A Liberty-Balancing Approach To Crime, Sheldon Evans
A Liberty-Balancing Approach To Crime, Sheldon Evans
Scholarship@WashULaw
At its core, the criminal legal system is an ecosystem of institutions that seek to balance liberty interests. The insightful theories and complex practices of crime policy coalesce around questions on how crime impacts the liberties of individuals and communities to be safe, and how this correlates with the deprivation of liberty from offenders through our punishment system. But modern criminal policy, most often associated with the problems of overcriminalization and mass incarceration, has wholly abandoned any such delicate and nuanced balancing. Instead, the system thrives on sacrificing the liberties of offenders in a perverse and ineffective regime that leads …
Auditing Criminal Justice Minimalism, Trevor George Gardner
Auditing Criminal Justice Minimalism, Trevor George Gardner
Scholarship@WashULaw
If criminal justice minimalism is a shared principle among criminal law scholars, it can help to clarify the quality of our disagreements. Every normative proposal in the criminal legal literature can be held to the minimalist standard—audited, so to speak, to account for the policy author’s minimalist claims. To this end, this Essay proposes a four-step framework by which to evaluate adherence to the minimalist principle, where each step serves as a hub for pointed scholarly debate regarding the path to minimalist criminal justice.

Influence Of Deck Area And Average Daily Traffic On The Deterioration Of Bridge Superstructures., Faysal Ahamed
Influence Of Deck Area And Average Daily Traffic On The Deterioration Of Bridge Superstructures., Faysal Ahamed
Graduate Theses, Dissertations, and Problem Reports (ETD)
State Departments of Transportation (DOTs) are responsible for maintaining approximately 623,000 bridges across the United States. Effective bridge management requires a comprehensive understanding of the factors influencing structural deterioration. Numerous studies have explored the effects of average daily traffic (ADT) and deck area (DA) on bridge deck deterioration. Given the interdependence between bridge decks and superstructures, it is plausible that ADT and DA significantly influence superstructure condition ratings and deterioration trends. However, their impact on superstructures remains insufficiently studied. In addition, existing studies primarily focus on overall bridge deterioration without adequately differentiating between superstructure designs and materials and maintenance authorities. …

Video Analytics And Fourth Amendment Vision, Andrew Guthrie Ferguson
Video Analytics And Fourth Amendment Vision, Andrew Guthrie Ferguson
Scholarly Articles in Law Reviews & Journals
What does the Fourth Amendment have to say about video analytics running on citywide camera systems? Video analytics (also known as computer vision) involves hardware and software in cameras that turns video surveillance streams into useful data, identifying, categorizing, matching, and alerting police about objects, people, and incidents. Video analytics can identify objects (e.g., hat, backpack, person, car) and track that person or thing back in time and through the streets using video surveillance footage. For police officers conducting virtual patrols or retrospective investigations, video analytics lets police scan thousands of linked cameras for suspicious behavior or a particular suspect, …

News Mediated Reporting And Governmental Narratives About The Enforcement Of Elite Criminality: Exploring The Social Construction Of Financial Frauds And Discrepancies In Punishment, Dominic J. Zicari
Theses and Dissertations
This study examines how financial crime enforcement decisions are socially constructed through a qualitative content analysis of news articles and government communications pertaining to two specific cases: the Enron scandal of 2001 and the subprime mortgage crisis of 2008. The study was guided by a theoretical framework that utilizes Barak’s (2017) theory of state-routinized crime control. The rigorous analysis of 394 news articles and government communication documents revealed that the media and the state rarely framed the subprime mortgage crisis as a criminal issue. Although the Enron scandal was frequently described as financial crime, journalists and government communicators were often …
Through The Lens Of Social Media: Examining The Relationship Between Exposure To Social Media Videos Of Police Misconduct And Perceptions Of Legitimacy And Cooperation With Campus Police, Kamal Alhassan
Theses and Dissertations
This dissertation examines how exposure to social media and internet news videos depicting police misconduct influences college students' perceptions of campus police legitimacy, procedural justice, and willingness to cooperate. Although prior research has demonstrated the impact of media portrayals on perceptions of municipal police, limited attention has been given to campus policing contexts. Guided by Tyler’s process-based theory of police legitimacy and Gerbner’s cultivation theory, this quantitative study surveyed 400 students at a large public university in the Southeastern Mid-Atlantic region. Measures included self-reported viewing and engagement with police misconduct content on social media, internet, and traditional media platforms, as …
The Fearless Decision And The Future Of Race-Conscious Charities, Chenglin Liu
The Fearless Decision And The Future Of Race-Conscious Charities, Chenglin Liu
Faculty Articles
Historically, courts tended to differentiate between invidious discrimination against racial minorities and benign discrimination against whites in the context of affirmative action movements. With the social movements galvanized by the conservatives and the change of composition of the Supreme Courts and lower courts, the feasibility of race-conscious measures aimed at helping minorities is substantially reduced. The conservatives' win in Fearless, coupled with the Trump Administration's attacks on DEI, have produced a self-censoring effect on charitable organizations. Because of these threats, race-conscious charities will have to modify their practices to become more "inclusive" or face legal challenges from conservatives.

Introduction: Deaths due to opioid-related overdoses have increased across the United States. Specifically in the state of Kentucky, African Americans are the only population that continues to experience an increase in opioid-related deaths. Previous literature highlights African Americans having unique drug use patterns due to systematic barriers and how these barriers limit access to protective factors and substance use treatment. The current study aims to specify patterns of African American non-medical prescription opioid use (NMPOU) and how these patterns may differ based on biological sex and generational cohort. Also, this study plans on using this data on patterns to inform …

Transforming Numbers And Narratives Into Impact At The Richmond Ed Fund, Jasmine C. Brown, Rochelle Clarke, Truc-Mai Nguyen
Doctor of Education Capstones
The Richmond Ed Fund (REF) has been a nonprofit partner to Richmond Public Schools (RPS) for over two decades. During this time, they provided valuable support through enrichment programs, scholarships, and teacher development to the RPS community. In 2019, the organization shifted its focus from direct program operation to major gifts fundraising to align with the RPS strategic plan’s five priorities. To better reflect its renewed mission and enhance its visibility within the community, in 2024 REF underwent a major rebranding focused on expanding impact, increasing collaboration, and fostering innovation. The Executive Director of REF submitted a Request for Partnership …
The Carceral State(S), Esther K. Hong
The Carceral State(S), Esther K. Hong
Michigan Journal of Race and Law
The carceral state is everywhere. Legal and social science scholars are increasingly using the carceral state concept to criticize various aspects, or even the entirety, of the United States. But despite how popular and common this term has become in writings about mass incarceration, criminal processes and punishments, and other forms of social control, the definition, conceptualization, and theorization of the carceral state are far from settled. This Article analyzes and contributes to this discussion by highlighting the diversity and fluidity of ideas surrounding the carceral state.
Although the term often appears without an express definition, the limited ones that …

Disconnected Minds: Exploring Nomophobia And Adhd's Impacts On Driving Hazard Perceptions Among College Students, Stephanie Zheng
Disconnected Minds: Exploring Nomophobia And Adhd's Impacts On Driving Hazard Perceptions Among College Students, Stephanie Zheng
Honors Undergraduate Theses
An increasing psychological concern in the 21st century is the development of the fear of being unable to access one's mobile phone, also known as nomophobia. However, its impact on individuals with Attention-Deficit/Hyperactivity Disorder (ADHD) remains largely unexplored. Given ADHD’s association with impulsivity, attentional difficulties, and emotional dysregulation, those with the condition may be particularly vulnerable to nomophobia, which can affect every aspect of their daily lives, ranging from interpersonal relationships to their academic success and overall physical and mental well-being. This study aims to answer four questions: how does ADHD impact the severity of nomophobia among college students, do …
The Life Of Or Measure 110: Evolution, Implementation, And Impact, Matthew D. Albertson
The Life Of Or Measure 110: Evolution, Implementation, And Impact, Matthew D. Albertson
Anthós
In 2020, Oregon voters approved Measure 110, a groundbreaking policy that decriminalized possession of small quantities of controlled substances and redirected cannabis tax revenues to treatment and recovery centers. This article examines the passage, implementation, and rollback of Measure 110 with HB 4002, enacted in 2024. Drawing on state audits, legislative records, and public health data to contextualize Measure 110 within broader debates on public health, criminal justice reform, and policy-making, Albertson analyzes the progressive policy’s aspirational, reform-minded goals and the practical shortcomings in its enactment. Albertson argues that while Measure 110 has faced justified criticism and partial reversal, it …

Crater Pdc Community Identity & Assets: Foundations For Future Branding And Economic Development, Lydia M. Schauss
Master of Urban and Regional Planning Capstone Projects
This project examines how the Crater Planning District Commission (CPDC) can develop a cohesive community identity through regional branding. Spanning eleven localities in Virginia, the CPDC faces challenges related to fragmented identity, under-leveraged assets, and limited community engagement across its jurisdictions. Through a review of thirty-two planning documents and two rounds of stakeholder focus groups, this research identifies common strengths, recurring issues, and shared aspirations across the region.
The analysis highlights quality of life—defined by affordability, rural character, and community connection—as a central theme. From these findings, the project proposes a branding framework rooted in Asset-Based Community Development and inclusive …
Public Transportation As A Vehicle For Upward Mobility Of Women In Appalachian Virginia, Katy Miller
Public Transportation As A Vehicle For Upward Mobility Of Women In Appalachian Virginia, Katy Miller
Master of Urban and Regional Planning Capstone Projects
Gender and geography are intersecting identities that can affect transportation access and therefore upward mobility. Mobility in rural areas is restricted by economic, temporal, and spatial limitations, as well as infrastructure accessibility. Gendered differences in mobility patterns influence the ability of women to utilize public transportation systems. There is a lack of consideration of rural women in transportation research and planning.
This paper seeks to understand the accessibility of public transportation systems in rural areas to women and how it can contribute to their upward mobility, by studying the Four County Transit system in Appalachian Virginia. Population demographics, current system …
Labor Law, Ownership, And The Firm, Sanjukta Paul
Labor Law, Ownership, And The Firm, Sanjukta Paul
Articles
In shaping economic coordination within and across both firms and markets, one significant action of law is to allocate privileges or rights between people or groups of people. These include the right to coordinate with other people or groups of people in particular ways regarding core economic decisions-a type of activity that is not always or in all circumstances legally permissible. An area that makes this more general action of law especially concrete is antitrust or competition law, with its collection of "exemptions." Antitrust's formal and informal exemptions quite directly allocate economic coordination rights, for particular kinds of activity, and …

Crime Modeling Using An Integrated Cnn–Lstm Architecture With Embedded Self-Excitation, Pawandeep Kaur
Theses and Dissertations (Comprehensive)
It is often assumed that natural phenomena occur randomly over time. However, careful analysis reveals that these events typically form some series or sequences and exhibit distinctive temporal patterns. These patterns are not exclusive to nature. They also appear in human activities, often studied under the concept of bursty human dynamics. The statistical methods analyzing bursty human dynamics not only capture overall trends or seasonality but also explore how past events influence future ones. It makes the analysis more realistic and the results more closely aligned with reality. Bursty human dynamics can be studied at two levels: the individual level …
Landslide Prediction Using Time-Series Decomposition, Reinforcement Learning-Based Feature Selection And Ml Models, Mohith Sai Venkat Ankem
Landslide Prediction Using Time-Series Decomposition, Reinforcement Learning-Based Feature Selection And Ml Models, Mohith Sai Venkat Ankem
Master's Projects
Landslides pose significant risks to human life, the community, and the environment, yet their prediction remains a complex and unexplored challenge. Existing prediction models often rely on surface measurements and satellite images, neglecting the critical role, in providing deeper insights into landslide analysis. The literature review highlights a lack of research in time series decomposition techniques, despite their potential to improve prediction accuracy. Similarly, feature selection methods that enhance model robustness and precision have not been adequately addressed. This study presents a novel approach to predicting landslide displacement by combining feature selection through reinforcement learning techniques with advanced time-series machine …
Abolitionism, Artificial Intelligence, And Non-Reformist Reform, Youngjae Lee
Abolitionism, Artificial Intelligence, And Non-Reformist Reform, Youngjae Lee
Faculty Scholarship
Prison abolitionism has gained significant prominence in criminal law scholarship, while artificial intelligence (AI) has emerged as a transformative force across society. Two schools of thought have arisen regarding their intersection. Some scholars contend abolitionists should welcome AI technologies to reduce the carceral state’s reach. Critics view these tools skeptically, arguing that they lead to biased surveillance and incarceration practices. Using this debate as an example, this article seeks to illuminate the distinction between reformist and non-reformist reforms. The article argues that abolitionists’ criticism of reformists as agents of oppression risks alienating potential allies and discouraging progressive interventions in pivotal, …
Police Brutality As Democide In The United States: The Supreme Court’S Acquiescence To Police-Civilian Violence, Jillian Fantuzzi
Police Brutality As Democide In The United States: The Supreme Court’S Acquiescence To Police-Civilian Violence, Jillian Fantuzzi
Cardozo International & Comparative Law Review
"Never again" is a power phrase used by survivors, observers, scholars, and descendants of survivors when reflecting on the mass casualties of innocent civilians resulting from government methods, like Nazism, ethnic cleansing, communism, and genocide, to exterminate groups deemed different or less than. Many blame dictatorial regimes for these mass atrocities, making democracy appear as a sound solution due to its attractive system ofchecks and balances. However, where the government agents responsible for mass killings of unarmed civilians remain unchecked by the judiciary, the product is not democracy but "democide." This unchecked power serves as a method of persecution of …
High-Consequence Infectious Disease Transport Protocols And Guidelines: Procedures And Simulation Evaluation, Charles J. Svela
High-Consequence Infectious Disease Transport Protocols And Guidelines: Procedures And Simulation Evaluation, Charles J. Svela
Doctor of Nursing Practice Projects
Introduction: High-consequence infectious diseases (HCIDs) such as Ebola virus disease (EVD) and other viral hemorrhagic fevers (VHFs) require interdisciplinary teamwork and collaboration, communication, and adherence to protocols in order to safely transport patients between agencies. Despite national preparedness efforts, standardized transport protocols for HCID patients remain limited and inconsistently applied nationally. This quality improvement (QI) project aimed to develop and assess evidence-based interfacility transport protocols for a regional Biological Isolation Care Unit (BICU) using a multidisciplinary, simulation-based learning activity.
Methods: A quantitative semi-structured survey was utilized to evaluate the effectiveness of newly developed HCID interdisciplinary transport protocols utilized in a …
