Into The Legal “Twilight Zone”: State Tenth Amendment Jurisdiction Displacing Climate Supremacy, Steven Ferrey Jan 2025

Into The Legal “Twilight Zone”: State Tenth Amendment Jurisdiction Displacing Climate Supremacy, Steven Ferrey

Lewis & Clark Law Review

The Supremacy Clause of the Constitution notwithstanding, western states have utilized their reserved Tenth Amendment Constitutional authority, upheld by federal circuit courts, arbitrarily to block their adjacent states’ sustainable infrastructure to address climate change. The Biden Administration set in motion a rapid electrification of the entire U.S. economy via three different new laws enacted sequentially in 2021, 2022, and 2023. A re-directed federal executive branch now oversees these programs and laws. This Article analyzes how each of those three laws suffers from a critical omission plaguing this most significant infrastructure program in the last half century—now forecast counter-intuitively by some …

The Public Trust Doctrine And Lake Abert: Saving Oregon’S Only Salt Lake, Joseph Arzt Jan 2025

The Public Trust Doctrine And Lake Abert: Saving Oregon’S Only Salt Lake, Joseph Arzt

Lewis & Clark Law Review

The public trust doctrine creates a relationship between states and their citizens under which the states are entrusted with protecting natural resources for public use. Though Oregon recognizes the public trust doctrine, recent decisions from Oregon’s Supreme Court have displaced and fractured this doctrine, leaving the current legal landscape surrounding the public trust doctrine in disarray. This Note focuses on Lake Abert, Oregon’s only saline lake, which in recent years, due to mismanagement and neglect, has undergone dramatic ecological shifts. By looking at arguments rooted in Oregon’s Constitution, as well as judicial approaches taken in neighboring states, this Note examines …

Affording Oral Tradition Evidence Due Weight Before The International Court Of Justice, Terrence Neal Jan 2025

Affording Oral Tradition Evidence Due Weight Before The International Court Of Justice, Terrence Neal

Lewis & Clark Law Review

Oral traditions are irreplaceable sources of historical information, particularly with regard to Indigenous Peoples’ histories and cultures. However, when states have submitted oral traditions as evidence of historical practices, events, and circumstances in cases before the International Court of Justice (“Court”), the Court has been reluctant to afford them significant weight. This Article, which is the first detailed study on the Court’s treatment of oral traditions, examines whether the Court is failing to provide them due or appropriate weight. Based on historical, archaeological, and anthropological research, it establishes that oral traditions can be as reliable as written documents for reconstructing …

Admitting Science: Problems With Current Admissibility Standards, William O'Donohue, Sneha Gupta Jan 2025

Admitting Science: Problems With Current Admissibility Standards, William O'Donohue, Sneha Gupta

Lewis & Clark Law Review

Attorneys use expert testimony to advance legal positions in courtrooms. Because expert testimony can have tremendous influence over judges and juries, it is admitted only if it meets specific admissibility standards, i.e., Frye and Daubert. These standards provide different admissibility criteria, have been adopted by distinct sets of jurisdictions, and, we argue, are of questionable validity. These standards are attempts to ensure that only knowledge is admissible and are, then, essentially an epistemic matter. Science serves as a proxy for knowledge because science is the epistemic process that has been successful at generating knowledge. However, both epistemology and the philosophy …

Carceral Bonds, Tyler E. Dougherty Jan 2025

Carceral Bonds, Tyler E. Dougherty

Lewis & Clark Law Review

Over the past 50 years, the U.S. financed a massive physical and fiscal expansion of prisons via the municipal bond market—with devastating results. This project is the first to shine a light on the role of municipal debt in state-level carceral decision making, spotlighting the ways that the municipal bond market affects states’ capacities to incarcerate.

This Article argues that the two primary controls of states’ use of the carceral bond market—(1) market discipline and (2) states’ fiscal constitutions—are particularly ineffective at limiting states’ spending on prisons. This failure to restrain states’ spending through the carceral bond market enables private …

The Legal Ramifications Of Israel’S Destruction Of Gaza’S Healthcare System, Serene Mistkawi Jan 2025

The Legal Ramifications Of Israel’S Destruction Of Gaza’S Healthcare System, Serene Mistkawi

Lewis & Clark Law Review

This Comment argues that Israel’s attacks on the medical infrastructure of Gaza are a violation of international law because hospitals are protected zones and medical personnel are civilians. To Israel’s response that Hamas is attack-ing from hospitals, thereby rendering them legitimate targets, this Comment presents a number of responses: (1) there is little to no evidence that Hamas is doing this; (2) even if Hamas is doing this, the military gains from attacking hospitals are outweighed by the civilian deaths; (3) even if Hamas is doing this and there is significant military gain from attacking hospitals, the interna-tional rules have …

Authoring While Dead, Mark A. Lemley, Oliver W. Holmes Jr. Jan 2025

Authoring While Dead, Mark A. Lemley, Oliver W. Holmes Jr.

Georgia Law Review

Bob Marley died in 1981. But he wrote a song in 2017 with The Killers. At least, that’s what the song credits say. Why? Because The Killers’ song included the two words “redemption song,” the title of a classic Bob Marley hit. Rather than fight, The Killers agreed to add Marley as a co-author.

There is an increasing trend in the music industry toward resolving disputes over music copyright by granting co-authorship (or “interpolation”) credit to the claimant, no matter how weak the claim (as in Marley’s case), and even if they are dead (as in Marley’s case again). Bob …

Federalizing Ncii Regulation: The Take It Down Act’S Approach To Criminalization, Platform Liability, And Threats To Disseminate, Trudi K. Sundberg

Georgia Law Review

For years, legal scholars, advocates, and victims have pushed for the federal criminalization of the nonconsensual publication of intimate imagery. Until now, regulation has been inconsistent across jurisdictions, often leaving victims without meaningful remedies or mechanisms for image removal.

The recent passage of the Take It Down Act has finally realized the goal of federal criminalization of nonconsensual intimate image distribution, including that of artificially generated images. The Act further initiates a framework for victim-led takedown procedures and engages with § 230 liability. Additionally, the Act addresses threats to disseminate such content, which is crucial to curb the spread of …

Popular Sovereignty And A Right To Know About The Government, David S. Ardia Jan 2025

Popular Sovereignty And A Right To Know About The Government, David S. Ardia

Faculty Publications

This Article argues that the U.S. Constitution implicitly contains a structural “right to know” about the government, rooted in the doctrine of popular sovereignty rather than the First Amendment. Democratic self‑government requires public access to governmental information; without it, the people cannot exercise informed consent or their sovereign authority. The Article critiques reliance on purely statutory transparency regimes such as FOIA, noting their fragility and susceptibility to political rollback. Through historical and structural analysis, it shows that the Framers viewed an informed citizenry as essential to maintaining checks and balances. The Article proposes three principles for operationalizing a constitutional right …
