The Great Writ Of Popular Sovereignty, William M.M. Kamin
The Great Writ Of Popular Sovereignty, William M.M. Kamin
Scholarly Articles
American habeas corpus, long conventionally known as the Great Writ of Liberty, is more properly understood as the Great Writ of Popular Sovereignty—a tool for We the People to insist that when our agents in government exercise our delegated penal powers, they remain faithful to our sovereign will. Once we grasp this conceptual shift, the implications for the law of habeas are profound.
In the past fifteen years, novel archival research has shown the Great Writ of Liberty’s founding myth to be ahistorical—that ideas about sovereignty, rather than individual liberty, drove the common-law writ’s development in the centuries of English …
Forum Shifting To Regulate Data Privacy: The Creation And Evolution Of Eu Data Protection Law, Raymond Yang Gao
Forum Shifting To Regulate Data Privacy: The Creation And Evolution Of Eu Data Protection Law, Raymond Yang Gao
Northwestern Journal of International Law & Business
Currently, the European data protection regime has become one of the most influential legal frameworks regulating data privacy protection and cross-border personal data transfers. Despite a burgeoning body of scholarship on EU data protection law, the questions of why and how the EU adopted this regulatory approach remain understudied. Contrary to conventional wisdom, European data protection regulation is neither preordained by Europe’s historical or cultural legacies, nor simply a result imposed by powerful EU member states out of national economic interests. Instead, this work argues that this legal regime is the result of contentious lawmaking processes aimed at addressing regulatory …

Where Air Meets Space: Legal Implications For The Provision And Use Of In-Flight Internet Connectivity By Satellite, Steven Truxal, Dimitra Stefoudi
Loyola University Chicago International Law Review
In view of the increasing scale and broadening scope of the provision and use of in-flight internet connectivity by satellite, this article identifies relevant legal implications for States, satellite operators and airlines. With reference to international air law and international space law, as well as telecommunication law, this article discusses the extent to which existing law can alleviate legal concerns.
The article begins with an introduction that discusses the intersection of air and space, locating the provision and use of in-flight connectivity by satellite. A lack of political and legal consensus on where precisely to delineate outer space is explained …

How Pretrial Detention Deprives A Child’S Access To Education: The Convention On The Rights Of The Child And The Juvenile Justice Reform Act, Abby Groetsch
Human Rights Brief
Although the United States (“U.S.”) has not ratified the Convention on the Rights of the Child, which specifically outlines the rights of juvenile defendants, the Supreme Court’s interpretation of the Fifth and Fourteenth Amendments provides implicit rights for children accused of criminal acts. In 1967, the Supreme Court decided In re Gault, definitively establishing that the Due Process Clause of the Fourteenth Amendment applied to juvenile defendants. The Supreme Court has also stated that children should be treated differently than adults, outlining different sentencing requirements for crimes committed while a person is under the age of eighteen.

Remedying Unconstitutional Immigration Enforcement, Guha Krishnamurthi
Remedying Unconstitutional Immigration Enforcement, Guha Krishnamurthi
Cardozo Law Review de•novo
Fearmongering about “illegal immigration” has reached a fever pitch. There is a nearing bipartisan consensus among politicians that “stopping illegal immigration and securing the border” is a paramount priority. The fact that many politicians and institutional actors have displayed animus in discussing immigration enforcement portends that many perils lie ahead. It is precisely during this time that constitutional rights must serve as a bulwark against government overreach. This Essay contends that our constitutional rights framework, specifically its principal remedies for rights violations, are inadequate to protect against government malfeasance. In particular, I demonstrate that there are plausible scenarios where the …

(Non)Police Brutality, Shawn E. Fields
(Non)Police Brutality, Shawn E. Fields
Faculty Scholarship
Local governments increasingly rely on unarmed, nonpolice experts to provide public safety services. In response to demands to reduce police violence, many municipalities have empowered paramedics, mental health counselors, social workers, and homeless outreach personnel, to triage health and safety issues without police involvement. Pilot programs reallocating police funds to these alternate responders appear to reduce arrest rates and rates of police violence. But they have not eliminated acts of violence committed by these nonpolice actors themselves. Shocking stories of paramedics chemically sedating motionless patients to death, social workers assaulting clients, and homelessness response units brutally dispersing unhoused persons after …

Lone Stars Lessons, Amy F. Kimpel

This Article provides the first comprehensive empirical account of Operation Lone Star (OLS), Texas Governor Abbott’s immigration enforcement initiative at the southern border. Though OLS consists of several components, including border wall construction and the busing of migrants to “blue” states, the machinery of OLS is primarily designed to apprehend recent migrants and prosecute them for violations of Texas state criminal law. The most common OLS prosecutions are for misdemeanor criminal trespass after migrants are arrested on private ranch lands near the border. As many criminal justice reforms aim to shrink the scale and scope of the criminal legal system, …
Multilevel Network Governance For United Nations Sustainable Development Goals: The Role Of European Subnational Entities In Urban Resilience, Hasan Isgandar
Multilevel Network Governance For United Nations Sustainable Development Goals: The Role Of European Subnational Entities In Urban Resilience, Hasan Isgandar
Graduate Thesis and Dissertation post-2024
This dissertation investigates the role of subnational actors in European Union (EU) multilevel governance networks focused on reducing urban poverty and achieving the United Nations Sustainable Development Goals (SDGs). Focusing on the SDG #1 (No Poverty), SDG #11 (Sustainable Cities and Communities) and SDG #17 (Partnerships for the Goals) it examines the participation and impact of subnational actors in two case studies: Naples, Italy and Krakow, Poland. Using Social Network Analysis (SNA), the research investigates the configuration and performance of the networks created within the framework of the URBinclusion projects, which are part of the URBACT and Urban Innovative Actions …

Pfas Litigation And Industry “Science”: Combating Deceptive Industry Practices, Dayna Smith
Western New England Law Review
PFAS have become a hot spot of litigation due to their growing notoriety as one of the greatest chemical threats of our time. Yet, due to concerted efforts by the PFAS industry, PFAS cases are likely to face a significant hurdle in the courtroom. Historically, industry groups have funded studies to lend support to their products, leading to a high risk of bias that has potentially far-reaching consequences. Further, there is mounting evidence that the PFAS industry actively used funding to manipulate science, while also engaging in other deceptive practices to hide potential health risks. This industry “science” then makes …
Duty To Protect: Updating Law Enforcement Tort Liability To Align With Contemporary Standards, Nicholas Emanuel, Lauren Loeb, Gavin Partington
Duty To Protect: Updating Law Enforcement Tort Liability To Align With Contemporary Standards, Nicholas Emanuel, Lauren Loeb, Gavin Partington
Western New England Law Review
Can civil tort law make law enforcement services safer and more effective? The purpose of tort law is to protect the public by imposing an obligation to act responsibly and avoid causing harm to others. But tort law is generally inapplicable to the profession of policing because of the public duty doctrine, the theory that police owe a duty only to the public at large, not to any individual. That doctrine and similar rules render police immune from civil liability even in cases of egregious failure to protect the public. Public safety—and confidence in law enforcement—suffer as a result.

Dc To Ac Voltage Source Converter Control System, Mohummad Tark Elgassier, Jordan M. Reichhardt, Brayden Richard Young
Electrical Engineering
The Voltage Source Converter Control System integrates a control system for a 2-phase half-bridge voltage source converter (VSC) utilizing a TMS320F2837xD Dual-Core Real-Time Microcontroller. VSCs are critical for the integration of power production into the power grid. They allow for accurate control over DC-AC energy conversion. Additionally with the improvement of renewable energies VSCs play a critical role in controlling the flow of these environmentally controlled and more unpredictable sources of energy. The control system regulates the output current and voltage, regulates switching patterns, and maintains power stability under varying loads. Within the control system Digital control systems, PWM generation, …
Administrative Forum Shopping, Amy L. Stein
Administrative Forum Shopping, Amy L. Stein
Fordham Law Review
Allowing private parties in litigation to stack the deck in their favor through forum shopping is standard fare in the United States. But not everyone realizes that public legislators engage in a similar exercise when they stack the deck in one party’s favor through “jurisdiction-stripping” or “jurisdiction-channeling” provisions. Congress can strip federal courts of all or some of its jurisdiction, channel jurisdiction over a particular class of cases into one particular court, and even strip the U.S. Supreme Court of its appellate jurisdiction. Understandably, this last category has received the most attention, as scholars are drawn to the penultimate conflict …

Pressing Charges: Criminal Fees And The Excessive Fines Clause, Annemarie Foy
Pressing Charges: Criminal Fees And The Excessive Fines Clause, Annemarie Foy
Minnesota Law Review Vols. 106:2 onward (2021-present)
Millions of people owe money to the government as a consequence of a criminal charge. But while some of that debt is tied to fines or restitution, much of it is levied as fees, or payments owed to the government for the administration of a defendant’s criminal proceedings. Criminal fees can include costs assessed for pretrial detention, a public defender, a jury, a court appearance, filing a document, electronic monitoring, and more. They are assessed at every stage of a criminal case and for all types of offenses. While state and local governments claim that criminal fees are necessary to …

Informing Choice: The Role Of Adoption In Women’S Pregnancy Decision-Making, Elizabeth R. Kirk, Ryan Hanlon
Scholarly Articles
In the wake of the Supreme Court’s opinion in Dobbs v. Jackson Women’s Health Organization, the authors of this Article offer a practical, collaborative response to a seemingly intractable, divisive issue. Kirk and Hanlon draw on their academic expertise in law and social science, respectively, to address the paradox of the general esteem for the institution of adoption alongside the rarity with which adoption is chosen. In this Article, they examine social science data and literature on women’s pregnancy decision-making in order to explain the need for laws and policies that promote informed choice. They introduce never-before-published survey data and …
Associational Rights Versus Nonprofit Transparency: Information Reporting In The Internet Age, Roger Colinvaux
Associational Rights Versus Nonprofit Transparency: Information Reporting In The Internet Age, Roger Colinvaux
Scholarly Articles
For decades, the nation’s charitable and nonprofit organizations have been required to file an information return, known as the Form 990, with the Internal Revenue Service. Congress mandates that the return be made publicly available. Such information reporting, both to the IRS and to the public, is the cornerstone of the federal government’s approach to assuring that nonprofit organizations are legally compliant. The Supreme Court’s decision in Americans for Prosperity Foundation v. Bonta (APF), however, casts a shadow on the constitutionality of nonprofit reporting requirements. In APF, the Court held unconstitutional California’s effort to require charities to …

A More Luminous Beacon, William M.M. Kamin

Over the Supreme Court’s past four Terms, federal post conviction habeas corpus has been placed on the chopping-block. Its fate hangs in the balance of an historical debate over the maxim, oft recited by the Court between 1830–1953, that post conviction habeas reaches only “jurisdictional defects” — as opposed to “mere error” — on the part of the convicting court. Justices Gorsuch and Thomas maintain that “jurisdiction” carried then the same narrow meaning it does now: power ab initio over the offense charged and the defendant’s person. Justices Kagan and Jackson contend that, in this context, “jurisdictional defect” was understood …
