only succeed by appealing to certain desires or habits of mind but may also deepen and entrench them. Third, I bring these insights together to examine …

Consensus And Conflict Over Context: Select Criminal Law And Procedure Cases From The Supreme Court's 2024-25 Term, Eve Brensike Primus, Elena Schultz Jan 2025

Consensus And Conflict Over Context: Select Criminal Law And Procedure Cases From The Supreme Court's 2024-25 Term, Eve Brensike Primus, Elena Schultz

Articles

In its 2024-2025 Term, the Supreme Court emphasized the utility—and necessity—of context-based, fact-sensitive analyses throughout its criminal law and procedure cases. Though the Justices sparred over how to derive meaning from factual, structural, legal, and historical contexts, they tended to agree that courts should not be artificially restricted from considering the breadth of the record before them.

Measuring The Rapidly Increasing Use Of Artificial Intelligence In Legal Scholarship, Michael Conklin, Christopher Houston Jan 2025

Measuring The Rapidly Increasing Use Of Artificial Intelligence In Legal Scholarship, Michael Conklin, Christopher Houston

St. Mary's Journal on Legal Malpractice & Ethics

The rapid advancement of artificial intelligence (AI) has had a profound impact on nearly every industry, including legal academia. As AI-driven tools like ChatGPT become more prevalent, they raise critical questions about authorship, academic integrity, and the evolving nature of legal writing. While AI offers promising benefits—such as improved efficiency in research, drafting, and analysis—it also presents ethical dilemmas related to originality, bias, and the potential homogenization of legal discourse.

One of the challenges in assessing AI’s influence on legal scholarship is the difficulty of identifying AI-generated content. Traditional plagiarism-detection methods are often inadequate, as AI does not merely copy …

Sustainable Agricultural Alternatives To Cope With Drought Effects In Semi-Arid Areas Of Southern Mozambique: Review And Strategies Proposal, Celso Mondlhane, Lawrence Munjonji, Íris Victorino, Carlos Huenchuleo, Paula Pimentel, Pablo Cornejo

All Grantees Publications

Drought, pests, soil fertility depletion, environmental challenges, and the limited use of agricultural inputs continue to plague food production in many developing countries such as Mozambique. As a response to these production constraints, sustainable strategies must be defined to cope with these problems. One strategy, largely applied worldwide, is the combination of the usage of plant growth-promoting microorganisms, conservation tillage, intercropping, and crop residue management. The above can help smallholder farmers to become more resilient, sustainable, and productive, in a framework where the limitations imposed by global climate change are being exacerbated. The impacts of these strategies are less known …

Synthesis And Characterization Of Gelatin-Hydroxyapatite Nanohybrid Composites, Alvin Sasia, Lawrence Ochoo, Daniel Bem, Nathalie Lyczko, Martial Sauceau, Ange Nzihou, Arthur Onyuka

Minerals, Mining and Materials Engineering

Gelatin-based nanocomposites have gained significant attention as sustainable and multifunctional biomaterials due to their natural origin, biocompatibility, and tunable properties, making them strong candidates for advanced structural applications, such as matrix fillers and functional coatings in porous substrates like leather. But, pure gelatin suffers from limited mechanical strength, thermal instability, and rapid solubility in aqueous environments, necessitating structural reinforcement. Nano-calcium hydroxyapatite (CaP) is a well-established inorganic additive that enhances the mechanical, thermal, and structural performance of gelatin matrices; however, its tendency to agglomerate in gelatin limits uniform dispersion, and consequently restricts its reinforcement capabilities. This study focuses on the synthesis …

This paper explores foam concretes produced from cement, sand, water, foaming agents and secondary cementitious materials (SCMs). We examine the effects of these constituents on the microstructure, mechanical/ physical properties, workability, and the durability of foam concrete. The contributions of SCMs are assessed based on their pozzolanic activity. Various SCMs, through their pozzolanic reactivity, contribute significantly to pore refinement, matrix densification, and the enhancement of mechanical strength, thermal conductivity and durability characteristics, including resistance to water ingress, chloride penetration, and sulfate attack of foam concrete mixes. While the SCMs incorporation leads to improved strength, it may also increase brittleness, which …

Understanding Rural Legal Deserts To Inform Public Policy: Identifying And Describing Lawyer Gaps In Non-Metropolitan Counties, David J. Peters, Emma Bartling, Emily Meyer

South Dakota Law Review

Rural legal deserts have become a growing topic of interest to legal scholars and social scientists in the U.S. However, current research is limited by measurement issues and by the lack of national-scale analyses. To address these limitations, we identify legal deserts by applying latent profile analysis to lawyer gap rates for N = 2,307 non-metropolitan counties in the U.S. Lawyer gap rates are calculated as local demand for lawyers minus the local supply, using employment in private practice law offices from the Census Bureau. Next, we statistically describe the spatial, demographic, economic, and social characteristics of legal deserts. We …

Mapping The South Dakota Legislature, John Mccullough Jan 2025

Mapping The South Dakota Legislature, John Mccullough

South Dakota Law Review

All state legislatures are unique. Each is rooted in a state’s political tradition and culture. A state legislature carries out its constitutional duties at a specific place— in a capital city and usually in a state capitol building. The setting of legislative activity is not simply a backdrop on a political stage, but rather, it is an integral component of a state’s political story. What makes the South Dakota Legislature’s story “one-of-a-kind” is the location at which it carries out its work. This article maps out that location, showing its distinctiveness among all state legislatures and providing a greater context …

South Dakota Law Review

The 2025 session of the South Dakota State Legislature marks its 100th regular session, providing an opportunity to reflect on its history and celebrate its role as a citizen-focused, part-time, and accessible institution. Established in 1889, South Dakota’s statehood was shaped by a desire to end the perceived corruption of territorial governance and to create a system rooted in republican principles, limited spending, and agrarian values. The state’s early legislature emphasized fiscal restraint, citizen representation, and rural priorities. Over time, reforms modernized the institution, including changes to apportionment, term limits, and technology, enhancing transparency and public engagement. Women gained representation …

Have Recent Legislative Changes In South Dakota Made Using The Initiated Measure Process More Difficult?, Cory Heidelberger, Teagan Mcnary, Reynold F. Nesiba

South Dakota Law Review

The right of the people to initiate and refer laws has been enshrined in South Dakota’s Constitution since 1898. In recent years, citizen advocates have used the initiated measure process to raise the minimum wage (2014), end payday lending (2016), and expand Medicaid (2022). In November 2020, Amendment A passed with 54% of the vote, legalizing recreational marijuana. However, after judicial review, this result was nullified. While these ballot measures were being organized and promoted, South Dakota’s Republican supermajority legislature and two Republican Governors enacted dozens of changes to the initiative and referendum process. Some of these measures, too, have …

Reevaluating South Dakota's Child Support Deduction: Balancing Retirement Contributions And Children's Needs, Marilyn Trefz

South Dakota Law Review

This article explores how South Dakota’s child support provisions, particularly the 10% allowable deduction for voluntary retirement contributions from parents’ gross income, affect the fair distribution of financial responsibilities between parents. By exploring the historical context and evolution of this statute, this article highlights the challenges and disparities the 10% deduction creates, particularly for custodial parents living in poverty. Through a comparative analysis with other states and a discussion on balancing retirement savings with child support needs, the article argues for reconsideration of the statutory allowance. The article’s aim is to ensure that the next revision of the child support …
