Carceral Firms In Disguise: Prison Labor, Human Rights, And The Public-Private Divide, Mao-Hong Lin Jan 2025

Carceral Firms In Disguise: Prison Labor, Human Rights, And The Public-Private Divide, Mao-Hong Lin

Emory International Law Review

The prohibition of forced labor is a globally recognized principle. International laws such as the International Covenant on Civil and Political Rights, the European Convention on Human Rights, and the American Convention on Human Rights explicitly ban all forms of slavery, including forced labor, with an exception for forced labor behind bars. Further, ILO asserts that forced prison labor must be conducted solely under the control of public authorities, explicitly excluding private entities from involvement. ILO’s prohibition against private use of prison labor is based on two main concerns: abuse of power over inmates and unfair competition between inmates and …

Josef Bohatec: The First Historian Of The Calvinist Reformation Of Rights, John Witte Jr., Thomas Jared Farmer Jan 2025

Josef Bohatec: The First Historian Of The Calvinist Reformation Of Rights, John Witte Jr., Thomas Jared Farmer

Emory International Law Review

This Article analyzes the pioneering work of the first great historian of Calvinist rights talk, Josef Bohatec (1876–1954), a Moravian-born and Vienna-based church historian. Bohatec built on the earlier efforts of several German scholars who were excavating pre-Enlightenment sources of human rights going back to antiquity. But Bohatec placed strong new emphasis on the original rights contributions of sixteenth-century Protestant reformer John Calvin (1509-1564) and his followers. Bohatec showed how Calvin’s legal training shaped the many new statutes and rights ordinances that he crafted for Geneva. He also showed how Calvin’s theological training shaped his highly innovative Protestant legal and …

From Litigation To Arbitration: Empirical Insights Into The Dmca Notice-And-Takedown System In Cross-Border E-Commerce Copyright Disputes, Baichuan Huang Jan 2025

From Litigation To Arbitration: Empirical Insights Into The Dmca Notice-And-Takedown System In Cross-Border E-Commerce Copyright Disputes, Baichuan Huang

Emory International Law Review

In cross-border disputes, the Digital Millennium Copyright Act (DMCA) notice-and-takedown system’s reliance on federal litigation as its final step faces serious procedural obstacles. An empirical analysis of twenty-four lawsuits filed in the Southern District of New York (SDNY) reveals non-appearing defendants, protracted proceedings, and Amazon’s occasional reinstatement of infringing products based on statutorily defective counter-notices. SDNY’s routine approval of email service on foreign defendants raises additional concerns about treaty violations and inconsistent application of legal standards. To address these inefficiencies, this Comment proposes a public, arbitration-like mechanism as an alternative to litigation. While private arbitration models—such as Amazon’s Patent Evaluation …

In this paper, I examine the risk and protective factors that influence whether an individual smokes. Smoking rates are disproportionately high among American …

The Erie Scoop, Barry Cushman Jan 2025

The Erie Scoop, Barry Cushman

Journal Articles

APRIL 25, 1938 WAS A BUSY DAY at the Supreme Court of the United States. The Court decided twelve cases by full opinion and six cases per curiam, granted certiorari in two cases and denied it in twenty-eight others, and denied two petitions for rehearing. The decision that received the most attention sustained a challenge to a directive of Secretary of Agriculture Henry A. Wallace setting maximum rates to be charged by commission men working at the Kansas City Stockyards. The Court found that the regulated parties had not been afforded a “full,” “fair and open hearing” before the rate …

I'M Trying To Love Garbage (2021) By Bethany Barton, Peter Shea Jan 2025

I'M Trying To Love Garbage (2021) By Bethany Barton, Peter Shea

Picture Books

Bethany Barton writes great books for kids about how minds change. In this one, the character’s arc is from thinking about garbage as just smelly icky stuff through empathizing (a little) with the creatures that feed on garbage, to eventually coming to see that all garbage is not equal; some needs special handling or it will clutter life up for a long time. The conclusion: I want to act like someone who thinks more about garbage, about what trash I create and where it ends up.”

How To Be A Nature Detective (1966) By Millicent E. Selsam, Maughn Rollins Gregory

Picture Books

Coming up with the most reasonable explanation of the available clues is something we all do on a daily basis. This book describes animal tracks as clues from which children can make inferences about what kind of animal left them and what they were doing when they did.

Grasshoppers, Ants, And Philosophical Fables, Maughn Rollins Gregory Jan 2025

Grasshoppers, Ants, And Philosophical Fables, Maughn Rollins Gregory

Picture Books

Aesop contrasted the ant’s virtues of industry, forward planning, and group loyalty with the idleness of a cicada interested only in merry-making and music-making. That contrast is challenged in many picture book versions of his fable. What does it mean to work? What is the value of making music and art? Can finding delight in an occupation be as important as denying gratification? When is it right to refuse help to someone who asks for it? This review compares six picture books—Ant and Grasshopper by Luli Gray (2011), The Ant and the Grasshopper by Amy Lowry Poole (2000), The …

Sidewalk Flowers (2015) By Jonarno Lawson, Samantha Piede Jan 2025

Sidewalk Flowers (2015) By Jonarno Lawson, Samantha Piede

Picture Books

JonArno Lawson's Sidewalk Flowers centers on a little girl accompanying her father on a morning walk across a grey landscape. On the way, she spots dandelions sprouting out of the pavement. The protagonist's attention to this tiny, beautiful detail catalyzes her expanding appreciation for the rest of her environment, spurring her to notice beauty in unexpected places. This review suggests that Sidewalk Flowers richly introduces children to the philosophical theme of attention not with words, but with color.

Buzzing With Questions: The Inquisitive Mind Of Charles Henry Turner (2019) By Janice N. Harrington, Maughn Rollins Gregory Jan 2025

Buzzing With Questions: The Inquisitive Mind Of Charles Henry Turner (2019) By Janice N. Harrington, Maughn Rollins Gregory

Picture Books

Do insects have minds? Are they creative? Can they tell time? Can they learn from experience? As a young boy, Charles Henry Turner couldn’t stop asking such questions and his curiosity-fueled intellect led him to become the first African American admitted to the St. Louis Academy of Science and one of the first entomologist to study insect behavior. By designing ingenious experiments, Turner proved that bees see color, that spiders can spin webs around artificial obstacles, that cockroaches can learn to navigate a maze, and that moths can be trained to beat their wings when a whistle blows. This insightful …

What Is A River? (2021) By Monika Vaicenavičiene, Maughn Rollins Gregory Jan 2025

What Is A River? (2021) By Monika Vaicenavičiene, Maughn Rollins Gregory

Picture Books

Monika Vaicenavičienė’s lush picture book What is a River? nudges us to contemplate our interconnection with living things and natural cycles, and with human history and culture. It relates a conversation between a grandmother and a young adult grandchild enjoying a picnic on a riverbank. Noticing that the river’s surface reflection of trees and flowers along its banks hides its lower depths (“Just like people”), the grandchild asks, “Grandma, what is a river?” The grandmother’s many responses do more than help her grandchild appreciate multiple meanings and values of rivers; they demonstrate how interesting some things become if we keep …

Lobbying By Brief: Unveiling The Dominance Of Amicus Lobbying In The Development Of Business Law, W. C. Bunting, Tomer Stein

SMU Law Review

This Article uncovers the pervasive and significant impact of business law amicus lobbying, a strategic tactic whereby lobby groups have commandeered the amicus curiae filing process in state courts to shape business law according to their interests.

This Article makes three primary contributions to the literature. First, it presents the only comprehensive dataset of amicus curiae filings in business law cases. This hand-collected dataset encompasses nearly all business law amicus curiae filings from 2005 to 2022 in the key jurisdictions of New York, California, Delaware, Texas, and Nevada. Second, it reveals a striking empirical finding: lobby groups account for 67% …

Longitudinal Examination Of Gender Differences In Engineering Self-Efficacy And The Impact Of Covid-19: A Six-Year Study, Lillian C. Jeznach, Maija A. Benitz

Engineering, Computing & Construction Management Faculty Publications

This paper presents a longitudinal analysis of gender differences in undergraduate engineering students’ feeling of self-efficacy across a six-year period, including the impact of the COVID-19 pandemic. Engineering self-efficacy was measured by the Longitudinal Assessment of Engineering Self-Efficacy (LAESE) instrument, while pandemic-related stress was measured with a COVID screener comprised of twenty Likert-type questions. Surveys were administered to engineering students at a small, primarily undergraduate university every semester from Fall 2018 through Spring 2024 and also included one summer survey following a move to online teaching in 2020. Results of long-term data collected over six years (thirteen timepoints) indicated no …

Buried Identities: Addie Bundren And The Vanishing Rural South, Eleanor Smith Jan 2025

Buried Identities: Addie Bundren And The Vanishing Rural South, Eleanor Smith

FCRH Honors Program Theses

As I Lay Dying, by William Faulkner, was published in 1930 and follows the Bundrens, a poor white farming family, as they transport Addie Bundren’s body across the county to be buried with her kin in the town of Jefferson. Telling the story of a literal journey from the minimally developed countryside to the seat of Yoknapatawpha County, the novel shows how the Bundrens confront modernization, an encounter mediated through the female body of their matriarch. While existing scholarship on As I Lay Dying often emphasizes themes of gender and modernity, few studies apply the thesis advanced by some historians …

Mental Fatigue Effect On Joint Repositioning, Collin Kehrwald Jan 2025

Mental Fatigue Effect On Joint Repositioning, Collin Kehrwald

Dissertations and Theses

Mental fatigue influences both cognitive and physical performance, but its specific effects on proprioception have not been widely explored. This study aimed to examine how mental fatigue affects shoulder and knee joint repositioning senses. A joint repositioning task was used to assess proprioception in 18 college-aged males, with measurements taken for both shoulder and knee joint angles before and after a mental fatigue-inducing intervention. The Stroop task was employed to induce mental fatigue between the conditions. Results showed a significant increase in shoulder flexion variable error (p = 0.01, pre-Stroop = 2.79 ± 1.31 degrees, post-Stroop = 4.97 ± 3.20 …

Blattella Germanica As A Vector Of Salmonella Typhimurium, Matthew Turner Jan 2025

Blattella Germanica As A Vector Of Salmonella Typhimurium, Matthew Turner

Dissertations and Theses

The following investigates the role of the German cockroach (Blattella germanica) as a vector of the bacterium Salmonella enterica subspecies enterica serovar Typhimurium (S. Typhimurium). As such, this work examines various host-pathogen-microbiome interactions that define the vectorial capacity of the German cockroach for Salmonella. To date, the majority of literature focuses on the general association of the German cockroach with various human pathogens, claiming any dissemination to be carried out via passive mechanical transmission. This project recognizes those claims, while expanding to include the possibility of biological transmission, involving active and complex host-pathogen interactions, including mechanisms like replication within the …

The Third Person Effect: Misinformation And Disinformation Of News On Racism, Jody-Ann Kadine Tyson Jan 2025

The Third Person Effect: Misinformation And Disinformation Of News On Racism, Jody-Ann Kadine Tyson

Dissertations and Theses

The increased proliferation of misinformation and disinformation has been a cause for concern in the 21st century, as it has had significant repercussions on societal systems and the overall livelihood of individuals. Additionally, a 2016 study revealed that 84% of the American respondents are confident in their ability to detect misinformation and disinformation, while 64% believed that misinformation and disinformation made others confused about current affairs and events (Barthel et al., 2016). These results confirm that some people are not cognizant of the effects of media messages on themselves, but on others (TPE). Due to this implied ignorance, the spread …

Eye Region Redaction: Familiar Versus Unfamiliar Face Recognition, Tyler Gandy Jan 2025

Eye Region Redaction: Familiar Versus Unfamiliar Face Recognition, Tyler Gandy

Dissertations and Theses

Our brains are incredibly skilled at recognizing faces, even decades later after first viewing a face. Face recognition is a crucial social function, enabling us to identify and interact appropriately with others. Studies have identified specific brain regions, such as the fusiform face area, that are specialized for this task. Additionally, areas around the eyes have been shown to be crucial to our face recognition ability. Despite the abundant research in face recognition, little is known about how we recognize familiar versus unfamiliar faces when the eye region is redacted. To understand the role familiarity plays in eye redacted face …
