Too Much Time Alone: Disciplinary Segregation As A Cruel And Unusual Punishment, Elijah Swolgaard, Spencer Schlag
Too Much Time Alone: Disciplinary Segregation As A Cruel And Unusual Punishment, Elijah Swolgaard, Spencer Schlag
Brigham Young University Prelaw Review
Disciplinary segregation has historically been used as an arbitrary form of punishment in American prison systems. The severe psychological effects of this confinement allow it be classified as a cruel and unusual punishment under the Eighth Amendment and generally lead to higher recidivism rates. This Note argues that in order to prevent these effects from occurring, disciplinary segregation should be ruled unconstitutional. Previous scholarship has argued for removal of solitary confinement generally. In contrast, this Note argues for the removal of disciplinary segregation specifically, while maintaining the use of necessary forms of solitary confinement such as administrative segregation. This will …

Dangerous Legitimacy: The Risks Of Normalizing Hamas As A Fundamentalist Terror Group In Western Discourse, Shevach Berkovits, Darnell Downes, Hunter Lacroix, Michael Dobkowski
Journal of Strategic Security
This article examines the dangers of Western discourse misrepresenting and normalizing Hamas, a fundamentalist terrorist group, as a legitimate actor in regional crises and conflicts. It explores Hamas' origins as a global terrorist organization, its history of armed conflict with neighbors and the broader Western world, and its ideological roots in religious fundamentalism and totalitarianism. The article argues that Hamas’ principles and actions are fundamentally incompatible with Western democratic ideals, posing a significant threat to regional and global security. It also addresses the ongoing challenges of "Western washing" Hamas through propaganda spread via social activism and social media. The article …

Vocational & Life Skills: Quarterly Report - Grant Cycle Five, Quarter Five July-September 2024, Nebraska Center For Justice Research, Janee Pannkuk, Abby Hayes, Katelynn Towne
Reports
The Vocational and Life Skills (VLS) program was created by Nebraska Legislative Bill 907 in 2014 with the purpose of easing the transition for individuals who reenter the community after incarceration. The VLS initiative is evaluated by the Nebraska Center for Justice Research (NCJR) to identify the impact service providers and programming have in increasing meaningful employment and prosocial lifestyle improvements among the justice-involved population. As part of the evaluation, NCJR provides trainings to support grantees as needed and provides feedback and information to the Nebraska Department of Correctional Services (NDCS) regarding the implementation process and data updates on a …
Familial Fairness: Guaranteeing The Right To Counsel For Indigent Parents In Juvenile Dependency Proceedings, Jake Toth
Dickinson Law Review (2017-Present)
Fairness principles enumerated in the seminal case Gideon v. Wainwright stand for the proposition that fundamental fairness and due process require appointment of counsel for indigent litigants. However, this principle has been constrained to criminal contexts. Many other types of litigation are just as impactful as a criminal proceeding, including juvenile dependency proceedings. Nevertheless, indigent parents do not enjoy an unqualified representation right.
This Comment traces the history of the representation right and how it has been treated in a juvenile dependency context, beginning with Gideon itself and examining other cases such as Eldridge and Lassiter. It then examines …
De-Policing: An Updated Empirical Analysis Of Crime And Federal Police Reform, Griffin Edwards, Stephen Rushin
De-Policing: An Updated Empirical Analysis Of Crime And Federal Police Reform, Griffin Edwards, Stephen Rushin
Washington and Lee Law Review
This Article builds on prior work by empirically analyzing the effect of federal intervention in local police departments on crime and clearance rates, using updated data and methodologies.
Congress passed 34 U.S.C. § 12601 (formerly 42 U.S.C. § 14141) in 1994 to give the United States Attorney General the authority to seek equitable relief against local and state law enforcement agencies engaged in patterns or practices of misconduct. Since its passage, the Department of Justice has investigated and intervened into dozens of American police departments, including some of the largest police departments in the country. Federal intervention represents one of …

Prosecuting Police, Guyora Binder, Anthony O'Rourke, Rick Su
Prosecuting Police, Guyora Binder, Anthony O'Rourke, Rick Su
Journal Articles
Prosecutors face criticism for prosecuting too many minority members and too few police. Recently, some reformers have won prosecutorial elections by pledging to change these priorities. Yet scholars have identified two impediments to police prosecutions. First, county prosecutors often answer to suburban voters indifferent to the excesses of city police. Second, prosecutors depend on those police to investigate their cases and to endorse them as effective. This Article argues that the influence of residents and police on prosecutorial decisions depends on the political geography of a prosecutor’s office. As a result, whether a prosecutor’s office is “city-based,” “regional,” or “state-appointed” …

How Justice Holmes Turned Conspirators Into Partners, Daniel Harris
How Justice Holmes Turned Conspirators Into Partners, Daniel Harris
William & Mary Business Law Review
A fundamental precept of the law of conspiracy is that all members of a conspiracy are partners in crime. This precept is the rationale for many doctrines of conspiracy law, including the controversial judge-made rule that all members of a conspiracy are vicariously guilty of substantive crimes foreseeably committed by one member of the conspiracy even if the other members did not commit the substantive offense, intend the offense, or aid or abet its commission. Why does the law impose partnership status and vicarious guilt on lower-level members of a conspiracy who have no ownership stake in the business and …

Analyzing Public Opinion As An Input In The Systems Theory Framework By Examining The Democratic Responsiveness Of The Pennsylvania Legislature In The 2023-2024 Legislative Session, Donovan M. Villegas
Analyzing Public Opinion As An Input In The Systems Theory Framework By Examining The Democratic Responsiveness Of The Pennsylvania Legislature In The 2023-2024 Legislative Session, Donovan M. Villegas
Student Publications
I examine the 2023-2024 legislative session of the Pennsylvania General Assembly to determine the role public opinion plays in the content of legislation. I use a public policy systems and theories framework as my main theoretical model. Using quarterly polling that identifies the top issues for voters, I find that the Pennsylvania legislature responded to those top issues. This suggests that public opinion does play an influential role in legislative action. These results are consistent with what the systems and theories framework would predict.
Deadtime In The Vale Of Soul-Making: Hermeneutics, Humanization, And Higher Education In Prison, Dale Michael Brown
Deadtime In The Vale Of Soul-Making: Hermeneutics, Humanization, And Higher Education In Prison, Dale Michael Brown
Dissertations
This body of work examines higher education with and for justice-involved people from a descriptive, theoretical, and empirical perspective—pulling together multiple disciplines and employing different methodologies from the humanities and social sciences. The investigation is written from a philosophical perspective via educational foundations and a social science perspective via qualitative research, including an examination of carceral higher education’s connections to teaching and experiential learning. This approach reflects the interdisciplinary nature of both the author’s degree program and the topic itself, which (as a field of academic inquiry) is part theoretical and part empirical (both qualitative and quantitative). The papers in …

A Factor Analytic Investigation Of The Millon Adolescent Clinical Inventory - Second Edition In Justice Involved Youth, Mary Alicia Tait
A Factor Analytic Investigation Of The Millon Adolescent Clinical Inventory - Second Edition In Justice Involved Youth, Mary Alicia Tait
Dissertations (1934 -)
The Millon Adolescent Clinical Inventory – Second Edition (MACI-II; Millon et al., 2020) is an adolescent self-report measure of personality and psychopathology. Its predecessor, the Millon Adolescent Clinical Inventory (MACI; Millon et al., 1993) is one of the most frequently used measures in forensic evaluation of justice involved youth (Archer et al., 2006; Baum et al., 2009; Viljoen et al., 2010). The factor structure of the MACI has been evaluated in diverse psychiatric and juvenile justice samples (e.g., Adkisson et al., 2002; Newman et al., 2015; Romm et al., 1999, Salekin, 2002; Woodland et al., 2014) and inconsistent findings have …

Balancing Security And Customer Satisfaction: Strategies To Combat Retail Theft, Stacy V. Kloth
Master of Public Administration Capstone Papers
Retailers face unprecedented inventory losses, which significantly impact their profitability. This capstone paper examines theft as a primary driver of retail shrinkage, highlighting the evolution of theft tactics and the substantial financial losses resulting from these activities. Comprehensive security strategies are necessary, incorporating technology, employee training, and collaboration with law enforcement. Effective shrinkage prevention is crucial for maintaining a customer-friendly environment and achieving sales goals. Balancing security with customer satisfaction, considering the impact of anti-theft technology, and implementing a robust data collection program are essential for enhancing sales and profitability. This paper contributes to the ongoing effort to balance customer …

U.S. Territories And The Criminal Law Curriculum, Emmanuel Hiram Arnaud
Faculty Scholarship
In this Article, I make a case for why issues concerning the territories should be taught in law school courses and suggest a few ways in which federal criminal adjudication in the territories can and should be incorporated into the criminal law and procedure curriculum.10 As I advance elsewhere,11 criminal adjudication in the territories functions differently than in the mainland United States.12 Using the framework of what I call the “territorial criminal legal system,” I have begun mapping the contours of the unique prosecutorial ecosystem produced by the territorial condition.13 Chief among the characteristics is the …

Understanding Brady Violations, Jennifer M. Mcaward
Understanding Brady Violations, Jennifer M. Mcaward
Vanderbilt Law Review
This largest-ever study of adjudicated violations of Brady v. Maryland provides a detailed and nuanced understanding of who suppresses material evidence in criminal cases, as well as why, how, where, and how often. Its findings complicate the conventional wisdom that Brady violations are the work of nefarious prosecutors who intentionally withhold material evidence from criminal defendants. While it is true that “bad faith” permeates this area of constitutional noncompliance, a substantial minority of Brady cases stem from “good faith” errors by prosecutors and suppression by law enforcement officers. Mostviolations occur in a small number of states, and most often, state …
Beyond The Bickering: Examining Event, Victim, And Offender Characteristics For Sibling Abuse Incidents In Oregon, Isabella M. Starr
Beyond The Bickering: Examining Event, Victim, And Offender Characteristics For Sibling Abuse Incidents In Oregon, Isabella M. Starr
University Honors Theses
Sibling violence (SV) is the most prevalent form of intrafamilial and domestic violence, yet it remains underrecognized and lacks the systematic attention given to other forms of family violence. Often minimized or misclassified as typical sibling rivalry, SV can inflict serious and lasting physical, emotional, and psychological harm on its victims. This study explores the characteristics of sibling violence incidents reported to law enforcement in Oregon between 2016 and 2023, using data from the National Incident-Based Reporting System (NIBRS). Through an analysis of 5,793 single-victim, single-offender incidents, the research examines demographic patterns among victims and offenders, incident dynamics, and typological …

Traditional Gender Roles And Intimate Partner Violence: Exploring Relationships Between Religion, Self-Control, And Alcohol, Carina J. Pawlak
Posters - 2025
IPV is the physical, psychological, or sexual aggression by a married, unmarried, or live-in partner (Patra et al., 2018).
- Male perpetrators are reported for 92% of the IPV cases compared to females and are more likely to severely injure or kill their partners (Levitt et al., 2008).
- In a traditional community that had lax attitudes toward IPV, there was an 80% increase in the likelihood of perpetration and women’s consent to the violence increased their likelihood of victimization by 11% (Linos et al., 2013).
- To maintain traditional gender roles found within religious communities, some men may use …
Against Criminalizing Wage Theft: Lessons From The Antitrafficking Movement, Stephanie Richard
Against Criminalizing Wage Theft: Lessons From The Antitrafficking Movement, Stephanie Richard
Cardozo Law Review
Criminalizing wage theft is a popular idea. This Article argues that--based on practitioners' experience with human trafficking--workers' rights groups, legislators, and prosecutors should reconsider embracing the criminalization of wage theft as an effective response to preventing this form of abuse. Twenty years of experience with trafficking cases and data show that criminalizing wage theft is likely not only to be ineffective but also to cause further harm to the victims and vulnerable communities who suffer the most from wage theft. A review oflabor trafficking cases and data shows the frequent negative impacts on victims from criminal prosecutions that would be …
