Bowers, Lawrence And Obergefell: A Case-By-Case Analysis, Hailey Moran
Bowers, Lawrence And Obergefell: A Case-By-Case Analysis, Hailey Moran
The Downtown Review: An Interdisciplinary Journal Written and Peer-Reviewed by Mandel Honors College Students at Cleveland State University
What does Bowers v. Hardwick, Lawrence v. Texas, and Obergefell v. Hodges all have in common? Each of these Supreme Court cases chronicles the passage of time and advancement in LGBTQ+ rights in America. Not only, however, do they chronicle the rights that have been achieved for LGBTQ+ individuals, but they also chronicle the evolution of the Justices on the bench. These cases here help us understand the influences that encourage the Justice’s decision-making, whether it be the state of the law or the Court’s environment. By analyzing each case, we can understand not only how these cases were decided, …

The Trial Of Musammat Kelee: Widowhood, Infanticide, And Colonial Justice In Early Twentieth Century India, Rashmi Banerjee
The Trial Of Musammat Kelee: Widowhood, Infanticide, And Colonial Justice In Early Twentieth Century India, Rashmi Banerjee
Socio-Legal Review
This article examines the 1920 trial of Musammat Kelee, a Hindu widow from Ajmer-Merwara, accused of drowning her illegitimate infant son in a lake. Drawing on extensive trial records, police reports, and official correspondence, it reconstructs the procedural history of her case and situates it within broader colonial debates on female sexuality, widowhood, and infanticide. Kelee’s conviction under Section 302 of the Indian Penal Code, despite weak evidence, hinged on judicial emphasis on her widowhood and the perceived illegitimacy of her child as proof of motive. Yet her subsequent pardon by the Viceroy’s office reflected a contradictory administrative impulse that …
Criminalizing Moral Failures: An Exploration Of The Difference Between Wrongfully Convicted Men And Women, Caroline Brady
Criminalizing Moral Failures: An Exploration Of The Difference Between Wrongfully Convicted Men And Women, Caroline Brady
Richmond Public Interest Law Review
In the United States, more than 1.9 million people are confined across local jails, state prisons, and federal prisons and jails.! Some of those people are innocent of the crimes for which they were convicted. In 2022 alone, 233 people were exonerated of crimes they did not commit.? Collectively, these 233 exonerees lost 2,245 years of their lives to incarceration.? Over the last few decades, as criminal justice reform movements have gained momentum, more attention has tumed to wrongful convictions. Yet much of the consideration has been dedicated to men, not women.* What ex- plains the lack of women featured …
An Examination Of Successful Reentry And Recidivism For Drug-Involved Offenders In Rural Areas, Jacqueline Cottle
An Examination Of Successful Reentry And Recidivism For Drug-Involved Offenders In Rural Areas, Jacqueline Cottle
Walden Dissertations and Doctoral Studies
In rural communities, treatment and supportive resources are limited, putting ex-offenders (EXOs) at an increased risk for relapse or recidivism. The purpose of this qualitative study was to understand, through semistructured interviews, the experiences of EXOs who completed the court residential treatment center, intermediate sanction facility, or substance abuse felony punishment facility, and returned to a rural county in Texas, along with the perspectives of 11 community supervision officers who worked closely with the EXOs. This study was guided by Agnew’s general strain theory, which posits that drug-involved offenders achieve successful reentry in rural areas when positive supports are present, …

The Role Of Higher Education Attainment In Mitigating Police Misconduct, Marty Allen Hatfield
The Role Of Higher Education Attainment In Mitigating Police Misconduct, Marty Allen Hatfield
Walden Dissertations and Doctoral Studies
Police misconduct continues to undermine public trust and strain community–law enforcement relationships in the United States. The potential role of higher education in reducing misconduct among officers remains underexamined. The purpose of this quantitative correlational study was to examine whether higher educational attainment is associated with reduced rates of documented misconduct in a large urban police department. Grounded in the social learning and organizational justice theories, the research addressed how postsecondary education influences ethical decision-making and conduct. The overarching research question concerned whether education level predicted misconduct frequency, controlling for gender, rank, and years of service. Archival personnel and disciplinary …
Generative Suspicion And The Risks Of Ai-Assisted Police Reports, Andrew Guthrie Ferguson
Generative Suspicion And The Risks Of Ai-Assisted Police Reports, Andrew Guthrie Ferguson
Northwestern University Law Review
Police reports play a central role in the criminal justice system. Many times, police reports exist as the only official memorialization of what happened during an incident, shaping probable cause determinations, pretrial detention decisions, motions to suppress, plea bargains, and trial strategy. For over a century, human police officers wrote the factual narratives that shaped the trajectory of individual cases and organized the entire legal system.
This practice is about to change with the creation of AI-assisted police reports. Today, with the click of a button, large language models (LLMs), a type of generative AI using predictive text capabilities, can …
Disparities In Street Harassment Exposure And Mental Health Consequences: Elevated Risk For Marginalized Women, Sophia Shaiman, Kaitlin M. Boyle
Disparities In Street Harassment Exposure And Mental Health Consequences: Elevated Risk For Marginalized Women, Sophia Shaiman, Kaitlin M. Boyle
Faculty Publications
Street harassment is a widespread harm that disproportionately affects women. While research suggests links between racial inequality, street harassment, and mental health outcomes, it is less understood how the severity of harassment experienced is shaped by their demographic characteristics, and how the severity of the harassment shapes mental health outcomes. Thus, we ask two questions. First, which demographic characteristics are associated with a greater risk of “complementary” and “hostile” forms of street harassment? Second, are complementary and hostile forms of street harassment both associated with higher levels of negative emotion, psychological distress, and post-traumatic maladaptive beliefs? To answer these questions, …

Digital Danger: A Mixed-Methods And Comparative Analysis Of Cyberstalking Victimization, Kylie E. Mccarthy
Digital Danger: A Mixed-Methods And Comparative Analysis Of Cyberstalking Victimization, Kylie E. Mccarthy
Doctoral Works at the University of New Haven
Stalking, and cyberstalking are singular forms of violence, predicated on a victim’s interpretation and perception of events (Campbell & Moore, 2011; Korkodeilou, 2017). With no universal definition, and ambiguity as to which behaviors constitute the crime, understanding remains limited (Maple et al., 2012; Reyns et al., 2012). As technology advances and tech-based harassment rises (Short et al., 2022), it is imperative research examine both the scope of victimization, and the experiences of those victimized. This study analyzed the characteristics and consequences of cyberstalking victimization in a national US sample (n= 73), comparing findings to the 2010-2011 UK Electronic Communication Harassment …

Peña-Rodriguez V. Colorado And The Racial Animus Exception To The No-Impeachment Rule: Extending And Exception To Suspect Classes That Experience Pervasive Bias In The Jury System, Taariq Lewis
Florida Law Review
During an inquiry into the validity of a verdict, Federal Rule of Evidence 606(b) prohibits jurors from testifying about statements made or incidents that occurred during jury deliberations, including jurors' subjective mental processes used in reaching the verdict. This rule is often called the "no-impeachment" rule. The no-impeachment rule promotes the finality of verdicts, facilitates free and vibrant discussion by jurors without fear their verdict will be questioned, and ensures that jurors are not harassed by litigants seeking to challenge their verdict. However, in a landmark U.S. Supreme Court case, Pena-Rodriguez v. Colorado, the Court held that a defendant's …

Diplomacy Syllabi
This course introduces students to the historical development and emergence of the human rights movement, particularly following World War II and during the consolidating period of the 1970s. This period is often labeled the golden decade of human rights, as the movement that commenced at the end of World War II was consolidated through the adoption of two crucial international instruments. Furthermore, human rights advocacy, which works through victims’ testimony and evidence-based reporting on violations, began to take center stage, departing from the basic rules of humanitarian engagement that include impartiality, neutrality, and independence.
With four interrelated parts, the course …

Structurally Harmless: Why Brecht Should Apply On Collateral Review Of Structural Errors, Jaden M. Lessnick
Structurally Harmless: Why Brecht Should Apply On Collateral Review Of Structural Errors, Jaden M. Lessnick
Notre Dame Law Review Reflection
Even when a prisoner has overcome all of AEDPA’s requirements and the Supreme Court’s equitable bars to relief, the writ of habeas corpus may issue only as “law and justice” require. The Court has recognized in recent Terms that the habeas statute thus confers on courts discretion to deny relief notwithstanding the satisfactions of the statutory and equitable preconditions. This discretion, the Court has said, is not boundless. A judge may grant the writ only after considering the principles of finality and federalism. Whatever else that includes, the Supreme Court has made clear that a judge must apply Brecht’s …
