The Empirical Double Standard: Opinion Surveys Across The Civil-Criminal Divide, Kay L. Levine, Bernard Chao Mar 2025

The Empirical Double Standard: Opinion Surveys Across The Civil-Criminal Divide, Kay L. Levine, Bernard Chao

Sturm College of Law: Faculty Scholarship

Across different legal domains, liability doctrines recognize the value of community input. But do courts truly listen to the community's voice when deciding these sorts of cases? This study is the first to explore how courts treat community opinion survey evidence across both civil and criminal law. To that end, we comprehensively examine trademark, false advertising, patent, antitrust, obscenity, death penalty, and Fourth Amendment search cases.

Our research uncovers a significant asymmetry: courts readily admit survey evidence in civil proceedings but systematically exclude it in criminal cases. This asymmetry does not appear to stem from structural differences between civil and …

Cultivating A Trauma-Informed Lens Into Outpatient Supportive Oncology Via The Interdisciplinary Team, Ramona Sitko, Msw, Lcsw

Kimmel Cancer Center Papers, Presentations, and Grand Rounds

Background
A cancer diagnosis often brings with it a profound sense of existential threat. For individuals with a history of trauma, it can activate a trauma response, manifesting as anxiety, depression, difficulty processing information, and challenges in adhering to a medical treatment plan. Health care providers in oncology settings should strive to recognize these responses to more effectively address patient concerns and help minimize potential barriers to care. Trauma Informed Care (TIC) is a framework developed by SAMHSA (Substance Abuse and Mental Health Services Administration) which can help providers realize, recognize, respond, and resist retraumatization of patients.

Objectives
Examine the …

2020-Current year OA Pubs

BACKGROUND: The August 2023 wildfire in the town of Lāhainā on the island of Maui in Hawai'i caused catastrophic damage, affecting thousands of residents, and killing 102 people. Social media platforms, particularly TikTok, have become essential tools for crisis communication during disasters, providing real-time crisis updates, mobilizing relief efforts, and addressing misinformation. Understanding how disaster-related content is disseminated and engaged with on these platforms can inform strategies for improving emergency communication and community resilience.

OBJECTIVE: Guided by Social-Mediated Crisis Communication theory, this study examined TikTok posts related to the Maui wildfires to assess content themes, public engagement, and the effectiveness …

The Heart Of Higher Education: Rediscovering Meditation From The Margins Of Learning To A Liberatory Pedagogy In The Post-Pandemic University, Jinting Wu, Yuejia Wang, Yu Wu, Qi Zhang

Journal of Contemplative and Holistic Education

On May 14th, 2022, a racially motivated mass shooting occurred in a predominantly Black neighborhood in Western New York. The trauma brought fresh anguish to a fraught social landscape already shaken by COVID-19 and resurgent racism. This paper explores the formation of a campus meditation group that emerged in light of the shooting tragedy and prolonged pandemic suffering, and its members’ journeys of healing, self-discovery, and transformation. While scholars have critiqued the neoliberal higher education for producing self-enterprising individuals motivated by economic rationality, this paper offers our humble attempt to re-center meditation as a liberatory pedagogy in fostering …

Adult Sexual Grooming: A Systematic Review, Christin Aletky, Bonita Sharma, Jose Carbajal, Tia Eubank

Journal of Social Work in the Global Community

Grooming is the manipulation and intimidation of people into acts that may appear consensual but are in fact exploitative and harmful, activities they would not have chosen otherwise. Different legal definitions and shifting social perspectives on consent complicate efforts to determine whether a given behavior is a result of informed consent or a response to grooming behaviors. Most studies on grooming and sexual assault focus on adults grooming and abusing children—research on adults grooming other adults is scarce. Therefore, the purpose of our study is to conduct a systematic review of current research on the grooming of adults. We used …

The Impact Of A Cancer Diagnosis On Employment And Finances; Preliminary Findings From A Multi-Site Guaranteed Income Trial, Deidre Geroni, Gregory Garber, Amy Leader, Chiu Yi Tan, Jessica Jacoby, Jason Ma, Meredith Doherty

Department of Medical Oncology Posters

Background

A cancer diagnosis affects patients beyond physical health, often disrupting emotional, social, and financial well-being. Employment is central to personal identity, contributing to:

  • Financial stability
  • A sense of community
  • Purpose and fulfillment in daily life

Addressing the impact of cancer on employment is essential to supporting patients' holistic well-being. Despite these challenges, there is a lack of targeted financial interventions aimed at mitigating the disruption to employment, highlighting the need for studies like this one.

Cost Comparison Of Congregate, Motel, And Village-Type Shelters For People Experiencing Homelessness, Jacen Greene, Todd Ferry, Emily Leickly, Franklin H. Spurbeck

Homelessness Research & Action Collaborative Publications and Presentations

Village and motel shelters exemplify the expanding field of “alternative” shelters for people experiencing homelessness, largely defined in contrast to “traditional” congregate shelters. Little research compares the financial costs of alternative and traditional shelter models. The research team analyzed cost data for 13 alternative shelters (six villages and seven motel shelters) and nine traditional congregate shelters in Portland, Oregon. Costs were assessed per “unit” (i.e. shelter bed or motel room) to account for differences in shelter sizes. Village shelters had the highest per-unit set-up costs ($99,630), followed by motel shelters ($88,462), while congregate shelters had the lowest ($43,692). Congregate shelters …

Cleveland State Law Review

This article aims to dismantle walls and barriers, tracking the contemporary trends in law that acknowledge the significant value of interdisciplinary cooperation. We strive to explore how collaborative contemplation on a legal issue, incorporating two or more academic and practical viewpoints, can enhance interactions across multiple disciplines, improve comprehension of intricate problems, and guide interventions. Ultimately, such collaborations can yield an innovative and synergistic knowledge base, fostering the development of new theories capable of explaining complex human phenomena from varied perspectives. These diverse vantage points are expected to generate superior and more fitting outcomes than those achievable by the field …

The Impact Of Patricia Leavy’S Sociological Fiction, J. E. Sumerau Mar 2025

The Impact Of Patricia Leavy’S Sociological Fiction, J. E. Sumerau

The Qualitative Report

This article examines the impact of Patricia Leavy’s Sociological Fiction upon students, professors, and other readers. Utilizing examples from over seven years teaching and writing sociological fiction works at a private liberal arts university in the southeastern United States, I illustrate and discuss some ways Leavy’s works facilitate (1) students finding themselves and sociology as a field of study; (2) professors navigating personal and professional questions during the life course; and (3) readers, regardless of identity, navigating self-development, reflection, and sociological inquiry as a potential interest or commitment. In so doing, I suggest examples of sociological fiction by Leavy and …

Journal of the Georgia Public Health Association

Background: H-2A farmworkers are disproportionately vulnerable to COVID-19 and understanding their beliefs regarding COVID-19 vaccines is important for public health outreach, yet to date little research has examined the influence of country of origin (COO) on the vaccine beliefs of this uniquely transient population.

Methods: Three focus groups (N=30) were held with H-2A farmworkers in South Georgia to explore their beliefs on COVID-19 vaccines, using thematic analyses to identify COO influences on these beliefs.

Results: Family in COO influenced worker vaccine beliefs through direct advice, commonly held beliefs in COO about harmful government agendas via vaccines increased worker vaccine fears, …

Faculty Publications

Abstract

This study examines the relationship between ethnicity and daily functional disabilities among older adults, focusing on Activities of Daily Living (ADLs) and Instrumental Activities of Daily Living (IADLs). The analysis uses data from the 2020 National Social Life, Health, and Aging Project (NSHAP) survey, which included a sample of individuals aged 57-85 (n=3,005). Respondents provided information on their demographic background (e.g., income, gender, race, age, health, retirement, and marital status) and socioeconomic characteristics through telephone interviews.

The study hypothesized that ethnic differences would be evident in perceived difficulties with ADLs and IADLs in later life. To assess these relationships, …

A Review Of The Ripple Effect Of Parental Incarceration: Suggestions For System Improvement From Neonatal Development Through Adolescence, Karen Thew, April Terry Mar 2025

A Review Of The Ripple Effect Of Parental Incarceration: Suggestions For System Improvement From Neonatal Development Through Adolescence, Karen Thew, April Terry

International Journal of Undergraduate Research and Creative Activities

Parental incarceration has the potential to drastically affect the social, behavioral, and physical lives of children. Such negative impacts include prenatal and chronic health conditions, behavioral and mental health issues, developmental delays, juvenile and criminal legal system involvement, and overall declines in well-being. These damaging outcomes occur for babies delivered during their mothers’ incarceration with negative lingering effects seen throughout the lifespan. Due to the stigmatization of incarceration, these children may experience bullying, engage in isolating behaviors, and struggle within the school, which may lead to the school-to-prison pipeline. While prevention and intervention services directed at these youth could not …

The Convergence Of World Prosperity And Afterlife Salvation: Neoliberalism And Political Islam In Turkey, Muhammad Andi Firmansyah Mar 2025

The Convergence Of World Prosperity And Afterlife Salvation: Neoliberalism And Political Islam In Turkey, Muhammad Andi Firmansyah

Jurnal Politik

This article investigates why Turkey’s middle-to-low-income earners, the segment of the population that has suffered the most from the neoliberal policies of the Adalet ve Kalkınma Partisi (Justice and Development Party AKP), have continued to support the party for so long. Using a case study approach based on secondary data, this article argues that the source of the AKP’s enduring legitimacy lies in their skill in utilising political Islam to consolidate neoliberalism. They strategically framed neoliberal restructuring in an Islamic spirit, generating not only loyal cross-class support but also obedience to neoliberal political projects with all their destructive consequences. The …

Effect Of Social Determinants Of Health On Clinic Visit Attendance In Patients With Hemophilia, Shailly Gaur, Brian Lee Phd, Mph, James Anderst Md, Msci, Katie Foote Lscsw, Lcsw, Osw-C, Andrea Bradley-Ewing Mpa, Ma, Shannon L. Carpenter

Posters

Background Social determinants of health (SDOH) create barriers to seeking care regularly, especially for patients with chronic disease. Patients with moderate-severe hemophilia A and B (factor 8 and 9 deficiencies respectively) have a life-long higher risk of bleeding and require chronic therapies. Specialized care is offered through hemophilia treatment centers (HTCs); however, these can be difficult to access for some individuals. Previous SDOH research in this patient population has been limited; therefore, it can be difficult to identify the barriers to care that exist. There is a need to examine SDOH more thoroughly to create patient-directed interventions to improve access …
